            Mr. Fusco:  I'm here regarding the sewer extens= ion on Straits Turnpike.  I'd just li= ke to say that I'm for this project, and I'd like to see it go to referendum so t= hat this is done sooner rather than later.&nbs= p; We all know costs are increasing for all kinds of projects, especial= ly something (inaudible) as soon as possible so the Town can vote on it once a= nd for all and hopefully go forward with this project.

            =             Mr. Pawlak:  I have a letter from the Chief and Acting Fire Marshall, Larry Black, regarding the appointment of the Fire Ch= ief, and I will read it in its entirety:

            =             I am writing you and the other Council members about the continuing discussio= ns about naming a new fire marshal for the Town of Watertown.  It is disturbing to me and many of= my fellow firefighters that the process seems to be bogged down by both the dispute of who has the authority to name the position and who the position = may report to.  This extremely imp= ortant position and the positions of any deputy marshals or inspectors have a dire= ct connection to the fire and life safety of the residents of the Town of Watertown.  This position should have been fil= led prior to Marshall<= /st1:City> Burrows' retirement, and now that the date has passed it is very important = that we proceed with a replacement as soon as possible.  We should not be waiting for a pos= sible reorganization of our department heads, a process in itself that if ever ta= king place will most likely take months to complete.<= span style=3D'mso-spacerun:yes'>  It is also evident to me and I bel= ieve to Atty. Pilicy that according to the Connecticut Statute 29-297, copy atta= ched, it is the Town's legislative body's responsibility to appoint the Marshall's staff.=   This is backed up by the copies of minutes of past Council meetings, attached, showing approval of past marsha= ls by the Council.  Manager Robso= n has informed me today that she has not placed the subject on this coming week's Council Agenda because of the reason shown above.  She also informed me on December 1= 6, 2005 that she was considering splitting the Chief and the Marshall position.  This after tel= ling me in earlier conversations that she was leaning toward naming me as a Marshall.  Then she proceeded to ask me if I = would act as Acting Marshall until the process is complete, which I am doing and certainly don't mind doing, although I am somewhat confused as to why I'm g= ood enough to act as Marshal but not good enough to do the full time job.  As Fire Chief and member of the Watertown Fire Department I should let you know that we do everything possi= ble not to let politics get involved in our department.  It only makes sense that we cannot= and should not be swayed by political views.&n= bsp; We must be able to function for the common good of the Town and not = be influenced by different political views.&n= bsp; I think this is why this situation is so frustrating to all of us.  This is an important appointment t= hat is being delayed by what appears to be differences of opinion between the Coun= cil, the Manager, and possibly the different parties within the Council.  On behalf of all the members of th= e Fire Department and myself I ask that you continue the discussions on appointing= the Fire Marshal and not delay this for any possible reorganization.  The Marshall's Office cannot adequately fun= ction with only one person, we must move forward as soon as possible.  Please place this on your next Agenda."

            =             I wanted to also ask a questions, I just wanted to follow up on something we discussed awhile ago, and that was the greenway t= opic that had been under discussion several months back.  I just wanted an update on that fo= r the next Agenda Council meeting, if you have something on that, Meredith.

            =             I know that the budgets are starting to come in.  I've seen the one from the Police = Department, and I just wanted to reiterate what I had said earlier, I think perhaps at = our first operational meeting of the Town Council back in November, probably the 19th I think it might have been, and I had discussions regarding what my expectations were with respect to taxes in Town and at that point I believe= I said that I was looking for at the most about a 2.5% increase in taxes.  How that filters back down to the budgets we don't know yet, but that is a matter of concern for me and for t= he rest of the Town Council members.  I did have a brief conversation with Frank Nardelli this afternoon and he indicated that he did get the preliminary numbers on the growth of the Gran= d List, which is encouraging because if I remember correctly Frank said it was somewhere in the upper 2's, 2.9% or so which is a very healthy growth so I'm pleased and optimistic with that particular development.  I also know that in conversations = with the Police Department, they are concerned about their emergency communicati= on system, both for them, the Fire Department, and Public Works, and they are looking at upgrading that system which I believe is 20 years old and was purchased used at the time, and that's about a $400,000 bill that we're loo= king at.

 

            =             T= he Town Manager informed me that we have not heard any news back regarding the= application for a STEAP Grant, so that is still in limbo.

 

            =             I have a Proclamation; is Neil Burrows here?=   I have a Proclamation for you, Neil.

            =             W= HEREAS, Neil S. Burrows joined the Watertown Volunteer Fire Department in August, 1= 969; and

 

            =             <= span class=3DGramE>WHEREAS, Neil was appointed Deputy Fire Marshall in 1987 and = Fire Marshall in 1992.  He also serve= d the Town of Watertown<= /st1:City> as Fire Chief from 1987 to 1997.  He served on many different committees on both the local level and state level= all working in the name of fire safety and fire prevention; and

 

            =             W= HEREAS, Neil retired as Fire Marshall on December 23, 2005; and

 

            =             W= HEREAS, Neil has dedicated many years of service serving the citizens of Watertown and Oakville and has always performed his duties to meet the highest professional standa= rds; and

 

            =             W= HEREAS, the Town of Watertown owes Neil S. Burrows a deep debt of gratitude for his devotion and = for his roles within the Watertown Fire Department and the Town of Watertown.

 

            =             N= OW THEREFORE BE IT RESOLVED that I, Joe Pawlak, Chairman of the Watertown Town Council, on behalf of the entire Town, wishes to express its profound gratitude to Neil S. Burrows and wishes him = well on his retirement.

        &= nbsp;   Ms. Robson:  We've started tod= ay on the budget meetings with department heads and obviously it will take quite awhile to get through all that but we did start today.

 

 =            I also wanted to clarify a report that was in today's Republican American that said that the organizational study that we did was $35,000; that is not the case, it was budgeted at $10,000 and actually came in less, at about $9,300= so I just wanted to make sure that that was clarified.

      = ;            &n= bsp;            = ;            &n= bsp;    Mr. Cavanaugh:  Another 3 storm's worth, and we go through, we budget "x" amount of sand per storm.  Unfortunately we're getting hammer= ed with costs like everybody else.  Two years ago we were paying in place $17.15 per yard of material, in place, wh= ich is on the road; the current cost this year is $25.68 per yard in place, whi= ch is almost a 50% increase in material costs over the last 2 years, so by the time we come up with another couple of weeks, the last 2 years we had about= 12 storm events after this date, which is February and March.  Traditionally when we enter Februa= ry and March we get more snow than ice and snow is actually a good thing because it uses a lot less material, but then of course there are no guarantees.

      = ;            &n= bsp;            = ;      = ;           Mr. Cavanaugh:  On a daily bas= is in weather like today we typically put out what they call a half bucket per tr= uck, which is a couple of yards per truck, we have 15 trucks, so on a routine day we're spreading between 20 and 30 yards of sand and salt material just to t= ake care of the routine ice spots around Town.  What I call a school storm event or= a callout is when all of the trucks go out and they're sanding and plowing and really maintaining the road.  = Unfortunately when we have an ice situation like we had this past weekend, you can apply = all the sand and salt you want on top of it, it either blows away or washes away and you're out there reapplying it and reapplying it and you're scraping and you're applying and you're scraping and you're applying and it chews up a l= ot more material which is why Elaine is right, the snow events are actually a = lot easier on us because you push the snow to the side, you hit the road, and you're pretty much done.  Unfortunately with ice, like we're having this rain and freeze, you = just keep going back and back and back and we'll be chasing ice for weeks as they call it.  Not particularly good news.

 

      = ;            &n= bsp;            = ;            &n= bsp;    Mr. Pawlak:  Just like fuel and electricity and gas.  Elaine, just a point of clarification, and the reason you suggested we have a Town Meeting for this= is because we've approached the limit?

      = ;            &n= bsp;            = ;            &n= bsp;    First on this item, we have received 8-24 Approval from Planning and Zoning for t= he project.  Based on a conversat= ion at the last Town Council meeting we have asked Haestad, which is our consulting engineer for the Water & Sewer Authority, to review their own project estimates as well as the developer's bidder that had submitted a bid to the developer himself, the results from that investigation was that Haestad sti= ll believes that the project may in fact be higher than the $2,036,650 by about $368,000 or so.  We asked for = and received a letter from Haestad regarding permitting time estimates, cause that was a question as well.  They have estimated that it would = take, from the time of submittal, it would take about 3 months to get the approvals for the permits.

      = ;            &n= bsp;            = ;            &n= bsp;    Mr. Houlihan:  Good evening, my name is Bob Houlihan, I represent the Heritage Development Group.<= span style=3D'mso-spacerun:yes'>  Let me try to put this into perspective.  If I may I'm goi= ng to read from a memorandum.  We en= tered into an agreement with the Town of Watertown Water & Sewer Authority on October 17, 2005.  This was a = time sensitive agreement.  It was b= ased on and supported with engineering and cost estimates that were revised just prior to the date of the agreement.  The agreement required that the Town adopt a funding ordinance based= on that cost data within 60 days of the agreement and then schedule a referend= um within 60 days of the funding ordinance.  In return Heritage committed to pay= 100% of the designated general benefit portion of the project.  This agreement was approved by the= Town Council and designed by the Town Manager.  We are desirous of living up to our obligations per the letter of the agreement and would ask respectfully that the Town do so as well.  This project cannot go through a f= ormal binding bid process if the funds are not approved and it's very typical that you approve the funds before you go to bid, I think almost all, I can't thi= nk of a Public Works project that worked the other way around.

      = ;            &n= bsp;            = ;            &n= bsp;    Mr. Houlihan:  Heritage Development Group did howe= ver, in our due diligence, procure an informal bid from a bonified contractor, a= nd we did this in our due diligence back in October when we designed the agree= ment cause we have the same concerns you have.  And we believe that this current, = sort of last 2 week process in our minds confirms that the $2,036,650 number is a good estimate.  It is true tha= t when the Town went back to Haestad and asked them to take a second look at their number, they increased it, we did too, but our number is about $1.3 compare= d to their $2.1, so technically speaking you've got 2 bids that average pretty c= lose to what this ordinance asks the taxpayers to authorize.  We respectfully request that the T= own Council vote expeditiously to set a referendum because our project is dead = in the water right now and if there's one thing guaranteed to make the project cost more it's delay.  This pr= oject was designed and engineered 10 or 15 years ago; in discussions with Frank earlier today it's my understanding that the estimate back then was $900,00= 0 so I think as time goes along, the numbers, it's a rolling donut.  The fact is it is going to cost wh= at it costs, the taxpayers can rest assured that it won't go over $2,036.650.  All Pub= lic Works projects involve some level of cost risk.&= nbsp; Even if you went out to bid you wouldn't know what the project costs.  Even if you went out t= o bid, because there are contingencies, there are line items that involve variances.  Few, if any Public= Works projects in Watertown have the unique advantages of this Wattles Brook Sewer Project where a priv= ate developer is offering to pay 100% of the designated general portion of the project. We feel the best way to represent your constituents is to expedite this sewer extension because it will facilitate the infusion of millions of dollars of net tax revenue estimates at $5,000,000 during construction and = then another $1,250,000 annually for the development that we're proposing that is fortunately going to be on the line that's been planned there for 15 years.  The magnitude of any potential cost overrun is meaningless in the context of the annual net posi= tive tax advantages of proceeding and we're picking up the difference.  We've agreed to pay 100% of the designated general portion of the project regardless of cost.  That means even if there is an ove= rrun there is no new dollars required by the taxpayers, so I think the overall context here is this is really not the project to experiment with or delay = but rather to expedite.  This is a really good deal for the Town and we look forward to living up to the lette= r of our obligation and we feel the Town is contractually obligated to do so as well.  We do want to work with= the Town Council on this.  Thank y= ou.

           &nb= sp;            =             &nb= sp;           Mr. Rinaldi:  To the best of my knowledge, the length of time I've been on this Council, we have always let special counsel be appointed by the Town Attorney.  We voted as a Council to pay the T= own Attorney $135.00 an hour, that was agreed upon, = but I don't remember making any agreements on special counsel.  I read the minutes from the last meeting, even though I wasn't here, and Mr. Kane felt this was a political move.  I don't think it is.  I think appointing Mr. Krug is in = the Town's best interest.  Atty. K= rug has done this sort of work before and I feel that he's eminently qualified = to do this sort of work, and I just want to remind everyone here that it wasn't too long ago, the preceding Council, that rejected two of our seats to commission in this Town and put in a person of their own choosing, disregar= ding an agreement that was about 20 years old between the two parties, that's al= so politics.  Having said that, I'm going to move the question.
