Mr. Tedesco: I appear here this evening to = state my case clearly as to why I seek appointment to the Planning and Zoning Commission. The main reason w= hy I ask for your support is to help Planning and Zoning in its decision making = process on land use issues. I come wi= th 30 years of experience in land development and the Tedesco name in home buildi= ng is impeccable. After last mon= th's Council's meeting I did have a bitter taste about the appointment process, = and even considered legal counsel in view of the fact that other developers ser= ved on land use boards, but after much soul searching I've concluded that my appointment to P & Z should be based on the merits of my experience in = the land use field and nothing else. In conclusion, as much as I desire an appointment to the Planning and Zoning C= ommission, I want the Council Members to rest assured that whatever the outcome of tonight's vote I will remain available to help the people of Watertown and Oakville in any capacity related to my many years of land use expertise. Thank you.

= ; Mr. Polletta: I'm here tonight because I heard some ugly rumors about my name either on the streets or in = the newspaper because I served on different boards and commissions. My Town Committee asked me to serv= e on different boards and commissions for over 25 years.&= nbsp; I served on P & Z for about 12 years, Zoning Board of Appeals pl= us or minus 3 years, Wetlands about 2 years.&nbs= p; Again, I was asked based on my experience in residential, commercial, and industrial.

By serving on Planning and Zoning I had a couple of issues. One was somebody said I developed a piece of property on Lisbo= n Street in Oakville. My family had that property for ov= er 28 years. It was a piece of prop= erty which was under the old Oakville/Watertown Fire District and my family paid taxes for many years. The only thing that was done there was a paper street which was built according to T= own Regulations. Again I was serving on Planning and Zoning and I did abstain on anything that I ever did.

The second one was a piece of property that I own on 36 Zoar Avenue. I bought the property at approxima= tely 1/2 acre of land. When I serv= ed on Planning and Zoning, I was asked to make that piece of property more conforming, so I bought another 1/2 acre of property from Sealy Mattress. After I bought the property Planni= ng and Zoning decided to change some of the property to residential, so here it is= Joe Polletta, having almost a 10,000 square feet building on a 1/2 acre of land, and when I bought it I bought it with the intention of expanding. I could not do that no more because it was changed, so you cannot expand a non-conforming piece of property.

And now I have a piece of property on Echo Lake Road that my family had for many years, a= nd I owned the rest of it for about 28 years.&n= bsp; It's 492 Echo Lake Road, it used to be a farm before, it's about 28 acres, and again, I owned this property for many years, so I believe just because some one works in the building trades or has a piece of property and develops a piece of property I don't think that he/she should not be allowe= d to serve on different boards and commissions.= I served again for over 25 years, and I had no problem, so I believe again, that if a person is in conflict he/she should abstain from any discu= ssion and make sure that he does the job according to the Town of Watertown's rules and regulations. So again I saw my name in the pape= r and I wanted to make sure this was clear and on the record. Thank you very much.

= ; Ms. Peluso: I wanted the Coun= cil to know I was recently appointed as Northwest Regional Mental Health person. We serve during the day, (inaudibl= e) and I serve during the day. May i= s Mental Health Month and mental illness is not the face of a stranger, it's about o= ur family, friends, neighbors, coworkers, and sometimes ou= rselves. I personally think (inaudible) for awhile and looking into 2005 brochures an (inaudible) the brochure says that (inaudible) of services that someone has the right to (inaudible). We belong to (inaudible) which is = the area we're controlled under the Mental Health Board and they handle from depression all kinds of things, dementia.&= nbsp; Along with this goes alcoholism, drug addition, whatever. I just would like you people to kn= ow that there is a board and there is somebody that you can contact because th= ere are circles out there. I talk= ed to somebody in Town who works with social workers and I asked her if this Boar= d could have served (inaudible) last year and she said (inaudible). I didn’t know about that. So it's a very good board. (Inaudible) but it gets you throug= h the process and it's there. It's = Russell Place in Waterbury. Watertown is part of it and I'm the appointed member. Thank you.

Mr. LeBlanc: I also heard my name mentioned and = I am a real estate developer and investor and I've served on several, well actually two boards. I served 2 terms = on the Wetlands Commission and I've served since 1989 on the Zoning Board of Appeals. About 8 or 9 years a= go I went to my Town Committee and I said you know, serving on these boards and commissions, I think that people should take a test, to tell you truth, and= I think if we get someone in the trade or is a developer or knows something a= bout construction, they should be on the land use boards, and I'll give you a co= uple of examples.

hen I first started out on the Zoning Board of Appeals I was only an Alternate = and at that time, it was in the 80's, there was a very prominent doctor in Town building a very beautiful house, probably close to $700,000 or $800,000., a= nd at that time I got my packet, I don’t want to bore you, but this is h= ow my expertise, they said that this house was 2 feet too far. Now this guy went through and got = his zoning compliance, went and got his permit, the rafters were up, there's a 12 pitc= h on the house, the house is shingles. Now I was only an Alternate, but I= 'm looking at this thing and I said to the board members, do your realize what it's going to take to take this man's house apart? It's almost $1,000,000. You got 2 x 12 rafters, you got to= take the plywood, the shingles, throw everything away. Well needless to say the guy, they didn't do anything to his house. And at that time I even said to them, I'm not making a professional opinion, but I can give you my expertise on this.

Also when I was on the Wetlands Commission there were 2 members serving with me = that didn't even know how to read a plan. There was a subdivision going on over on Middlebury Road, they were putting in 5 houses, this woman came before us from Middlebury and said that the water was going to run on her property. Well the submission started at 180= , she sat at 210. You tell me how t= he water is going to run on her property.&nbs= p; I mean it's things like that, that if you= 're not qualified to serve on these boards and commission, then you shouldn't b= e on them.

I was asked to be on the Police Commission, probably 10 or 15 years ago. What do I know about being on the = Police Commissions? I've been in con= struction and trucking all my life, and I want to volunteer my time where I can help = the Town, and through the whole time that I've been on these commissions, I've always excused myself from anything that I knew the people, or I was develo= ping it myself. I walk right out o= f the room, I had nothing to do with it. So I'm just saying when you review = these people's applications, you should look and see what their background is. If they're an electrician, a plumb= er, a carpenter, or an excavator, they can help a lot, especially on the Wetlands, Planning and Zoning, and the Zoning Board of Appeals. Thank you very much.

Mr. Durso: As anybody here who knows me knows = I love debate, even Paul Valenti, who disagrees with everything that I say, well t= oday is Tuesday, right, no, but I love debate, and I don't think anybody with knowledge of any field should be barred from serving on a commission. Mr. Tedesco, I'm sure he would know enough if there was any kind of conflict of interest. Once again the more knowledge we h= ave, the more institutional knowledge on those Commissions, I think the better f= or the people of Watertown. We have competing arguments when deciding a land use issue, and I don't think that one person or one faction= should have the ball as far as deciding what's best in land use decisions. So based on th= at I would urge my fellow Republican councilmen to support Mr. Tedesco. I think he'll be great, he will ad= d to the institutional knowledge of the Commission. Thank you. = ; Mr. Polletta: There are some letters going around about serving on boards and commissions cause they bel= ieve it's a conflict of interest, and I got two of the letters today and that was the reason why, so I don't know where it started, if you said it or whoever said it, but the idea is what I was trying to say is I, anytime there was anything to do, I did not participate, I just stepped aside and made some of the examples that I give when I was on P & Z about my building that even though we changed the zoning in certain areas, I did not participate. So it cost me just to be on the bo= ard, but I'm supposed to set the example, and I didn't say nothi= ng.

&= nbsp; &nbs= p; Mr. Kane: I had a meeting with Tess Beauchamp= and she is prepared to put together a citizen's group for the preservation of t= he existing town hall, and before she begins this endeavor she wanted the Town Council to be aware of it. If anyone is interested in this particular issue please feel free to contact h= er, but she is looking to get people together to preserve the existing town hal= l so I just wanted to bring that to the Council's attention and she hopes the To= wn has the support.

&= nbsp; &nbs= p; Mr. Valenti: Would that be with the thought of in addition to town resources or in lieu of town resources?

&= nbsp; &nbs= p; Mr. Kane: No, in lieu of, thi= s is their own (inaudible) effort. But before there is a movement, le= t's say, she wanted the Town Council to be aware of = it, just proper protocol. One thi= ng actually she did mention as well, and if you remember Dave Hardt at the Fire Department suggested to us at one time, and we of course did it, to honor o= ur veterans of the town, so we renamed Town Hall Hill to Veteran's Hill and she did question whether it can be also known as and keep that designation so I don't know if that's something we do want to take up tonight, but it's something maybe that the Council members can think about and potentially co= me back with if they have any opinion on it one way or the other, but she did = want to make that known as well.

= ; &n= bsp; Discussion: Mr. Killeen: This appointment has drawn quite a= bit of interest for a number of reasons. One of the things that I would like to make a matter of record is th= at the Republican portion of the Council has conducted itself in a manner whic= h is consistent with good order of business for the Town of Watertown and there's been issue taken through the media, that this was an effort to block appointments summarily from the Democrats; this simply isn't the case.

= ; &n= bsp; = ; &n= bsp; Elaine has mentioned the preference that has been expressed recently, I understand= it was a revision to the P & Z By-Laws last Summer formerly expressing wha= t I consider to be the obvious, which is when a vacancy opens up as a regular member, that ideally should be filled with an alternate who has been there = for awhile and has a little knowledge about what is going on. It seems to me that that is statin= g the obvious, but apparently it was read into the revision to the By-Laws because things had gotten complicated and more work to do, more complex, and theref= ore it seemed appropriate at that time, I've been told, to formalize it, so it's just a point that I think needs to be considered. I think that's the end of my comme= nts for now.

= ; &n= bsp; = ; &n= bsp; Mr. Kane: I just want to make a brief statem= ent myself. I do have questions regarding any developer, and Mr. Tedesco this has nothing to do with yourse= lf, or the gentlemen in the room, I'm sure they're all fine gentlemen, I just do have a question regarding developers on land use boards because they will appear before a board that they're actually on, and they will have to be walking a tight rope really, and a careful fine line in their voting so it = is a situation where potential does exist. Having said that, I will say what I said 2 weeks ago, which is I will not hold up this recommendation. I do want to abide by the Democrat's position and their appointment and by th= e Gentleman's Agreement that is so often mentioned, so I will not stop or vote against th= is recommendation, although there are some concerns that I do have personally regarding any developer, not a single person.

= ; &n= bsp; = ; &n= bsp; The one thing I do want to clarify, however, in regards to this Democrat versus= Republican, I think now is a better time as any, is in a letter to the Town Times, the = Chairman of the Democratic Party had written that it is by law a Democratic seat, and that is not true, it is a minority representation, so basically it's not fa= ir for the Democratic Party to assume it is their seat. It can be anyone, there are many p= arties, independent parties as well as others, that have the right to be represente= d as a minority position on any board or commission so if I might correct the Chairman of the Democratic Party I think that needs to be said, but again, I will vote in favor, or basically not hold up this nomination because of the Gentleman's Agreement that has been mentioned previously.

= ; &n= bsp; = ; &n= bsp; Mr. Wick: The question of the Gentleman's Agr= eement is one that influenced my decision awhile ago in a different way than it applies today. I had a concer= n in my mind about what was some of the underlying theories, if you will behind = that agreement, and I found somebody who was there, present at the creation 25, = 30 years ago when that agreement was hammered out, and I questioned him on the assumption I had made about what would you guys have agreed to if you had a= sked yourself this very specific question, and the answer I got was the one that= I had, up to that point, only assumed was the case, which is well no, we woul= dn't have expected something like this. At the time I was reminded they were concerned about members of both parties just arbitrarily refusing to accept= a nomination from the other party and putting up somebody else from that other party but different from the one that was originally proposed, and that kin= d of nonsense ceased after that Gentleman's Agreement was reached, but the Gentleman's Agreement was not intended to apply this broadly, and as I say, that was an assumption I had made, I tried to verify it and I got it verifi= ed so I would argue that that agreement does not apply in a case like this.

= ; &n= bsp; = ; &n= bsp; Mr. Killeen: Mr. Chairman, I would like to also comment on the Gentleman's Agreement. The "Gentleman's Agreement" apparently was developed for whatever reason a long time before I became a member of this Council and I always felt that a vote on this Council as an individual member of the Coun= cil belonged to me, and for the purposes of my own conscience I make and take my votes based on feedback and input that I receive from people in our Town. One of my chief concerns was not M= r. Tedesco at all. It simply would be th= is - any active developer sitting on that land use board stands to have to recuse himself not only on his own issues, but potentially on the issues of his own competitors in the market. So= again I wanted to make that idea very specific, but again in terms of the Gentlem= an's Agreement, I'm not so certain that that has precedence here.

= ; &n= bsp; = ; &n= bsp; Mr. Kane: Well let's not get into a debate r= ight now, but never did anyone attack anyone's integrity. Let's make that clear, you (inaudi= ble) say that. No one has ever att= acked anyone's integrity, so let's make that clear. There may be questions regarding potential of any developer, but no one has attacked anyone's integrity, whe= ther Democrat, Republican, or likewise.

A third hasn't really been discuss= ed and that was my appointment to the Council.&nb= sp; At the time that the Republican Party had nominated me, the Democrats had nominated Vinnie Palladino and in my opinion that was a posture positio= n, but I think it stated something in terms of appointments and votes and that sort of thing. Thank you.

I've = been in this Town most of my life, I know most of the people, but you got nomina= ted and I didn't know who you were up until you came here (inaudible).

Stewart, Town Clerk of the Town of Watertown, a municipality organized under the laws of the State of Connecticut, do hereby certify that the following is a true and correct copy of a resolution adopted at a meeti= ng of the Watertown Town Council, duly held and convened on May 16, 21005 at w= hich meeting a duly constituted quorum of the Town Council was present and acting throughout and that such resolution has not been modified, rescinded, or revoked and is at present in full force and effect.

= ; &n= bsp; WHEREAS, the Watertown Planning and Zoning Commission at a continued Regular Meeting held on April 13, 2005 voted to recommend to the Town Council the acceptanc= e of the following streets into the Town of Watertown's road system as described:

= ; &n= bsp; Saco Street - from it's intersection with Ice House Road easterly a distance of approximately 200 f= eet (0.038 miles) to its intersection with Lisbon Street, being a 50 foot right= of way and being further shown on a map entitled "Plan and Profile Augusta Street, Watertown, CT" prepared by Terry Meyers Associates, P.C. marked "As-Built" and dated last revised 09/14/04.

= ; &n= bsp; Lisbon Street - from its intersection with Saco Street southerly a distance of approximately 957 feet (0.181 miles) to its end, being a 50 foot right of way and being further sh= own on a map entitled "Plan and Profile, Lisbon Street, Watertown, CT" prepared by Meyers Associates, P.C. and dated last revised 11/05/04.
