&= nbsp; Mr. LeBlanc: I'm here concerning the vehicle inv= entory I received and there is a line there that says 24/7, and am I to assume that that means that people who take them home use them 24 hours a day, 7 days a week? On the sheet is says 24= /7.
&= nbsp; Ms. Robson: Yes, Bob, you can always just = call me and ask me that, you didn't have to (inaudible).
= ; Mr. LeBlanc: Well no, I had to inform the Council cause there is a point that I want to make concerning th= at 24/7. I wanted to make sure t= hat I knew what I was talking about because I've been known to make a fool of mys= elf before. The reason why I brin= g that up is that all of the departments are marked Yes, or Y or N, except for the Police Department, and nobody in the Police Department takes their cars hom= e. I was just wondering, is that some= thing new or is that policy?
= ; Ms. Robson: I'll double check (inaudible).
&= nbsp; Mr. LeBlanc: Well as I say the only thing that = is checked here for that department is (inaudible) for personal use, there's t= wo people.
= ; Ms. Robson: Well for personal= use means they have (inaudible).
= ; Mr. LeBlanc: Not according to= tax structure, but I'll accept that.
&= nbsp; Ms. Adams: My understanding was that seve= ral years ago the Town Council had voted for the Police Chief, the Deputy Chief, and I think either the First Lieutenant or the third in command were authorized, since they are on call 24/7, 365, they were authorized to take those vehicles home. That was= my understanding (inaudible) where the Council voted several years ago.
= ; Ms. Robson: Yea, no, the Poli= ce Chief and the Deputy Chief (inaudible) I don't have (inaudible) in front of= me (inaudible).
&= nbsp; Ms. Adams: They're authorized by the Town Council.
&= nbsp; Mr. LeBlanc: I accept that but I would like to = have a corrected list, one that is up to date to tell me just what is going on in = that department. If I can request = that.

&= nbsp; Mr. LeBlanc: Secondly, two years ago, last budg= et, there was a fight going on about getting two marked cars, and we were told = at a public meeting that we were getting two marked cars instead of 2 unmarked c= ars, and after the budget was passed there was a change made and we bought 2 unmarked cars, and one was supposed to go to the Deputy Chief and together = was supposed to go to the Detective Bureau because of the high mileage of 54,00= 0 or 58,000 miles on a detective car. Now through my observation in Town I noticed, and also according to = this sheet, it was taken away from the Detective Department, one new car, and gi= ven to the Lieutenant on patrol. = Is this the way you change things after you tell people you're going to do one thing and then you keep changing things? Is this the ki= nd of a problem we're going to have with our budget, that you can't seem to get t= he truth?
&= nbsp; Ms. Robson: I would never purposely (inaud= ible) anybody. There was further discussion after the budget meeting so the details (inaudible) and changes = were made, but at the time of the budget discussions (inaudible). So, no, it isn't the normal way th= at things will happen (inaudible).
&= nbsp; Mr. LeBlanc: Then the second change, when they = took that car away from the Detective Bureau and gave it to the Lieutenant on Patrol, the Lieutenant on Patrol is a Crown Victoria 204 with 1,500 miles.<= span style=3D'mso-spacerun:yes'> That's another change.
&= nbsp; Ms. Robson: I said changes were made after= the budget discussions.

= ; Mr. LeBlanc: This is in respo= nse to the last Town Council meeting, July 19th.&= nbsp; You didn't give me a chance to respond on the second Public Participation. You allowed Mr. Archer, though, to violate the law, respond, you should have allowed me to respond.

&= nbsp; Mr. LeBlanc: I attempted to respond to him = after the meeting and he didn't want to hear anything. The mistake he made was saying I d= id not have my facts about the Police Commission's role in the budget process, so buckle your seat belts, these are the facts:

· Town Charter, Section 404C2, the Police Commission shall prepare the annual budget for the Police Department in consultation with the Chief.
· March 14, 2001, Police Commission Regular Meeting, there was a request of Atty. Pilicy for a legal opinion on the rol= e of the Police Commission. Page 1= 0, the Charter gives the Commission the primary role in the initial preparation of= the budget.
· January 14, 2004, Police Commission Meeting, Page 28, there was discussion that we should not get a completed budget, it= 's a violation of the Town Charter. Page 31, we were handed a completed budget by Chief Carroll 3 minutes before adjournment.
· March 9, 2004, Watertown Finance Subcommitte= e, Mr. Archer, who is not here unfortunately was Chairman. Police Department handed a complet= ed budget in then. Commissioner = Pawlak got up at that meeting and stated this is a violation of the Town Charter.<= span style=3D'mso-spacerun:yes'> We had no input whatsoever with the budget this year. Unfortunate= ly Mr. Pawlak wasn't shown on the Minutes as speaking then. Mr. Archer did the Minutes.
· Wednesday March 10th, Police Commission Regu= lar Meeting, budget discussion was on here. Next night there was budget discussion. The budget is out of the control of the Commi= ssion and the Police Department at this time.
· March 10th, Commission Regular Meeting Minut= es, both myself and Mr. Pawlak got up then and stated this is a violation of the Town Charter, we did nothing whatsoever with the budget.
· March 15, 2004, Town Council Regular Meeting, Mr. Pawlak and myself both addressed you, Mr. Chairman. I spoke about how the Commission n= ever had input, approved, or voted on this budget. Absolutely nothing whatsoever was = done.

there's two violations of the Town Charter this year just with the Police

You were given the budge= t in ample time. The budget doesn'= t come to the Town Council until March. You were given it in January. I have the Minutes here. In March when you had an opportunity to work on the budget, you walked out of = the meeting.
&= nbsp; Mr. LeBlanc: It was March 10th, it was the night after it was brought to the Finance Subcommittee. Get your facts straight.

&= nbsp; Mr. Mickel: From what I understand, the process= , once they're typed, uploading is a very simple, straightforward process.

&= nbsp; Mr. Mickel: So if these people have them typed,= they should be there.
&= nbsp; Mr. Kane: Do the minutes have to be approved = at the next meeting before they can go?
&= nbsp; Ms. Adams: I wouldn't put them on unless they = were approved.
&= nbsp; Mr. Mickel: It's been the policy all along= to put them up right away, but if you want to approve them, go right ahead, but put the agendas on. The agend= as don't need to be approved and they haven't been put up there in 2 months.
&= nbsp; Mr. Kane: Do we put the agendas on the web si= te?

nbsp; Ms. Robson: Yea, we do the best we can.
&= nbsp; Mr. Mickel: I bring this forward because I= spoke favorably about using the internet as a method of getting information out to the public and these are pretty straightforward, simple things, so I would encourage you to do better at that.
&= nbsp; I came before this group also asking if we do not have an Ordinance Hearing Officer, are the ordinances enforceable?&n= bsp; Has that question been resolved?
&= nbsp; Mr. Wick: I wouldn't say it's been resolved.<= span style=3D'mso-spacerun:yes'> The Ordinance Subcommittee has not= met since you raised the question. We have a meeting scheduled for next Monday.&= nbsp; Everybody's schedule came together finally and that's one of the iss= ues we would be considering. One = of the realities however is that there is no need for a Hearing Officer unless som= eone appeals.
&= nbsp; Mr. Mickel: Without a Hearing Officer, I would imagine everybody would appeal. One other issue about the web site. On the calendar page, there's a meeting that's missing on the second Wednesday= of the month.

&nb= sp; Ms. Adams: We're still workin= g on P.O.'s cut with last year's budget, among other things.
= Turkey Brook Improvement Project - we're still short of two, what's the word I'm l= ooking for, easements. It was down t= o one, but before the papers were filed with the Town Clerk the person sold the property so now we have to talk to the new property owners.

= NPDES - Storm Water Phase II - we need to put them to a public hearing for public comment.
=
= Street Overlay Program - Just so people realize that there are several roads that = have (inaudible) been paved, but we haven't done the driveways yet, the part bet= ween the road and the driveway, and we're going to work on that as time allows to make them all nice and even.

Mr. Kane: Do you or Meredith have any inform=

= Ms. Adams: Yes, (inaudible) that night at the Public Works Subcommittee meeting, what happened is what they believe is the compactor going up the road, they wanted the copper pipe, lead pipe, old/new welded together and we think that it was the vibration, the (inaudible) fire hydrant and then I guess that's what (inaudible) connection just vibration.=
Mr. Kane: So the finishing of= the paving is on schedule again?
= Ms. Adams: Right. They took up the old pavement caus= e we don't want it to look like goodness, we just paved the road and now we dig = it up gain, so they scooped up all the old pavement, (inaudible) to put down so it won't look like that. I don't know if you have an update= since last Tuesday, Meredith?

Ms. Adams: It's just one of t= hose things, but unfortunately the road was (inaudible) and it doesn't happen du= ring the (inaudible).
Mr. Rinaldi: I noticed (inaudible). There was a chan= ge there (inaudible). I was the = one that was hysterical, cause (inaudible).
= Ms. Adams: (Inaudible). It was unfortunate, but I guess the effect of the water supply (inaudible) in that area (inaudible).
= Traffic Study - Intersection of Davis and Colonial - This is the report. This was brought about as back as = an intersection there, that is #3 in Town as far as traffic accidents with injuries. One being the intersection of Riverside and Falls Avenue, which has been worked on and wi= ll be (inaudible). Another one i= s this right here now. (inaudible) to this report and it is quite lengthy.

Mr. Valenti: In connection wi= th the Turkey Brook Project you stated there was an agreement for an easement but = then they sold the property. Doesn= 't that run with the land? Or di= d they not record it?

= ; &n= bsp; We are a non profit organization and work strictly on a volunteer basis and we need a utility vehicle, and realize the Recreation Department has a bus tha= t is currently not running and going up for auction. It would fit our needs. We are willing to fix it, and woul= d tow it away if need be. I underst= and that the Town has budgetary needs, but we also understand in the past anoth= er bus was donated to another non-profit organization. I do consider it doubtful that auctioning a senior citizen bus would provide the Town with a large source = of revenue. I believe that the v= ehicle which would be donated in as is condition would be a source of support for = our Drum Corps for many years to come. Please consider this an official request by me, as the Director of t= he Oakville/Watertown Drum Corps, to have the auction revoked and the bus dona= ted to the Oakville/Watertown Drum Corps. I can be reached at any time to discuss this matter with you or the = Town Council members. I would like to thank you in advance for your support and consideration. Originally there was = going to be a bill which we were going to be allowed to back charge this and migh= t be able to recoup some of this money, and they said no, we can't do that eithe= r, so basically the Town has to pay the $3,602 with no recourse against the individuals who are delinquent. So it's the State's way of raising some money.

Mr. Mickel: Elaine mentioned a study that = was done between 1999 and 2001 about the number of accidents in Town. You mentioned there were three intersections that were very dangerous.
Ms. Adams: You want to know what #2 was, = right?
Mr. Mickel: Yes, and #3.
Ms. Adams: That was #3, Falls Avenue and Sunn= yside was #2. Fern Street and Depot= .
Mr. Mickel: And the #3 accident site had 4 accidents in a 2 year period?
Ms. Adams: This is only accidents right, that= occurred with injuries, no minor fender benders.
Mr. Mickel: So an intersection that has more accidents with injuries could be on that list in future years?
Ms. Adams: Absolutely.

We have had Mr. LeBlanc here sever= al times before the Council, we've had God, I'm sure you've been reading it, a= multitude of letters back and forth in various newspapers, and I'm wondering if it mi= ght make sense just to have the Commission Members come before the Council, may= be as a discussion item, we have Discussion Items, to see if we can see what t= he root problem is here, or if there is one, and then hopefully have that Commission operating properly or at least we'd have a better insight into w= hat the issues are. I would move = that we add that item to our next meeting.

&= nbsp; Mr. Kane: The only thing about that is a coup= le of things. If I can go back and = use your words, we're saying that they're not being run properly. No one is saying that they have be= en run improper so I don’t agree with you there. Secondly I don't think we can forc= e any board or commission to come or report n front of us, if you will. I think we can ask people. (Inaudible). I think we've done a lot of times = is try not to get involved in specific items of a particular board or commission as well, you know, we can't go to the Planning and Zoning and ask them to do something a certain way, or Water & Sewer, or any other commission. I'll let other members speak on th= at if they like, but I don't think it's necessary at this time.
&= nbsp; Mr. Valenti: Maybe then by way of allowing other members to speak on it, I would just move that that be added to our Agenda = for the next regular meeting and then we could vote it up or down.

It's clear that there seems to be a problem. I don't think any of= us have all the facts and the purpose of this (inaudible) hope (inaudible) wou= ld be to try and get the facts. = As an alternative to try and do something within the constraints that exist at the Council level, and then the charge would be for this Task Force, if you wil= l, to just attempt to identify the problem, suggest a resolution, and come bac= k to the appropriate group and maybe the Police Commission itself with some recommendations.

I think (inaudible) what goes on. I t= hink we need desperately to hear both sides of the issue. Again, that's important for us to getting in on what's going on. As far as asking commissions to come here, since I've been around we've done i= t 3 times. It's certainly within = our purview cause they are appointed by this Council and they answer to this Council, so that's our purview, but again, I can't stress enough that we ha= ve to hear both sides of the story, this can't go on with Letters to the Edito= r. I think we're all looking pretty b= adly at this point.
