Mr. Krayeski: A couple of weeks ago one of t= he Council members got up at the banquet and said he tried softball, didn't do= too well, he tried basketball, he was as big as the basketball, he tried soccer, and he didn't do too well, he tried band, and then he said he was spinning = his wheels.

I think right now that we're spinning our wheels with this $600,000 allocation for new fields. I think the dye was cast a few years ago where these fields should be located. I have in = my possession copies of the Minutes of the meeting, Planning and Zoning, Regul= ar Meeting, December 4, 2002, in which Charlie Beliveau from the Board of Education, Vic Vicenzi, who was then Chairman of the Facilities Committee, = and the late Bill Skyrme, they had maps all set. It's unfortunate I don't have the maps. As you know last Thursd= ay all the records from the second floor of the Town Hall were moved up into the lobbies or hallways of Ba= ldwin School and it's unfortunate that these maps could not be located. I was very thankful to Mary Barton = for getting me all these notes. I= t says that the Town owns the property for the two football, two soccer, two lacro= sse, whatever you want, 2 large fields and 2 baseball diamonds, we own the prope= rty adjacent to this building right there, we own the property adjacent to John Mills Complex. That was desig= ned by Mr. Beliveau, by Mr. Vicenzi with Bill Skyrme to put in 2 large fields and 2 baseball or softball fields. = They went so far to have access way through the tennis courts out here, they had access way for emergency vehicles all set up on Edward Avenue. Judy Wick had made a proposal that= there be a 50 foot buffer would be left so the athletic fields don't write on somebody's back yard. This wa= s all set up, 2002 when Dr. Dastur was Superintendent of Schools. It was even mentioned that they di= g all the trenches for lighting and with that if we decide that we would go down there the thing to do would be to go to our very dependable State Representative Sean Williams to see if he could get us a grant to put light= s up down there. If we're going to= spend the money, spend it where we can do something immediately. This property belongs to the Town, we don't have to buy it. That would give us almost immediat= e access to use it, the only thing that would have to be = done is some excavation. The searc= h to put in artificial surface could also be looked at for the lower field, which means you could get a lot more participation. This is not for your kids, it's for your kid's kids. This could be done in 2 years and then everybody would have fields to play on. <= span style=3D'mso-spacerun:yes'> I hope you seriously consider this = matter of using Town property, using that money very wisely to get this done. Ms. Masi: I'm here this evening to speak abo= ut a very serious and distasteful issue that's happening in this community, but before I begin my presentation I do want to pass out my presentation to mem= bers of the Council and the staff.

I hoped that we wouldn't have to be here this evening, but the Concerned Citi= zens for the Preservation of Watertown is here to file an Ethics Complaint again= st members of the Planning and Zoning Commission. I'm going to read my presentation = into the record because I want to make sure that we get in all the facts:

"Town of Watertown Council Chairman = Joseph Pawlak and Town Council Members

I'm here as the President of the Concerned Citizens for the Preservation of Watertown, Incorporated in 1989 as a non-profit group of citizens to further the common good and general welfare of the community. The Concerned Citizens for the Pre= servation of Watertown promote, develop in our community that is a long term solution= to broadening our tax base by providing employers of primary jobs and users of minimal services with the least impact to our environment and small town character.

This is a formal complaint to the Town Council by the Concerned Citizens for the Preservation of Watertown for the removal of 2 Planning= and Zoning Commissioners from that Commission due to a conflict of interest that prevents them from acting in the best interests of the citizens of Watertown.

As you know, the Town of Watertow= n adopted ordinance #03-21-05-263 "An Ordinance Creating a Code of Ethics" on March 21, 2005. The Code of Ethics "seeks to avoid any loss of trust and to maintain and increase the confidence of our citizens in the integrity and fairness of th= eir government". This is done by creating a "process free from threats, favoritism, und= ue influence, and all forms of impropriety so that the confidence of the publi= c is not eroded". This Code of Ethics is reviewed and signed by the members of all Boards and Commissions = of the Town and returned to the Town Clerk where it is retained and remains on= file.

The Town's Code of Ethics further states that under "Section 3-8 Conflicts= of Interest; (i) No public employee or public official may use his position or office for the financial benefit of himself, a business with which he is as= sociated, an individual with which he is associated, or a member of his immediate family."

Equally, the Connecticut General Statues indicates in Sec. 8-11 "No member of a= ny zoning commission or board and no member of any zoning board of appeals sha= ll participate in the hearing or decision of the board or commission of which = he is directly or indirectly interested in a personal or financial sense". Land Use Law and Practice by Robert A Fuller, a noted planning and zoning attorney in the St= ate of Connecticut, under Section 47.3 Conflict of Interest also states, "where an agency member has a conflict of interest it is improper for = him to participate in discussion on the application even though he did not vote= on the final proposal."

Additionally in the June 1, 2005 minutes of the Planning and Zoning Commission's special meeting (included in your packet), former Town Attorney, Randall McHugh, reviewed the issue of conflict of interest and predisposition based again on Land Use Law and Practice by Robert A. Fuller, Under Section 47.3 Conflict of Int= erest, it states that ".. it does not have to be s= hown that the interest of the agency member does in fact conflict with his public duty, but only whether there is an appearance of impropriety so that the pu= blic confidence is undermined."

There are a two members of the Planning and Zoning Com= mission that are in violation of the Town's Code of Ethics, James Lukosavage and Ga= ry Martin. The Commission, inclu= ding these two members, is working on the new Plan of Conservation and Development. One of the controversial issues in the Plan is the recommendation that the 100 acres of industrial zoned land in the Route 262/Route 8 Corridor be rezoned as a Pla= nned Commercial Area which would allow big box retail. This recommendation by the current Commission makeup is not conceptual but site specific, and will most certai= nly lead the way for Konover Developer's big box retail plan with financial enrichment to the two members in question or their families.

Alternate member James Lukosavage is a landowner in the very area of this proposed zone. Regular member Gary Martin, is the son-in-law of a landowner that could be= involved in this retail proposal, and he has admitted to that fact in recent Planning and Zoning meetings.

Although these Commission members have been repeatedly warned by former Commission Chairperson Judith Wick of their conflict of interest, and at least the appearance of a conflict of interest, they to this day have refused to step aside in any of the discussion during the Plan relative to this Corridor an= d a reclassification from industrial to retail use. Also at the May 3 meeting of the Commission, the Concerned Citizens for the Preservation of Watertown, forma= lly and for the record, requested these two Commission members to step aside fr= om any further discussion with respect to this Corridor and reclassification.<= span style=3D'mso-spacerun:yes'> They have refused to do so.

The evidence of Jim Lukosavage and Gary Martins' participation is in the Planni= ng and Zoning Commission's minutes of the meetings while developing the new Pl= an of Conservation and Development; more recently the February 1 2006 minutes, April 26, 2006 Minutes, and the CCPW's videotape of Section 5, the Economic portion of that meeting; the May 3, 2006 minutes, May 10, 2006 minutes and = the CCPW's videotape of that meeting and a portion of the May 3, 2006 meeting.<= span style=3D'mso-spacerun:yes'> In the February 1, 2006 minutes ev= en Commissioner Tedesco indicates that Waterbury politics is tame compared to what "we have right now in Watertown'. He states "he has almost been= sort of told that you vote a certain way and maybe you will get back on, that is= not how it should be done …" I have given a copy of these videotapes and minutes, except the May minutes which haven't been transcrib= ed yet, to Mr. Pawlak to be included as part of the record and to be shared wi= th all of the Town Council members.

Also, Mr. Lukosavage attended meetings of the Economic Development Commission to participate in the discussion regarding the development of the industrial property in the Route 262/Route 8 Corridor and the possible rezoning from industrial to retail. While a= ttending the August and September, 2005 meetings, he also was involved in discussion= s to create the questions used on the December 2005 Economic Development Commiss= ion's survey done by N.E. Willow Group, LLC.&nbs= p; You will have to listen to the audio tapes of these meetings as the minutes are only a brief summary and not verbatim minutes.

As background information, the citizens of this community participated in Circ= le Study Groups to provide input into the Plan of Conservation and Development, and public workshops were held. No significant zone changes were made to the Plan until suddenly a new revised= map was introduced at the November, 2005 workshop when there was a complete turnaround by the Commission to rezone 100 acres of industrial property in = the Route 262/Route 8 Corridor to a planned commercial area. At this public workshop approximat= ely 30 citizens spoke against this proposed zone change, the loss of valuable industrial property and the ability to encourage the type of growth that th= is zone currently allows and could allow, such as hotels, restaurants, distribution facilities, health clubs, day care centers, offices and medical buildings. Only one person sp= oke in favor of this zone change. Ba= sed on this public workshop the Commission voted to leave the land zoned as indust= rial until impact studies could be done.

However, at the March 6, 2006 Town Council meeting Konover Developers made a presentation and outlined their proposal to the Council for the same 100 ac= res in the Route 262/Route 8 Corridor. After this presentation, and the meetings Konover Developers had with Town staff, private organizations and members of the Economic Development C= ommission to gain support for their proposed retail center, the attitude on the Plann= ing and Zoning Commission abruptly changed and big box retail is once again a t= opic of discussion for that area, even though Konover has never appeared before Planning and Zoning with any hard plans, economic data, traffic studies and infrastructure needs.

Continued participation by Commissioners James Lukosavage and Gary Martin in developi= ng the new Plan of Conservation and Development is a violation of the Ethics C= ode, as they have a vested and personal interest in the Plan and will place the = Town in the position of defending itself from a legal reversal in a court of law= .

The Concerned Citizens for the Preservation of Watertown expects the Town Counc= il to appoint a subcommittee to investigate the violation of the Code of Ethic= s, and commence a Hearing on the allegations not more than 60 days after the filing of this complaint, in order to remedy this conflict of interest for Commissioners James Lukosavage and Gary Martin, by the methods prescribed in Section 3-7 of that ordinance which are "(1) public censure and reprim= and and/or removal from board or subcommittee, and/or (2) a civil penalty of not more than $100 per violation".

The Concerned Citizens for the Preservation of Watertown is not only committed = to preserving a progressive quality of life in our community which we have bec= ome accustomed to, but also it is committed to seeing that anyone and everyone = that appears before the Planning and Zoning Commission does so on a level playing field and is heard by unbiased and uncommitted commissioners, free from con= flicts of interest or the perception of a conflict of interest."

Mr. Stanley: I came here to speak as a child gr= owing up in Watertown, a parent in Watertown, a father in Watertown, former high school = sports player in Watertown= , someone who has a great amount of experience dealing with sports in this To= wn. I just wanted to give my opinion on= the grant that is available to us. Hopefully you will take into consideration the best we can get for the dollars that w= e're going to get, spend it wisely. I think we deserve and need fields fast and I think the idea, someone spoke before,= developing land that we have right now and getting the best use out of that is the way= to go. I also hope you consider that we t= urf the field. We made so many mi= stakes with this football field out front, if that was turf in the beginning we wo= uldn't have all these problems we have now. It could have been a multipurpose field where all sports could play, boys, girls, soccer, field hockey, lacrosse, just be fair to everybody. I hope that you do consider someth= ing like that, where we buy the land, develop the fastest way to alleviate the problems we have now, my opinion turf is the way to go and not only that, b= ut I think it should be in a place where we can get lights, cause that also helps too. Ms. Legge: I'm also the Athletic Director= in Town. I also would like to encourage the Council to consider the land that we already have. We're desperate for fields. The few fields we have now are in = pretty good shape, but within a few months, having so many kids looking for places= to play, they won't be in good shape and my big fear is someone is going to hurt. We have the land down h= ere, I thank Jim Krayeski for finding out just how far along it went and then of c= ourse there was no money for it. We= can turf one of those fields, and we can probably put a fence around it for the amount of money we do have available. It could be something that could be done immediately and could be us= ed immediately. It doesn't take = long, once that turf is down they begin to play and it can be used day in and day out. At the same time we migh= t be able to do something with the other fields, so that we could perhaps rest a field so that there would be plenty to go around, but I urge you to move quickly. It is too bad that we couldn't do anything about our field, but the bids had already been placed = when the money was available for turf. We cannot turf the Mills Field because of the drainage and the system that's in there, we have a beautiful field but it has to remain the way it = is, so our next best bet would be to use the land we have available and use it = as quickly as possible. Mr. Fusco: On the March 20th Town Council Agenda there was a line item to discuss the Straits Turnpike sewer project = and at that meeting it was decided to send it back to Water & Sewer for upd= ated appraisal information. I'm wo= ndering, since 4 meetings have occurred, including tonight's meeting, when that will= be discussed again and when we'll see that on the Agenda?

Mr. Pawlak: We have updated numbers which = are basically complete, Mark. Gen= erally speaking, Frank, can verify this for me, but just this afternoon I pulled d= own some emails from Frank Jodaitis, cause I wanted = to know myself where we were with that, and all of the updated appraisals have been received, if I'm not mistaken.

Mr. Nardelli: Correct.

Mr. Pawlak: And it looks like at this point the assessment would come to somewhere around $18,000 per affected household. I asked Frank Nardelli to check wi= th Frank Jodaitis to see what that would entail with respect to the Town's out= of pocket costs, and I think Frank was out today, is that correct?

= ; Mr. Nardelli: Yes.

= ; Mr. Pawlak: So as soon as we = get that information we can then have all the numbers that we need and we can consider it and see what we want to do with it.

Mr. Fusco: Is it fair to say possibly next mee= ting you'll have something?

Mr. Pawlak: Yea, next meeting I'd say probably = more than likely and I think that's June 5th or something like that, about 3 wee= ks from today.

Mr. Traver: I don't have any idea where that $600,000 could be spent, you'd have to ask somebody else, but everybody else knows where it should go so I think we ought to take good advantage of it a= nd get the sports fields where we can. I'd like to say that I’m also a native of town and went through the school system and played all the sports, but I was more reminded of the other gentleman that was referred to that just didn't make it at doing anyt= hing. I do have an idea who that was, bu= t he doesn't have to speak up.

This is budget time and I want to talk about money. And the money I want to talk about= is important because it's conceptual money, it isn't there and it won't be there. = We hopefully are going to get a windfall in a sense from the activity on Bunker Hill Road with, I call it Heritage East, that looks great and I hope that it all come= s to fruition and you take good advantage of that. But the conceptual money that I wa= nt to talk about is all this economic Shangri-La that we're going to have with a regional mall in Watertown. I just want to say unequivocally t= hat it's a loser, if you want to talk about budgets and money, because I'd like= to have you look at a vision, a vision that that 600,000 square foot regional = mall exists today's Day 1. We get some money in and then we h= ave a little problem because the western side of Waterbury wants to come up Falls Avenue, and so they get to the end of Falls Avenue, Sylvan Lake Road, and t= here's nowhere to go, and so now we have this request to widen, straighten, and sl= ow down the traffic on Falls Avenue, which we know of course that combination = is impossible. And then the peop= le in the Waterville section because the highways are jammed up, decides that Sha= w's Hill is the best bet, and a quick shortcut down Franklin Avenue is the way = to go, and we look at another $1,000,000 to overhaul that and then Bushnell Av= enue is next, then Sylvan Lake Road and all this money that this manna from heav= en that we're going to get is all gone and instead of being a good thing we ha= ve a financial catastrophe in Town. I'm not worried about what will happen to the poor people, the local people, the families in Town that own the small businesses on Main Street in Watertown = and Oakville, I know that somehow they'll survive as their business dwindles and dries up but there is unemployment for those local people. So I just want you to think about = the fact that you're not going to have this supposed money from Heaven or from = this Regional Mall. You're going t= o have the revenue, if in fact this happens, which I certainly think it won't and I hope it won't, you'll have the revenue, but from your budget work, you know there's another side of the budget which is the expense side so it's the ex= pense side that's going to magnify and the net will be a loser, so don't spend th= at money because you're not going to have it.= Thank you.

6.&nb= sp; Chairman’s Report

= Mr. Pawlak: We did receive a resignation f= rom Maureen Caine, from the Board of Education. She indicated that her personal an= d business pressures warranted that she had to resign, so that will be taken up by the= Board of Education.

= I have the overtime report from the Police Department and everybody else, and= I note that the Police Department's overtime was up to about $14,000 and I note wi= th sadness that we had another fatality in Town, on the 4th or the 5th down on Route 6, and that accounted for a portion of that. And as a result of that I've asked= the Police Department to step up their procedures throughout the Town to see wh= at we can do to reign in the speeders and the people who ignore stop signs and stoplights and hopefully bring some sanity to our streets. I think that is 5 if I remember cor= rectly since last July.

= One of the items I noticed (Tape #1, Side A ended - may have missed some) carri= ed out between the Town's side and the Board of Ed and one of the things that = we will be looking at, there was mention of shared services with data processi= ng or information services and that is obviously one of them and I just wanted= to make sure that not only on the Town's side would we include the efforts of Frank Nardelli and his group but also that we fold in and consider the information services that are done by the Police Department because I belie= ve we have one officer over there who is doing that, so I want to make sure th= at we meld all of those together so that we can achieve some efficiencies and uniformity.

= We are going to be advertising for a permanent town manager. I spoke with Frank Nardelli this afternoon and we will be advertising over the weekend in Hartford, New Haven, and Waterbury for a full time town manager.= The specifics are being ironed out= . Did we get those all finished, Fra= nk?

&= nbsp; Mr. Nardelli: Lisa and I will= go over those tomorrow.

&= nbsp; Mr. Pawlak: Okay, so those wi= ll be in the weekend papers and we'll see what we get for a response within the n= ext 2 weeks.

= I'm happy to report that respect to the job descriptions for all the department= heads within Town, we have all of them. Did we get Mary's today?

= Mr. Nardelli: I did not receive that one yet= .

&= nbsp; Mr. Pawlak: Okay, so we have = every one except one and we expect to get that, Elaine, Frank and I have copies a= nd we're going to, I'm going to let them sit down, and if any questions come to the top, we'll get those ironed out, and the plan is once we have everything settled, I'd like to sit down with Frank and Elaine and each of the departm= ent heads and go over to make sure we're all in agreement with those job descriptions so we have those up to date, and we are also in the process of looking at comparable salaries for all of our department heads in towns surrounding us, where we have things in commons such as population, budget size, department heads who do similar jobs, so that we can come up with a current job salary or category which we can then apply to our department he= ads, and I believe we can get this all done for July 1st, I believe.

= Mr. Nardelli: Yes we should be able to do that.<= /p>

= Mr. Pawlak: The Memorial Day Parade is on the = 29th and I expect the Town Council members sill participate. My friend here on the left says si= nce we're going north to south, and we're going to downhill, he'll be walking t= his year.

= Every year both in the Winter around Christmas and in the Summer, the Watertown Garden Club makes wreaths and places them on the Firehouse, the Town Hall, = and the Annex, and in the Summer they plant and maintain planters on the bridge where the Oakville= Green, Post Office, and the Town Hall.&nbs= p; In addition to that they annually give out between $1,000 and $1,250 scholarships to Watertown seniors for application toward their tuition if t= hey go to school and hopefully take up some courses relative to gardening and botany or whatever, and I just wanted to recognize them for their services = to the community because I don't think it's ever been done, and they do a nice= job and those planters are a welcome treat for the eyes and also the wreaths ar= ound Christmas so I'd like to thank them publicly for the work that they do.

7. = Acting Town Manager's Report

&= nbsp; Mr. Nardelli: We just receive= d a State Grant, the Summer Youth Program Grant for $12,487. Ken Bates from the Northwest Regio= nal Workforce Investment Board will be coming down to the department heads tomorrow morni= ng at our meeting to discuss the grant and it will help with jobs for summer y= outh here in Watertown for this Summer, so we're looking forward to that present= ation tomorrow.

= The federal snow aid to municipalities for the February 11 and 12 snowstorm, unfortunately Litchfield County was not included in the FEMA money. I talked to Sean Williams about that an= d he explained that there was a federal formula and we did not qualify. We would have received 75% reimbur= sement for that storm, but unfortunately Litchfield County is not inclu= ded in that.

= On the budget side, tomorrow I'll be with Superintendent Erardi most of the da= y, he's got a press conference schedule in the morning, he's got a taping in t= he afternoon with the Community Access Channel, and tomorrow night he's reques= ted me to go to a PTA meeting in case there's any questions so the Superintende= nt is keeping me pretty busy with this budget process and I told him I would certainly help him give any information I could.

= Ms. Adams: I think if you want him to stop, vo= te yes, is that the impression I'm getting?

&= nbsp; Mr. Pawlak: I think I misplac= ed my invitation.

&= nbsp; Mr. Cavanaugh: It's a pleasur= e to come before you tonight and discuss the status of the Public Works Departme= nt, specifically the snow removal division and the highway division activities,= as well as engineering. I am an engineer and I will be giving out some handouts at this time.

= (Inaudi= ble) everything you wanted to know about snow removal 2005/2006 but were afraid = to ask. This year the numbers in= front of us, as you're aware, we had to come back a couple of times for sand and = salt during the year, specifically the last appropriation was for $50,000 and I'm pleased to report that we barely touched it. There's about $49,800 that we didn= 't touch this year. I told you i= f we didn't need it we weren't going to spend it, so it's still in the account f= or your use should you need. We = do have a couple of storm's worth of material up in the salt yard bin. I broke down the budget line items= for overtime sand and salt compared to previous years and then I gave you a comparison of the sand and salt, the quantities you could use for previous number. One of the questions = that comes up continuously is that we had a relatively mild= Winter, how come the material cost was so high?&nb= sp; And that number is shown a little bit further down below. When you look at the cost per ton = per sand and salt, cumulative for the last couple of years, the price for sand = has increased 65% and the price for salt has increased 41%. Put the 2 of them together it avera= ges somewhere around a 50% material cost increase over previous years, which as you see h= as had a significant adverse impact on the budget. The call outs this year, it was a relatively mild Winter, we had 16 major call outs as opposed to 35 or 43 th= at we had in previous years, but the precipitation total for 76 inches measure= d up at the Garage is about the same as the 77 from last year and the 61.25 from= the priors year.

= What we did experience this year was a different type of pre= cipitation, we didn't get a lot of snow. = Snow is easier and cheaper to deal with than the ice events that we had this yea= r, this freeze thaw cycle that we had used up a lot of material because it doe= sn't matter whether we're having a hard Winter or an easy Winter if the roads are frozen or we're experiencing a thaw, the water is running onto the road, the road is freezing at night so we have to get out in the morning and respond = to it. Similarly there was a cou= ple of very long storm events this year where we just chewed up a lot of material because of the ice and temperature conditions, we used a lot of material so that's the reason why our material cost was up so high and yet when you loo= k at the overtime costs, we didn't go over the budgeted amount this, year, we st= ayed a few thousand dollars under our overtime, so that's the type of Winter we = did have.

= Further on down below I identified the 15 snow routes we had, it cost about $792.00= per mile to keep the roads free and clear for traveling this year. Each of the la= rge trucks, that number (inaudible) with about 9.4 miles for each event.=

&= nbsp; Mr. Pawlak: You indicated the= costs were slightly under budget, which is good.= How did the budget amount compare to last year's? Did we budget more or the same?

&= nbsp; Mr. Cavanaugh: The budgeted a= mount I believe was more than last year.

= Ms. Adams: If you take a 5 year average of wh= at we spent and add 3% or 6% to that, or something, (inaudible).

&= nbsp; Mr. Cavanaugh: It's a 5 year = average and I added 3% for labor contracts.

= Mr. Pawlak: So if you did that we ended up a l= ittle bit less than that, is that what you're saying?

&= nbsp; Mr. Cavanaugh: 2005/2006 we s= pent on the overtime . . . and the actual paid for 2004/2005 was 85, so the actu= al expenditures was less than last year, and we did budget less, excuse me. We budgeted less than we spent . . . . I took the rolling 5 year average for the last 5 years and then you add the labor incr= ease (inaudible).

= We figure anywhere for a good year, 16-18 what they call call out, major event= s, so we're on the low side of that.

= The next sheet you have in front of you, the sand and salt budget (inaudible) supply the material for the Board of Ed and the Parks Department, we give y= ou a breakdown on the back to that. The Park Department is billed I believe, Mr. Nardelli can confirm that for the material that we provide them for the school use during the year. We do supply a snow plow service for . . . .

&= nbsp; Mr. Pawlak: Excuse me, Roy, c= an we just have some quiet please, while he's making his presentation, thank you.=

= Mr. Cavanaugh: We do supply snow plow services for certain developers for unaccepted roads and we do back charge them for that= and on the third page outlines how we calculate that particular cost. And then the 4th and 5th and 6th s= heets are the actual expenditures as we received the sand and salt (inaudible) wh= at the budget numbers are for the year. There is a certain amount stored up in the salt pile up at the landf= ill at this time, and as you know a certain amount goes out every day for routi= ne maintenance, spot sanding of the regular icy spots and a certain amount is given out free for citizen use. That's it for the sand/salt portion of the presentation. Any further qu= estions on sand and salt?

= Now we have the Public Works presentation.&nbs= p; The first cover sheet is a memo I sent to the Town Manager in regard= s to the storm event on April 22 and 23rd (inaudible) repercussions in Town. There were a number of areas that f= looded that were identified at that time which we're going to either have to or wa= nt to address over the next year or two depending on what happens with the projects. In addition there w= ere a significant number of washouts in roadway repair jobs which were necessitat= ed as a result of this particular storm flow event. We finished repairing them last we= ek and then we had this week's storm which washed a lot away again and we anticipa= te more washouts in the coming week. We are getting hammered pretty heavily with rain= , it's balancing that going on. We didn’t identify any hazardous road conditions as a result of the washouts, but there are a lot of spot repairs which were necessitated and it has set our regular maintenance work back somewhat. The memo discusses, and I'm not go= ing to repeat everything in there, but it does discuss a number of events that happened that day and some of the outfall from it.

= The next sheet you have in front of you is an update on the 2003 Public Works b= ond.

= Ms. Adams: I think it's important to mention t= hat we had some areas in Town that definitely did flood and one was behind the Bro= ok's Plaza, that whole area, and with the Public Works crew making sure that the basins and culverts are cleaned out, that this time it's successful that th= ey did not flood; any other storm then would have and there are a few other ar= eas in Town the same thing has happened, with the due diligence of getting the = workers in there and making sure that everything is clear, that we are finally maki= ng headway in our flooding. A fe= w new areas popped up this time but it was a bad storm.

&= nbsp; Mr. Pawlak: Is that the reaso= n the busses are parked over here, in anticipation of the rain in the next day or two?

&= nbsp; Ms. Adams: Does anybody know anything about that?

&= nbsp; Mr. Cavanaugh: As a precautio= n, they are predicting a significant amount of rain in the next couple of days= so as a precaution, Knight Street had to be evacuated on April 22 and 23, so t= he bus company and the Board of Ed is very diligent on making sure that we're = not going to get stranded. So I d= id gloss over that. The improvem= ents that we did on Turkey Brook over the last couple of years, it responded mag= nificently to this last rainfall event, and some of the other culverts, we identified = and the guys make the rounds during the storm, a lot of the flooding that we did experience on the 22nd and the 23rd was caused in large part by tires washi= ng down and blocking a culvert, the one by Colonial, a tree was uprooted upstr= eam, came down and blocked the culvert, as soon as we got those out of the way it was like popping a cork in the bathtub, Colonial drained right out in an ho= ur, Sylvan Lake took somewhat longer but those culverts are radically undersized for the work that we've got and they are scheduled to hopefully be replaced= as part of the Civil 8 project if that proceeds, otherwise (inaudible) but tha= t is on the radar screen. One othe= r area of concern was the Sand Ba= nk Road area, it overtopped the road in two places and there were a few houses that were isolated as a result of that; that is an area of concern, possibly one= of the biggest ones that we have out there right now.

= There are a significant number of small drainage problems, homeowner issues that = we are addressing, both the Highway Department and = the Engineering Department, Public Works as a whole as a result of that. April 22nd and 23rd, I know the Fi= re Department they handled an awesome number of calls and put out a lot of sand bags.

= The next sheet you have in front of you I identified the status of the 2003 Pub= lic Works Bond Projects. As you k= now in 2003 they approved the bonding with a significant number of projects that w= ere approved at that time, some have been completed, a couple of them have been cancelled or taken over by events and a few of them are in the process of b= eing bid out and will be bid this year and a couple of more will be occurring ov= er the next couple of years.

= The next sheet in front of you is the 2006 Master Schedule. You were looking for what is the Hi= ghway Department doing, what do we anticipate doing. We sit down twice during the construction season, at the beginning a= nd at mid point, and we block out our routine programs, our regularly scheduled maintenance and what are projects are going to be and they we assign the bo= dies and try to figure out as best we can, as best we can project, without foreseeing events like the rainfall, of what we are going to be doing and h= ow we're going to get it done. S= ome things are routine, mowing for instance, we know starting in May we're going to put out 2 mowers on a regular basis. It may not be 5 days a week, but it will be at least 2 or 3 days a week knocki= ng down the intersections. We kn= ow we've got catch basin work, street sweeping. Once street sweeping starts, we'll= be going through mid July. Right= now we're about 1/3 of the way through the Town and we're working on the 4th of= the 9 sections right now so we will finish sometime around July.

= Mr. Pawlak: Thank you, Main Street looks good.

= Mr. Cavanaugh: A couple of the quick safety improv= ement projects, identified down on the Master Schedule, 19 Neill Drive and the Gr= een, those are site line improvements as a result of residential or citizen conc= erns expressed over the last couple of year, the Highway Department was able to = get out there and do some site line improvements by excavation of the roadway, = and the Chamber of Commerce sign is also up.

= As far as some of the, when I say clean up section and the other routine work,= one of the big items that we spend a lot of time doing in the Spring is as most= of you know, last year we had a banner year for taking out mailboxes, this yea= r we had a great year for taking out bituminous curb. Well now we have to go back and fi= x all the curbs and lawns and that is a significant effort that will be on-going = for awhile. I'm sure some citizen= s here experienced those firsthand.

= We also have here an engineering division report. I gave you a capsule summary as far= as where we're at as far as our major projects and similarly I gave you one on= the Highway Division of the Public Works Department. Again it's a snapshot of the major projects, where we're at in time and what we're doing.

= Finally the last sheet, I put together in capsule form a budget summary of where we were from the year 2002 right up through the present to give you an idea of where the budget has gone for the last few years and how the guys up at the Highway have been able to take our dollars and stretch them and still get everything done in a cost effective manner.

= I know I kind of glossed over a lot areas and I'm sure there must be some questions.

= Mr. Pawlak: Have we heard anything, Frank, with respect to the Timken Grant?

= Mr. Nardelli: Yes, that was in regards to th= e Fire Department? I spoke to Larry = today and we did not receive that grant.

= Mr. Pawlak: So we're going to complete that, I= think the intent now is to try and do that with our own personnel? Or have we not approached that yet= ?

Mr. Pawlak: This is just an open discussion for ideas; we've had some presented here before, some in the past, and I just w= ant to get as much input from everybody as we possibly can. I was not even aware that we had additional land available right there that we could develop, and that as a matter of fact plans had progressed along with respect to that property.

Ms. Adams: I remember those, Joe. They're kind of rough sketches on w= hat could possibly be done there. I don't believe there are any costs attached to that. It as just a rough idea, we could = put a field here and a field there.

Ms. Legge: Originally.

Ms. Adams: Back in 2002.

Ms. Legge: Yes, but also another phase th= ere was no cost, they just did it by committee, that's all.

Mr. Pawlak: But there is plenty of land availab= le there apparently?

Ms. Adams: It's all the woods down there.=

Ms. Legge: It looks like brush so it would ha= ve to be cleared and graded and put drainage in, turf on top, a fence around and there we go.

Mr. Pawlak: With a change in the designation or= use of the farm, allowing us now to do a renovation or construction if you will= , as opposed to just purchase, that gives us a nice possibility to use that money right there.

Mr. Rinaldi: Roy, you gave us a proposal at one point, utilizing this land along the hill her= e, are we talking about the same thing here?

Mr. Cavanaugh: It was a different proposal, but (inaudible) worked through Charlie Beliveau, we took a look and we incorpor= ated some of his ideas and we took a look at the feasibility, particularly given= the new changes we have down on the road down there, we came up with some ideas, and it certainly looked like we had enough room to do some serious field wo= rk down there.

Mr. Rinaldi: And this was also Town property al= so that you were talking about, correct?

Mr. Cavanaugh: Yes, it was all on Town property ov= er there and we did identify the fact that the Unico fields are contiguous with that, we identified the limited of where it is and where the former railroad right of way going through there too, so the field use basically identified they'd build from the Unico field up to essentially there's almost like a little natural amphitheater right here that we thought could be developed i= nto kind of a spectacular field and we own the property and it certainly seemed like there was enough area and it certainly seemed like the site development costs for at least the first fields weren't going to be significant. The second potential field down th= ere, there was some other wetlands issues which could be identified and there we= re some grading issues, but it certainly didn't seem insurmountable or exorbit= antly expensive.

Mr. Pawlak: So it's basically the same area, s= ame fields, slightly different, but same land.

Mr. Cavanaugh: Same land, same basic number of fi= elds, the orientation would be slightly different, we're applying lessons learned, mostly Veteran's Park and from the field up here, yes.

Mr. Rinaldi: I would also agree that I think by= using land that the Town already owns, that money could be put into developing the fields rather than purchasing land, I think it gives us a jump start to hit= the ground running.

Ms. Adams: We've heard over the past year sev= eral different proposals, it started with the Rickivicius that failed, but what = has come on has been there's talk about the drive-in site, there's talk about j= ust a piece of Rickivicius, there's talk about the Fire District land down the = hill here, and there's also talk about redoing the fields now or potential field= s on Town property, I almost think that with a time limit attached to it, that we ask for Park & Rec's input, maybe by our mid June Council meeting. They've sent us correspondence ove= r the past year at least in things they would like to see, so I would like their input. I don't want to drag (= Tape #1, Side B ended - may have missed some).&= nbsp; Second meeting in June?

Mr. Pawlak: Works for me. Ron Russo tried to be here, appare= ntly he was trying to come in from = Chicago but his flight was delayed, but that sounds doable. The 19th of June sounds doable.

Ms. Adams: There are public hearings that hav= e been held over the past couple of years regarding the needs for fields and I thi= nk the Commission has the best idea on just what we need in Town also, but I w= ould like their input.

Mr. Pawlak: Works for me. We do have some input, as you know= , from Park and Rec with respect to 3 very general suggestions, but we can ask for more specifics.

Mr. Rinaldi: I know Representative Williams is h= ere tonight and I had spoken to him already and I think that if you want to elaborate, Sean, I think there is a bit of a sense of urgency here to get t= his thing resolved. Am I correct?=

Representative Williams: I think there is a little bit of a = sense of urgency. We don't have a definitive end date where this decision needs to be made or where this proj= ect needs to be completed. But th= ere is a little bit of a sense of urgency in the sense that we have this grant mon= ey for 2 years this coming August now and we haven't quite done anything with = it yet, and other towns and other legislators will start saying are you guys g= oing to do this, or are you going to do nothing, so I think there is some urgenc= y, although there is not definitive deadline, so I wouldn't want to put it off= too much longer I guess is what I'm saying.

= ; &n= bsp; Discussion: = ; Mr. Pawlak: Regarding the plo= w and the accessories, I notice it's for a 2004 truck, what happened there?

= ; &n= bsp; = ; &n= bsp; Mr. Cavanaugh: 2004 truck, we ordered 2 trucks at = that time, and as you know, we appropriated the money it takes awhile, we ordered the trucks off a State bid.&nbs= p; One of the trucks was a pure State bid truck, the second truck, we identified a need and they put out what they call a wing plow, it's a side = plow that goes out on the side and we also ordered a barn door on the back of the truck, as opposed to a lift flap, it opens out to the side. These weren't standard items on the State bid. Somehow between th= e time the truck got ordered and the lease purchase agreement within this lease ca= me up, when the lease agreement came up and the dollar value was assigned to i= t, these accessories were not included in the lease and there was a lot of fin= ger pointing about why that went on, but the fact of the matter is it did not g= et included in the lease, and by the time it was picked up, the lease could no= t be renegotiated, so we had a couple of options, either we could roll it into another lease that we were getting for other equipment like an office copie= r, or we could just pay it, cause we did have the funds available, and not inc= ur the leasing costs over 5 years. It takes a long time to get one of these trucks, that's why it would say 2004 truck, that's the budget year when it started, so they were ordered towards the end of 2005, and 2006 they were a= ll in.

= ; Mr. Lafferty: There has been = some discussion as far as the use of the grant money and some suggestions have b= een made to the possibility of improvements to the Mills Complex or other areas around the school. There has = not been any formal discussion from the Board of Education, but in the month of June when the Athletics Subcommittee meets, there will probably be some discussion on that, so that's where the Board of Ed stands as far as this issue, there's no formal opinion from the Board. I'd just like to point that out wh= en you consider using the fund money on the schools. Thank you.

= ; Mr. Masi: I just wanted to of= fer my thoughts regarding the fields. I think that the idea of utilizing the property down here, which is Town prop= erty for fields, based on the fact that studies have been do= ne is a good idea, but I think you have to know some other things. In the Comprehensive Plan of 1993 w= e discussed the Town eventually purchasing the land between that property and the Mills Complex and French Street<= /st1:address>. There's an open field in there and= a couple of houses. Eventually = if the Town owned all the land between this complex and French Street there would = even be more fields that could be built and more area that could be used towards recreation and I suggest that you look at that, separate and distinct from = this other situation because you have to use the $600,000 obviously, but don't l= et that other piece go, cause once it's offered for a subdivision it's gone forever and you lose the fact that you get the openness and availability of land right to French Street.

The second thing is everybody mentions Unico Fields. I hope the Council realizes that t= hose fields are made up of 4 separate leases, each with a cancellation date on them of = 30 days, by either party. When I= was president of Unico we were going to raise funds on a community drive to put= a fence around the field. We ma= de application to the Town Council at that time to see if those leases could be either extended or that land could be purchased outright, and it was dropped, it w= as never brought forward so Unico said we're not going to invest $15,000 or $20,000 into a project where the owner of that property, each of the indivi= dual 4 pieces, can cancel within 30 days, so I think you need to know that that = is a problem down there, they're using them but they're cancellable within 30 da= ys by either party.

The third thing that I want to address is that when I was on Planning and Zonin= g, we had 3 attempts to bring recreation into residential areas. One was on Old Colony Drive, one w= as on Hinman Road, and one was on Honey Hill, and in each of these 3 cases, this = was open space that the Planning and Zoning Commission had gotten for those sub= divisions, in each of those 3 cases the residents came down and hammered the hell out = of us in terms of the fact that they didn't want any part of noise, car parkin= g, you name it. So the thing is = that the open space that is gotten for subdivisions is basically passive open sp= ace in fee simple when it's gotten for fee simple for the general use of the wh= ole community, not for that subdivision. And it is land that acts as a buffer area, and only buffer area. It's not a pie in the sky panacea = where you can go out and take 20 acres of somebody's most valuable land and throw= a field. That's called stealing, okay, if you don't pay for it. The thing is you can't ask 5% of the remaining landowners left to pay for the f= act that 95% of the people who live in this Town never contributed to buying the land to put fields on. That i= s a general benefit for everybody. The whole Town should invest in the fields because everybody is going to use them, and it seems to me the most appropr= iate place fields are where you have a central area, i.e., the corridor up and d= own the Steele Brook area, continuation of the Unico Field up to French Street,= and as Dennis suggested maybe down towards the Fire District. That's an area that can be taken c= are of, it can be lighted, it can have double access= from off of Knight Street or over the bridge. It's been= my experience that you're going to meet resistance when you start talking about putting fields in residential areas. It's not going to fly. You're going to suffer the Rickivicius problem every time it happens, and it's counterproductive. J= ust some thoughts I wanted to pass on based on the experience that I've had. I'm all for fields, but I think it= has to be well thought out so that everybody accepted the premise and is willin= g to pay for them. Thank you.
