1. Convene Public Hearing - 7:00 P.M.

Mr. Archer, Chairman, called the Public Hearing to order at 7:04 p.m.

Mr. Archer, Chairman, read aloud the following Notice of the Public Hearing for the record:

NOTICE OF PUBLIC HEARING

Watertown, Connecticut

The Watertown Town Council will hold a Public Hearing on Monday, May 6, 2002 at 7:00 p.m. in the Polk School Library, 437 Buckingham Street, Oakville, Connecticut to consider the

TOWN OF WATERTOWN ORDINANCE CONCERING SKATEBOARDS,

IN-LINE SKATES AND SCOOTERS

Copies of said Ordinance to be repealed are available at the Town Manager's Office (424 Main Street, Watertown) and the Town Clerk's Office (Town Hall, 37 DeForest Street, Watertown).

NOTICE OF PUBLIC HEARING

I hereby certify that on April 25, 2002 I left a duplicate copy of the attached Notice of Public Hearing, Town of Watertown, Connecticut with Virginia Stewart its Town Clerk to be held on May 6, 2002.

I further certify that on April 25, 2002, I caused a copy of said Notice of Public Hearing to be published in the TOWN TIMES, which newspaper has a substantial circulation in said Town.

I further certify that on April 25, 2002, I caused to be set upon the signpost or other exterior places nearest the Office of the Town Clerk and all other places and signposts designated by the Town, a written copy of said Notice of Public hearing signed by the Town Manager of the Town of Watertown.

I further certify that all the above acts were done at least five (5) days before the holding of the Public Hearing on May 6, 2002.

2. Public Participation

Kai Leszkowicz, 53 Cutler Knoll, Watertown, CT 06795

Mr. Leszkowicz: I went over it with Mr. Frigon and it was pretty much everything we were looking for. I just urge you to pass it. It's not permanent, but right now at the time it will be something that most skateboarders will agree with. Everyone understands it, the kids I talked to, and it will just be like a waiting period now until we could actually get funding for a facility.

Robert LeBlanc, 78 Highland Avenue, Watertown, CT 06779

Mr. LeBlanc: I am not against skateboarding, I'm against Section 3c, that states private parking lots which are properly posted prohibiting the use of wheeled devices. Does that mean we are allowing skateboarders to go onto private parking lots if they're not posted? Who pays for the posting? You go to a businessman out there and say hey, you've got to post this thing or they're going to use your parking lot for skateboarding. My question is are we sanctioning the use of private parking lots for skateboarding if they're not posted? That's my question.

Mr. Archer: Neither of those questions are answered in that item, you're correct.

Mr. LeBlanc: Also, I'm going to bring this up at the Regular Town Council Meeting. You are stipulating in this ordinance, as in many ordinances, that you can fine people up to $100.00. Is that $99.00 or $100.00? The reason I ask is that the Superior Court Fee Booklet that stipulates you cannot fine someone $100.00. You can fine them $99.00 for any non-parking ordinance. You can only fine them $99.00. And when you fine them $99.00 it becomes $75.00 because they round it off from $50.00 to $99.000 as $75.00.

Mr. Archer: Well I'd probably have to talk to the Town Attorney to get clarification on that, but I think up to means up to but not inclusive of.

Mr. LeBlanc: Well as I say the law reads it says up to $100.00, so I'm saying . . . . . . .

Mr. Archer: I can't answer that one.

Mr. LeBlanc: So in other words even a $99.00 fine becomes a $75.00 fine. I will bring it up at the Regular Town Council Meeting also.

Karen Leszkowicz, 53 Cutler Knoll, Watertown, CT 06795

Ms. Leszkowicz: I think that the ordinance is a really good compromise. I think that's all that we were asking. I think this gives the kids in this Town places to be, whether they are public or private. There are private individuals who have said they can use their property and I'm sure if they don't want to they will post it so that kids can't use it. I think they need this now because there's really no place for these kids to go. I really don't see it as a problem. I think it's just going to give them a place where they are not hassled and I think it's a good start. Yes, we do need a park but that's a whole other issue. I urge you to pass this and let the kids have some freedom in the Town to pursue their activities.

Mr. Archer: Is there anyone else? Anyone else? No? Going once, twice? Hearing none we'll Close the Public Hearing.
