1. = Letter from Superintendent of Schools, Re: Town Council Representation during Negotiations with Administrators, dated May 22, 2007.
= Mr. Pawlak: I have a letter from the Superinten= dent of Schools. Rather than read = the entire letter, I know there is not a copy in the packet, it regards the ope= ning of the negotiations with the Watertown Administrator's Association, there i= s a timetable which is established.

= P= arties must commence negotiations 8/4/07, parties must name a mediator if contract= has not been settled by 9/23/07 parties must name an arbitrator if contract has= not been settled by 10/18/07. Sin= ce we are the fiscal authority in Town, Dr. Erardi has asked that we would like to have a representative to those negotiations. I believe Mr. Walton would like to= . Does someone from the minority sid= e like to participate also?
= Mr. Primini: I would.
= Mr. Pawlak: Ray? Okay. I didn't see a beginning date, but= it says must commence by 8/4. Is= that the plan?
= Dr. Erardi: Between July 4th and August 4th we'= re required by Statute to meet with your Finance Subcommittee, and that will establish our opening date.
= ; Mr. Pawlak: So you want to me= et with the full Finance Subcommittee?
= Dr. Erardi: We have to do that by statute.
= Mr. Pawlak: I also received another corresponde= nce. As you may or may not know the Town awarded an $1,100 scholarship to Evan Harkinson last Thursday. Unfortunately Evan was at a track = meet. What time did they finally get bac= k?
= ; Dr. Erardi: I saw him at his = part time job; he missed it by about half an hour.
= Mr. Pawlak: So we were not able to present it t= o him personally, but we did give him a letter and I guess he'll have to come dow= n to the Town Hall Annex and establish his bonifies with respect to the college = he's attending and he'll receive his $1,100.
&= nbsp; &nbs= p; I also received another letter, it is from Project Pride. They are in the process of rehabbin= g the Watertown High School Gymnasium. They're going to paint the wall and I'm not sure what else is involved there, I know paint the walls was probably the primary thing and they're probably doing s= ome other things there. The proje= ct costs is estimated at $10,000 and they have a group of volunteers. I guess they're looking for materi= als which would be covered by the contributions and they have sent this to me w= ith the hope that the Town Council can find a way to find some money which we c= an donate to that project. I thi= nk we'll probably have that on the next Agenda to propose a donation to Project Prid= e to help them.

last item is an old item, a letter addressed to Whom It May Concern. It was from Neil's Auto Body and
Watertown Auto Body regarding the towing vehicles in Watertown and the fact
that some of them towed by one facility ended up in a Waterbury storage
facility and he took exception to that because according to our By-Laws, or
whatever you want to call them, they must be available on a 24 hour, 7 day a
week basis, and I believe they're supposed to be in Watertown, and apparent=
ly that
has presented a problem for some of our towing people. So if you would, Chuck, take a loo=
k at
that and see if we can get that straightened out if they should abide by all
the other requirements that the other towing services in
&= nbsp; &= nbsp; I do want to thank all of the Town Council members who strutted their stuff on Memorial Day, especially those who handed out candy and got extra exercise,= and that does not include you, Jack, you rode, but I want to thank you all for showing up and attending the Memorial Day Parade.
&= nbsp; &nbs= p; I just want to remind everybody that we have a referendum tomorrow on several questions. We have a budget, = which will be as usual a 2 question budget, on the Town's side and the Board of Education budget, and in addition to that we have the 3 question budget on = the school renovate as new and I would hope that everybody would take part and exercise their right to vote, and quite frankly I hope that everyone will v= ote yes 5 times.

Lisa Car= ew, our Recreation Director, has once again succeeded in obtaining a $40,000 grant = for a wheelchair accessible bus. = The bus will be bid sometime toward the end of the 2007/2008 fiscal year with t= he responsibility of the Town's portion of this purchase would be payable in t= he next fiscal year.

Last yea= r we had many complaints that the condition of our sidewalks, the stone wall in the center of town, etc., and Roy has designed a new program that will allow the Town to spray something very similar to Roundup, it's a general, licensed application material and he is going around with the donation of a tank by Grasshopper Lawns, it's on loan to us, going around spraying all of our sidewalks and curbing and hopefully kill all of the weeds and growth that p= resently grow, hopefully it will make the Town look better.

We did m= eet with Peter Oliver and we've asked him to go back and provide us with 3 alternatives. The original dr= aft submitted to us last week was for 1 design and that was to replace all of o= ur UHF, VHF and low band systems and we've asked he then take that design and = work it so we have other alternatives, keeping the Fire Department with their low band and VHF, keeping the Highway with their low band and installing some n= ew repeaters and so forth so he's going to come back and do that, that should = be completed very shortly.

Mr. Frigon: Yes, very much so. The estimated cost that was given = to us last week was in excess of $2,000,000 so that's why we've asked him to come back and rework the project a little bit.
Mr. Pawlak: What were we expecting? $400,000?
Mr. Frigon: Yea, we were looking at somewhere b= etween $300,000 and $500,000.
Mr. Kane: On the Disposal of Town Owned Prope= rty, you mentioned questionable value to the Town, do you have, can you give us a listing of what you're talking about?

and Zoning to provide me with a record of all town owned property that is n=

Mr. Kane: My second question is about the Town Hall, are there still air quality studies going on in the Town Hall?
Mr. Frigon: No, we met with OSHA last Friday fo= r our exit interview of our last round of tests or last complaint to OSHA. The equipment that was authorized = on May 21st has all been installed. = It's a negative air pressure, air scrubbing machine and there should not be, we ha= ve no citations as a result of that. We may have one for the back door lock not working appropriately, but as far as the air quality goes, no. (Inaudible) should be complete.
Mr. Pawlak: One thing I would like to do is som= etime in either July or August we should schedule another test just to see how th= at equipment is functioning.
Mr. Frigon: We've done that.
Mr. Pawlak: Did you talk about the last time, t= he system storage infrastructure?

think that we as a Town would not want to see certain things like the

&= nbsp; &nbs= p; Mr. Pawlak: As you know this has been under discussion on and off since January and to date the only thing that we have right now is what you're looking at in front of you, which quite frankly was done unilaterally because I was waiting and waiting and waiting. So I again request that you take a= look at this spreadsheet which shows all of our department heads with their curr= ent base, the base with deferred compensation, a suggested new based, and the l= ast column is an average of salaries in towns who have basically the same funct= ions for department heads, and then we can act on this. I don't want to drag this out any further. I want to get someth= ing to Chuck cause he has to work on salary reviews and also (inaudible).

I have a problem with cutting people's pays, cause I feel the deferr= ed comp has always been part of their salary and I think it's very, very unfai= r to do that to these employees who have been dedicated for all these years. Now my understanding and the way it should be we voted on I think a couple of years ago, any new employee comin= g in for a department head position would not be eligible for the deferred comp.=

I mean you're look= ing at dedicated employees who have proven themselves again and again and again, j= ust how dedicated they are to the Town. They've survived some of them several town managers, kept their departments going, and they provided the consistency we've had in this Town. I don't know how many actually right now, I mean the turnover, Richie is gone, Mary Barton is gon= e, you know where things have turned over, so I would definitely be opposed to anything like that.

&= nbsp; &nbs= p; Mr. Pawlak: Well I know that you're opposed to = it, but at the same time I've received absolutely no input from anybody regardi= ng their suggestions in dollars and cents, so I'll ask once again that you tak= e a look at this and we can discuss it on June 18th, we'll get a copy to Frank = and we can review it. I do not, a= s I said before, I do not share your opinion, or your feeling, that deferred compensation is part of the salary. I believe that deferred compensation as it is structured here is a fringe benefit, if you will, which is in fact a pension fund for the employ= ees, very similar to a 401K part of a, in the private sector, and that the prima= ry difference between this particular method of funding or this particular compensation and that in the private sector that I've been used to is the f= act that in the private sector it's basically either fully contributory on the = part of the employee or there is a kick in contribution on the part of the emplo= yer, and those contributions can range anywhere from $.50 on a $1.00 or $1.00 for $1.00 up to a certain amount. In this particular case there is zero contribution on the part of the employee, it's all on the Town, and in almost every case that we're talking about her= e, the employees have also another pension fund I believe, it's the MERF Fund,= as a matter of fact I think we just brought up one, wasn't it Harry Ward we ju= st put into the MERF Fund as opposed to, because that was the only thing he ha= d, so these employees have both the MERF Fund, they have deferred compensation= and they also get Social Security? Do you also get Social Security?
&= nbsp; &nbs= p; Mr. Nardelli: Yes.
&= nbsp; &nbs= p; Mr. Pawlak: So in effect there are basically 3 pension funds for these employees.
&= nbsp; &nbs= p; Mr. Nardelli: The MERF Pension Fund offsets what = your Social Security Benefits (inaudible).
&= nbsp; &nbs= p; Mr. Pawlak: Okay, so there's an offset there.
&= nbsp; &nbs= p; Ms. Adams: (Inaudible) again Joe, this deferred compensation did not happen overnight, it came over the course of, I don't = know how many years, I'm sure Frank could research that.
&= nbsp; &nbs= p; Mr. Frigon: Almost 17 years ago.
&= nbsp; &nbs= p; Ms. Adams: 17 years as part of the compensatio= n of the department heads. Now if = you want to take that compensation out of there and put it into their salary, I don't think there's any real issue with that, but again I just don't feel t= hat cutting their pay, which I believe you would be cutting their compensation,= is fair.

I'm very con= fused, the second line says total salary increases will not exceed 3.25% but then = if you have good performance, excellent performance . . . .

In other words what I'm suggesting= is, and this has very little to do with the salaries of the individuals with respect to how much of a raise they're going to get, but what I'm suggestin= g is that if the combination of all of the salaries of the department heads is $500,000, okay, the total salary increases should equal 3.25% of that $500,= 000, and then it's up to Chuck to decide how he parcels that out among the depar= tment heads based on their performance. If he chooses to give somebody a 5% increase, then somebody else has= to get a 2% increase. It has to balance, it has to equal 3.25%. That's my suggestion. = It's done in industry all the time.
