= Mr. Pawlak: We've received two F.O.I. rulings = on a couple of complaints that were lodged against the Town Council. Basically both of them were in fav= or of the Council, although we do have to do some corrective action on one of them which revolved around the Executive Session, so we'll tidy that up and pass= the information around to other boards and commissions so they're apprised of w= hat has to be done in similar situations.

= A= dditionally I took the liberty of sending Lt. Governor Kevin Sullivan a letter regarding the $600,000 grant which Water= town received, I believe back in 04, to be used for the purchase of athletic fie= lds or property to be used for athletics. We were asking that the Bonding Commission change the wording of that grant so that we can use those monies for renovation or modernization of existing facilities which gives us much broader ability to improve our facilities.

= T= here are two ordinances which have come to my attention which will have to be ac= ted on within the next month or so.

= I know that we're well along in the budgeting process. The School Board has been presente= d with a budget from the Superintendent and I know the Town Manager is working on = budgets with the various department heads so hopefully within the next 2 to 3 weeks we'll start to work on that on the Town Council level.

= I have some correspondence that I would like to read into the record also.

= ; &n= bsp; Mr. Kane: You mentioned the l= etter to the Lt. Governor, I believe, why wouldn't we speak to Representative Williams, after all he was the representative who got us the funds to begin with?

= ; Mr. Pawlak: Sean and I have b= een speaking on this one probably for the better part of a month to a month and= a half and he was working it from his end and I just wanted to push a little = from the other side to hopefully get, I guess what we'd call a pincer movement to get this thing going and I did copy Sean in my letter to him, so we're both working on it. I'd just like = to get it moving along so we know as quickly as possible where we are; I don't wan= t to lose the money, basically is my concern.

= T= his is a letter that was sent to me from Joe McGrail who was the Chairman of the Economic Development Commission. I was tardy in reading it into the record.&n= bsp; It is dated 12/15/05.

= &= quot;Mr. Pawlak: The Economic Developm= ent Commission has been on record for many months expressing a need for a study which would determine whether the Town of Watertown would benefit from hiring an Economic Development Coordinator. Although we feel that this positio= n is vital we can't say for certain how best to fill the position. From our position it's difficult to gauge whether this position would best be filled on a full time or part time basis or whether the responsibility could be shared among several present T= own employees. Our hesitation in = making a firm recommendation is with the best intentions for the taxpayers in our Town. A position such as this= would be a costly initial expenditure and we feel a comprehensive study would all= ow the Town to spend the money wisely.

= In the meantime it is our belief that the Town would benefit greatly by naming= an acting E.D.C. Coordinator immediately.&nbs= p; Although this person would only temporarily fill the position they c= ould also help in the evaluation study of how this position should be handled in= the future. The benefits of an Ac= ting Economic Development Coordinator would be immediate. This person will meet with current business owners, would meet with potential developers, meet and greet new businesses, make follow up calls to individual businesses that have express= ed interest in moving to our Town, help businesses through the P & Z proce= ss, and apply for State and Federal economic development grants, etc. To this point the Town Manager has= had the sole responsibility of this function.&= nbsp; It is our belief that given the demands that our present or any futu= re Manager would face in their day to day duties, they would be hard pressed to single handedly cover such a vital position. We'd like to go on record that we acknowledge and appreciate Meredit= h's efforts, but we feel a more focused approach is needed at this time. With our request comes a recommend= ation for this acting position. At = our last meeting the E.D.C. we voted unanimously to recommend Charles Frigon for this position. The E.D.C. has worked with Chuck in the past and we have the utmost confidence in his ability. With his experience = as the Acting Town Manager, Chuck is uniquely qualified for this position and we f= eel there isn't a better Watertown= cheerleader. By having Chuck temporarily filling this position, under Meredith's leadership, we would fe= el very comfortable that all of our economic development bases are covered in = the near term. During Chuck's ten= ure as Acting Town Manager the Purchasing Department managed to work efficiently, = and it is our hope that those past stop gaps could be used during this temporary assignment. The E.D.C. would = be more than happy to discuss this with the full Council and we would request = that this matter be handled expeditiously and be embraced in a bipartisan fashion. &= nbsp; Ms. Robson: You had asked for= an update on Steele Brook, we have contacted the consultant that we're using b= ut we're going to be setting up a meeting as quickly as possible to go through where we stand right now and what the next steps are, so hopefully at the n= ext meeting I'll have more detailed information for you on that project, but we= are moving ahead on it.

I know Larry served on the Fire Department for years and he's done a great job and everybody speaks highly = of him and I'm sure he's going to do a great job as Fire Marshall, and now our next job is to find a Deputy Fire Marshall, so with Larry's help and others= in Town we'll be successful in that search, so thanks, Larry.

&= nbsp; B. = Discussion on Town Manager's Recommended Creation of Department of Community and Econo= mic Development

&= nbsp; &nbs= p; Ms. Robson: I've summarized for you, but perhap= s for the public's benefit, let me just summarize the cover. I'm recommending a departmental reorganization that would entail the creation of a new Department of Commun= ity and Economic Development. My = main rationale for this change is to provide for operational efficiencies and improvements, not the least of which would be to provide a greater focus on economic development. I am recommending that you consider the savings to be long term and not immediat= e, since the readily identifiable savings relates specifically to existing employees. With or without sa= vings, however, I believe this new structure would improve our operations and shou= ld be fully considered and implemented. = It is my intention to seek the input of the various land use boards to get the= ir feedback, ideas, and concerns regarding this change at the same time you are all reviewing this. Then we c= an discuss this issue again at greater length with more complete information.

&= nbsp; &nbs= p; I've summarized for you the structure, the rationale, which I've explained brief= ly, the structure would be that this new Department of Community and Economic Development would have under it the following functions: Engineering, Planning, Zoning, Wet= lands, Building Inspection, and Health, although as you all know health is provided through the Torrington Area Health District, so it is a service that we contract for. I have identifi= ed a number of issues relative to the change of staff from one supervisor to department head and from two department heads to supervisors and some of the other iss= ues that would be involved in this sort of a change. I have estimated some costs in sav= ings, though again it's not my intention for the existing employees to suffer any loss in paid compensation. It= 's ultimately your decision on benefits and all the rest, but I'm looking at t= his as a long term savings to the community, not immediate, because of the exis= ting long term employees that are involved, so ultimately it's your decision, bu= t my recommendation is based on the operational efficiencies that would occur ba= sed on this reorganization. I don= 't know if any of you have any questions, if you just want to mull this over f= or awhile, I do have the meeting scheduled already with the Planning and Zoning Commission and we'll schedule the other meetings with the other boards as quickly as I can get on their calendars.

&= nbsp; &nbs= p; Mr. Primini: I'd personally like to see a cost analysis of this of what it would cost, any conf= licts with bargaining units?

&= nbsp; &nbs= p; Ms. Robson: Well I have that summarized in ther= e so if you need any additional information let me know.

&= nbsp; &nbs= p; Mr. Primini: I mean you're saying long term, whi= ch I'd like to see, but I'd like to see what it would cost, maybe immediate future= , near future?

What I'm looking at, you're going = to put what's currently a department head down into a bargaining unit, he's going = to be supervising, he's going to be in the same uni= on he's going to be supervising?

I had thou= ght when we had just talked about this 6 or 7 months ago that we had decided th= at there would be no deferred comp for any new hires, that= we were cutting it off here.

&= nbsp; &nbs= p; Ms. Robson: There's a caveat, I don't remember = the exact words, but there's a caveat in that resolution that says whatever tho= se provisions were that you agreed to didn't affect any employees that were transferred, reorganized, I forget the exact language, but so that it didn't affect them= .

&= nbsp; &nbs= p; Mr. Nardelli: If those people go into the Supervi= sor's Union, that has to obviously be negotiated with the Supervisor's Union. You're talking about the department heads going into the Supervisor's Union, or are you talking about . . . . .

&= nbsp; &nbs= p; Mr. Rinaldi: No, I understand that, but with the Department Heads presently we, as a Council, bargain with them directly, and I'm just wondering if it would cost us more bargaining with the Union or bargaining with the Department Heads stric= tly through the Council?

&= nbsp; &nbs= p; Mr. Pawlak: It wouldn't change as far as the De= partment Heads are concerned, there's no change there. The only difference there would be= , if this proposal was accepted either in part or in f= ull, we would be dealing with 1 or 2 less Department Heads. That's the only difference, but the discussions regarding salaries and benefits would be the same, at least for this year.

&= nbsp; &nbs= p; Ms. Robson: Well again my focus is on improving efficiencies and operations. = Will there be additional costs potentially/ I don't know what the legal= costs might be in terms of negotiating with the Supervisor's Union. It might go through quickly; it ma= y not.

&= nbsp; &nbs= p; Mr. Pawlak: You're talking about adding these t= wo positions into the supervisory staff as part of the . . . . .

&= nbsp; &nbs= p; Ms. Adams: Into the union yea, you're basically opening up the contract, yea, and there are costs there too.

&= nbsp; &nbs= p; Mr. Primini: Well one of my concerns is the Depa= rtment Heads are limited to 35 hours of overtime for the year, and I know a couple= of these Department Heads currently right now they put in much more than that = 35 hours. If we have to start pa= ying that in time and a half, I potentially think it's going to cost a lot more money potentially, cause I know the hours some of these people put in. Just mee= tings, Mary, just meetings that she goes to a couple of times a month, the input p= ut into that, that's something I'd like to find out more about, if you do something like this, instead of 35 hours a year is it going to be a couple hundred hours a year? We're k= ind of biting off our nose to spite our face is what I'm concerned about.

&= nbsp; &nbs= p; Mr. Pawlak: Is that something that we could per= haps get our hands around because the department managers, are they entitled to = comp time?

&= nbsp; &nbs= p; Ms. Robson: Comp time.

&= nbsp; &nbs= p; Mr. Pawlak: So if we could look at their comp t= ime, if that is in fact accurate, that would give us some sort of a handle as to what sort of potential overtime costs we're going to face.

&= nbsp; &nbs= p; Mr. Nardelli: We get comp time for meetings but we don't get comp time for working extra hours, so it’s not, we're looki= ng at if they come in early or work later, that would also be overtime (inaudi= ble).

&= nbsp; &nbs= p; Ms. Robson: But keep in mind with the new depar= tment director, he would be responsible for approving overtime, so there may be additional hours of what amounts to right now comp time that would no longe= r be incurred under this new scenario.

&= nbsp; &nbs= p; Ms. Adams: In a matter of opinion, I would thi= nk that with the amount of meetings that they go to, and just the applications= in both of those offices, it's not concrete like other offices are. Tomorrow you can have 10 applicant= s walk into the Zoning Office and say I want to apply for a subdivision, you don't know. The same thing with the result is the Building Inspector has to make sure that all of these residen= tial houses are inspected, so it’s not something that is definitely concre= te, it changes all the time so I don't see how anyone, if the work has to get d= one, they're going to have to do it, the overtime is going to have to be paid, so basically as Department Heads they work until the work is done on a set sal= ary.

&= nbsp; &nbs= p; Mr. Kane: First of all I appreciate the Town Manager looking into this and trying to make our structure more efficient a= nd reorganization, I give you credit for that and we should continue those kin= ds of efforts. My question is in regards to economic development because this is the tag line of this department. I don't see an ec= onomic development phase here or goal, I see more of engineering, planning and zon= ing, wetlands, building inspection. Where is the economic development portion?

&= nbsp; &nbs= p; Ms. Robson: The economic development portion wo= uld be in the, what I consider the ombudsmen types of services that the new depart= ment head would provide under an umbrella department, so that when somebody come= s to this new department it's one stop shopping. They know where their application = stands or their permit stands and it's just an easier way to work through our syst= em than to have to go to several department heads. The other thing is, in fact in the letter from the Chairman of the E.D.C. in terms of getting out there to bus= inesses, following up with businesses, getting them the information they need, I thi= nk it's going to be a much better process having this new set up than it has b= een in the past.

&= nbsp; &nbs= p; Mr. Kane: And the Town Engineer is capable of= all those different things, like you said, working with the Chamber of Commerce, reaching out to the local business community, he has those abilities as wel= l?

&= nbsp; &nbs= p; Mr. Robson: Absolutely, I believe he does.

&= nbsp; &nbs= p; Ms. Adams: The person, and not the position, t= he person she wants (inaudible).

&= nbsp; &nbs= p; Mr. Primini: The Town Engineer position was implemented I believe about 3 years ago, and the purpose of that, Paul and Elaine can vouch for this, the purpose of that was all of our projects that= we had, we were contracting out engineering, and that was always a built in 10% cost for engineering and that was the main reason we hired the Town Enginee= r, because the engineering job saves the Town a lot of money by doing that. And I know that the Town Engineer, between Roy Cavanaugh who started doing it and then Chuck Berger took over those two jobs, I'm sorry but I think they've got their hands full by just doing the Town Engineer and that job does save us a lot of money in the long run, that's just my two cents.

We find on Public Works, going back Paul what, you've been on there 6 years an= d the 4 years I've been on in addition to the 4 with you, you're looking at mista= kes that have been made, projects signed off on by somebody who just gets checks and there's no accountability long term, they get paid, that's it, they're done, whereas if it's a Town employee who's signing off on it, you then have accountability.

&= nbsp; &nbs= p; Mr. Pawlak: You're talking about someone whom we hired from the outside?

&= nbsp; &nbs= p; Ms. Adams: Exactly. If you farm it out it's not cheap.<= /p>

&= nbsp; &nbs= p; Mr. Primini: And the problem, we had a Town Engi= neer I believe years ago, and then what happened, we're paying for the sins of not having a Town Engineer, all these a, if anybody knows these flooding control projects we've had, a lot of them were created by developments that went in that traditionally everybody took those contractor's words for it that that= was it; now we have two people actually between the Public Works Director and t= he Town Engineer confirming yes, this is going to work and this isn't going to work, and what I see what they go through on those plans it's a lot of work, it's= a lot of time, extra time too.

&= nbsp; &nbs= p; Mr. Pawlak: Okay, so your concern in that respe= ct is dilution of his time to be spent for the engineering.

&= nbsp; &nbs= p; Mr. Primini: And that's another thing when I ask= ed for a cost analysis, are we going to end up just contracting out more of the To= wn Engineer's responsibility so it kind of defeats our purpose of even having a Town Engineer.

&= nbsp; &nbs= p; Ms. Robson: I have identified that as a potenti= al increased cost. We don't know= how much of that we'll have, that depends on the projects that we have going on= and the needs at the time, so that one will ebb and flow again based on the nee= ds, but I have identified that as a potential cost.

Eric Brown, Attorney Representing Department Heads

Atty. Brown: I've been retained by a group of th= e Town Department Heads relative to various employment and labor issues as they're affected. I'm speaking tonight about the proposal that has just been discussed regarding the creation of a Community and Economic Development Department and the movement of two curre= nt Department Heads to the position of Supervisor, and the movement of one Supervisor to = the position of Department Head. I think that you've already hit on a number of the issues relative to that ch= ange, but I think that it's important that you be aware of some of the issues rel= ated to labor in particular. The discussion has involved the issue of two of the Department Heads moving to = the Supervisor's Union. I think there's no question that i= f those people are moved to the Supervisor's Union, they'll need to petition to bec= ome members of the Supervisor's Union which = raises issues of recognition. There = have been statements that those two Department Heads, when moving to positions o= f Supervisor, will be guaranteed the same compensation level. Well there are no guarantees in la= bor negotiations, as you know, and that will be subject to approval of the Supervisor's Union, so I don't think it'= s as clear cut as the Town Manager will have you believe with respect to compensation and other benefits that would accrue to those people should th= ey go to the supervisor position.

A couple of other issues that you need to be aware of, we're talking about mo= ving two Department Heads, one of them is a female, one of only two female Depar= tment Heads in the Town, and the other is 68 years old, and so that will raise is= sues immediately regarding potential discrimination towards those two people, if there is not a legitimate reason for creating this position and moving the people. Finally it seems like= it is a fete a comple that Mr. Berger will be moved into the position of Departme= nt Head. It would make sense that the Town consider utilizing a competitive exam format to fill that position setting = out what the parameters of the job are and then finding the best person for that job, and it may be that 1 of the 2 Department Heads that's being considered= to be moved might actually fit the job better than Mr. Berger, who apparently = has already been promised the job.

Those are just a few of the issues; there are other issues related to Charter provisions, appointing authorities, and things of that nature which I belie= ve need to be looked at closely, and ultimately to make sure that this is appropriate for the Town, but also in line with both labor and employment law.
