            Mr. Guerrera: We took the liberty, cause we = were at the Board of Ed meeting last week, we've got a couple of pamphlets we'd lik= e to hand out that answered some of the questions that the Board of Ed had that I know are coming to you.

            The top letter, just so you know, is from the Field Turf track builder, he's a certified track builder, he's the general manager of the track division, it explains how they cover the track, how they deal with track conditions when they do the turf, but he wrote it figuring it would help any questions as f= ar as how the track is protected. On the second page there were some of the other things that are covered are the drainage under the track, there should not be any drainage under the track = that they are aware of, but there is no way to tell until they look at the drawi= ngs. I tried to contact Charlie Be= liveau today but our schedules just didn't connect. The maintenance cost is basically = one person dragging the field once a month or cleaning up the mess or whatever = the labor costs of that would be. Our estimate of $2,500 should be fairly close.= Your replacement cost is typically 2/3 and if you calculate that on = the cost of $567,000, it's $375,000.

            Mr. Pawlak: That's in today's dollars.

            Mr. Guerrera: That's in today's dollars, in 10 y= ears it could be another $60,000, $70,000 added on. He couldn't answer your liability insurance question, that's something you have to contact. Additional equipment to maintain t= he field, they provide the drag piece that's needed and it could be hooked up = to any tractor or golf cart as it says in there.

            Mr. Pawlak: Is that like a reverse brush like u= sed on lawns for leaves?

            Mr. Guerrera: Yea, we were down in Berlin and the guy explained it fluffs= up all the material underneath so it looks brand new again because after time, after the month it builds down a little bit and they just fluff it back up. The price from $750,000, originally he feels it was most likely a budgetary number, but he couldn't = tell exactly until they looked at the whole spec, but $567,000 I don't know what they were planning on the first time, if they were doing the whole entire inside, but if you looked at the picture we gave you, it would look just li= ke Wolcott, it covers the full playing field, it covers the full soccer field,= and it gives you 5 yards past the goal post which is a barrier area so when a k= id runs out of bounds he has plenty of room.&= nbsp; There's no need, they feel, to turf the whole entire inside, cause if you do you are probably going to add another $100,000 to the project, that’s why Wolcott did it the way they did it, and if you go to a lot= of complexes, that's what they do. They do it just enough so you have a playing field and the boundary outside the playing field. Ex= tra water affecting the track, there is no additional water cause all the water is draining into the curtain drain that is already there, or = the concrete drains that are already there.&nb= sp; No water will be drained onto the track. And the other question was the fie= ld events, like throwing the javelin, the javelin c= an be thrown if it has a protective tip on it, which is a rubber tip. The disc is not a problem and the = shot put landing area, the shot put was the only one that he said that the surfa= ce, they would have to put an extra pad underneath the shot put area, cause he = told me if they were able to move around with the shot put, it won't keep crunch= ing down in the same sot, that's when you have a problem.

            What we're asking, you guys have been great, is I understand, I'll take 2 second= s to explain something. We figured= , and I don't know how anybody would use the money, but the signage up there, I'm= not sure if it's $800 or $1,200 a year they get for the advertisement, now you = only have 6 signs up there, we're figuring if this goes forward, a lot of people, because it's going to be used so much, are going to want to advertise, so a= ny company around for $800 a year gets a sign that's going to be seen by a lot= of people. If you just calculate= that with a matter of 50 signs, that's $45,000 a year. Over 12 years that's $540,000, it = more than replaces the turf if it has to be replaced in 12 years. I mean that's just another option,= not counting anything else.

            And the other thing that's been mentioned to us, we have a part time athletic director, the scheduling is hard, well we were up at the game Friday night = and it was pouring. They had the = game and Ms Legge came over to our concession and she was curious about Judson, = if the soccer was using it on Saturday cause she was trying to reschedule the J.V. game cause she didn't want to play 2 games in= a row. This would eliminate all that. It eliminates her hassle about trying to reschedule cause of rain, it eliminates her hassle about tr= ying to find busses to ship the kids for their home games, i= t does eliminate a lot. The one= thing I was talking to Shamus about, I was telling him the concerns, he said why don't we try this, they're willing to write you up a full bid spec for free= , no cost to us, cause I know there's costs about an engineer, they're willing to write up the full specs, with the picture they supplied that shows the exact field, and then he recommends, this is them, get 3 proposals, it doesn't co= st anything. I mean that would answer a lot of questions. Guys come in, they= 'll go down Town Hall, they'll look at everything, the track, what's underneath the track, they'll look at the drainage, and you're going to get 3 figures that= are going to be right on and you'll all know what's involved and what it covers= and what it doesn't cover, and it won't cost the Town a dime to put it out for proposal, and like I said, Field Turf (inaudible) is willing to write up the specs for free and that would be all we would need. I mean we're willing to contact wh= oever you want. I mean we've been contacting a lot of turf companies, this company= is the only one who has been responding every time and answering every question that we have ever had. That's= what we're asking and this way it would pt a lot of stuff to rest. And the other thing is if you've b= een in construction, you know it's coming to the end of the year. Construction companies are startin= g to look to book work for next Spring so I know we have time, but if we ever si= gned something by the end of this year, you're going to save more off of that $567,000 cause companies are hungry to start work, and this way that guy is= in place, and as soon as the track season is over, or school is over, boom, yo= u're on the list, you're there, but it's just another way we could probably save= a little bit instead of getting an engineer and everything else who probably doesn't do tracks.             Mr. LeBlanc: I just want to compliment the Counc= il and the Town for the job they're doing on Highland Avenue, rebuilding that road. If it gets done it will be beautiful. Water has stopped = going into my cellar finally after 20 years, because the sewers were all blocked = up.

            Has any approval by the Town Council, Town Manager, Acting Town Manager, concer= ning drawing up some by-laws by our Town Attorney? I was informed that it's been in p= lace already, it's been approved and I didn't know that so that's the reason why= I'm asking.

            Mr. Pawlak = With respect to what, Bob?

            Mr. LeBlanc: Drawing up a new set of by-laws for= the Police Commission.

            Mr. Pawlak: That will be going forward. I was told about that and I didn't= have all the information, we're going to be talking about that, it's going to be done.

            Mr. LeBlanc: I'm not in favor of it, but I just = wanted to know if it was going to be done. Secondly I have a problem with a legal matter concerning a little street, the 4th left on Mi= ddlebury Road, going up towards Middlebury, it's called Carmell Hill. A young couple bought a house on C= armell Hill and in the deed it says Carmell Hill.= Now on the sign on the front of the street it says Caramell Hill. So they approached me and they wan= t me to marry them, and they didn't know what address to put on the marriage lic= ense. I really don’t know. I went = to the Engineering Department last Tuesday and I asked what the name of that street was, and at first they said Carmell, so I said the sign was wrong and then = they checked. In 1954 the street w= as approved by the First Selectman, there was a town meeting (inaudible) as Caramell but since that time, all the deeds, all the assessments, all the t= ax reports, all the social security information is Carmell. Somehow or another the Assessor go= t wind that I was asking questions, now they're changing the assessments to Caramell. So my question is h= ow do we go about changing the name of the street to make it easier for the 4 or 5 houses involved and all these legal papers involved? Can we just somehow change that 1954 ruling and change the name to Carmell?&nbs= p; I'd like to talk to the new Town Manager about it, give him some experience in changing the names of streets if he wishes.

            Mr. Rinaldi: Jack has a map here and it says Carmell Hill Road on the map.

            Mr. LeBlanc: If you go on MapQuest and you happ= en to put those 2 streets in, one will send you to Warren Way in Watertown, and the other one will send = you to the 4th left off of Middle= bury Road. If you look at other maps, some ma= ps, Caramell I have some in the car, I'm sorry I didn't bring them in, I have 4 maps and they're all different, and even the Post Office now is having a problem, cause if you don't change that name, although zip codes, zip plus 4 goes out the window because zip plus 4 puts the letter carrier right to the house on the street, so it's just a little suggestion.

            Mr. Rinaldi: Did they change the sign up there?<= /p>

            Mr. LeBlanc: The sign right now is Caramell, but= all the deeds, assessments, taxes . . . .

            Mr. Rinaldi: There was a sign change?

      = ;      Mr. LeBlanc: No, they put new= signs up, new color.

      = ;      Mr. Rinaldi: I had a friend up there for 20 years and it was always Carmell Hill Road, so I don't know where this other th= ing came from.

            Mr. LeBlanc: The first house was built in 1= 955, so they approved the street in March of 54, and the first house went in the= re January or February of 55, and somehow or another they put down Carmell, which was wrong, and everybody else followed suite.

      = ;      Mr. Pawlak: We'll have to fig= ure out the easiest way to correct the problem.

      = ;      Mr. LeBlanc: I don't know how= you go about changing the name of the street, you ca= n't just change the sign, like these people said, what will they put on the marriage license.

      = ;      Ms. Adams: We had this issue = in another area of Town, Roberts Street or Roberts Avenue, legally the sign th= ere I think has been Roberts Street since probably the 50's, legally it is Robe= rts Avenue, and the Subcommittee suggested that the neighbors, if they want to, petition, come to the Public Works Subcommittee to have it changed and upon= our (inaudible) I'm not going to speak for the other members, but our approval = of changing it, then it would be brought to the full Council to be changed, but personally myself, I think you'd need a good majority of the neighbors to w= ant the change for a change to be effective.

            Mr. LeBlanc: There are only 4 or 5 houses on th= at street, so I talked to some of the people and their checks and social secur= ity are all Carmell Hill.

            Ms. Adams: Well that's what they gave them.

            Mr. LeBlanc: And what happened since then is En= gineering got wind of what I was doing and all of a sudden they started changing the assessment cards to Carmell, now we're really going to get confused if the = Town Council doesn't . . . .

            Mr. Primini: Is that the one that's considered a private road?

            Mr. LeBlanc: No, it was accepted at a town meet= ing and the First Selectman in March of 1954.

      = ;      Mr. Pawlak: It's a dead end s= treet.

      = ;      Mr. LeBlanc: I just happen to= come by Deland Field a few minutes ago and I saw people golfing on it, is this l= egal? That's a $400,000 field, I don't know what the regulations are?

      = ;      Mr. Rinaldi: No. If I remember correctly guys used = to go up there in the morning and use it for a driving range and when they reconstructed the field, they weren't supposed to do that anymore, so no, there's not supposed to be any golfing there.

            Mr. McCleary: I missed the last meeting unfortunately. There was an i= tem on the agenda regarding crushing of stone, or something. Can you tell me what that's all ab= out?

            Mr. Pawlak: If I remember correctly, it was a proposal we use crushed stone for repaving or cracked sealing or something = of that nature, Elaine?

      = ;      Ms. Adams: Chip sealing.

            Mr. Nardelli: There was money appropriated in the= 05/06 budget which they went out to bid, and I don’t think anybody bid on i= t, so they rebid it this year and they re-appropriated $11,000 for it. What they were going to do particu= larly with that $11,000 I'm not exactly sure.

            Mr. McCleary: Cause t= he way it reads, it sounds like we're hiring a crusher or something?

            Mr. Pawlak: No, not at all. We're paying s= omeone, I think it's $5.00 a ton, something along that line.

            Ms. Adams: It's a remediation f the roads.

            Mr. McCleary: Well I thought maybe Watertown was going to do something like Middlebury is doing where they're taking property that is hilly or what not= and turning it into usable property and then using the stone for their own high= way department, which is&n= bsp; a rather intelligent way to develop property.

            The other one is the sewer project, which I see is back alive again. I just want to say I hope it dies,= but should it continue forward, I would hope you people would put it forward for another public hearing considering that there's astrono= mical new valuations for property, I'm hearing numbers of over $20,000 and= I'm just wondering if the people that would affect are still in favor of it.

            Mr. Pawlak: It's a project that the Town Counci= l in and of itself will not, cannot approve, it has to go to a town meeting, so = it will go to a town meting if the Council approves sending it forth.

            Mr. McCleary: Was that a late addition to the Age= nda, cause before I went out of Town I checked the Agenda a= nd it was not on there.

            Mr. Pawlak: It was on the Agenda.

            Mr. Fusco: Regarding the Straits Turnpike sewer project, at the last meeting there was some discussion and I was informed t= hat there was going to be some questions asked of the Town Attorney. Has anything moved forward in that regard?

      = ;      Mr. Pawlak: Yes, he is resear= ching it and we will have a legal opinion with respect to the funding of that pro= ject for our next Town Council meeting which will be on the 1st or 2nd of Octobe= r, I believe. So we should be all = set then.

            Mr. Kane: A woman came to us a few meetings b= ack about Heminway Court, has anything . . . .

            Mr. Rinaldi: It had to go to Planning and Z= oning first. We thought it came her= e and then Frank checked and it had to go to Planning and Zoning.

            Mr. Nardelli: Yes, I contacted that woman and she= was going to go to the Public Works Meeting.&n= bsp; I called her on the phone and spoke to her.

            Mr. Rinaldi: We were advised that Planning and Z= oning handles that, am I correct?

            Mr. Minnich: I don't know the issue.

            Mr. Rinaldi: You probably haven't gotten it yet,= but it's to approve an existing road, but that would be under your umbrella.

            A.        Memorandum from the Park and Recreation Commission, Re: $600,000 State Grant Money, dated September 14, 2006.

Mr. Pawlak: At the regular Watertown Parks and Recreation Commission meeting dated last Thursday, September 7, 2006, t= he Commission unanimously went on record to recommend to the Council to relook into the Rickivicus property if available, or a portion thereof. The Commission felt this was anoth= er suggestion on the expenditures of the State grant money.

B.         Letter to Chuck Frigon, Re: Town Manager Appointment, dated September 14, 2006

            Mr. Pawlak: Dear Chuck: It is with a great deal of satisfa= ction and confidence that I, acting on behalf of the Town Council of Watertown, confirm your appointment as Town Manager for the Town effective September 6, 2006. As you know the Council= voted unanimously to appoint you at our September 5, 2006 meeting. That in itself speaks volumes with respect to what we expect from you. You have many years of experience working for our Town both as Purchasing Agent and as Acting Town Manager on two previous occasions. We have every confidence that the knowledge and experience and strong commitment to two way communication, bo= th with your subordinates and the Town Council, will stand you in good stead and en= able us all to improve the quality of government and services we deliver to the deserving citizens of Watertown.         &= nbsp;   Mr. Frigon: I have a variety = of issues to update you on this evening, but I think first and foremost it's a= ppropriate for me to, this being my first opportunity meeting with all of you, to say thank you for inviting me back to the office, it's an honor for me, and I assure you I will work very diligently to maintain your trust and confidence. =            As you may recall last March, the Town Council authorized the Town to particip= ate in a full cooperative with Region 15 which is compromised with some 35 or 40 t= owns, boards of educations, and so forth. This past week the contract was delivered to my office, with was accepted and signed. For heat= ing oil it's gone from $2.03 to $2.27, and that's a fixed price through August = 31 of 2007. That's about a 20% increase. Unleaded Fuel has g= one from $1.99 to $2.42, and diesel fuel has gone from $2.16 to $2.49. Those are all fixed prices that wi= ll be charged through August 31, 2007. Although that is high, the good news is we budgeted slightly higher = so if we have a reasonable to mild Winter we should, I= 'm seeing a lot of no's over here, we can always hope.

=            The Town Hall Structural Analysis - a contract was signed with Joseph Calabrese= as authorized by the Town Council and that work has begun and should be comple= ted within 45 days. A report shou= ld be available to the Public Buildings Committee for their November 15th meeting, with hopefully a recommendation coming shortly thereafter to the Town Counc= il at their November 20th meeting. That is moving forward.

=            Later on the Agenda you'll be asked to approve a formal job description for the l= and use/zoning enforcement officer and in conjunction with that effort, I will = be meeting with Planning and Zoning on Wednesday, September 20th and we will formalize questions that have been written and will be submitted to them on= the 20th. 5 candidates have been selected; I worked with the Council of Governments, we reviewed all of the applicants and selected 5, and those applicants will be interviewed on the evening of the 27th, and I believe it's the Planning and Zoning's intention= to have a special meeting immediately following and hopefully take some action= on the applications received, so that is moving forward and hopefully by the 2= 8th we'll have some good news.

=            720 Echo Lake Road, you'll recall again that in the budget we have a $200,000 l= ine item as revenue for the sale of 720 Echo Lake Road, that's that smaller whi= te house as you go up the hill towards Buckingham on the right. That piece of property was sent to Planning and Zoning for review and their review has come back advising us t= hat this property has already had its first cut, or a free cut, done in 1965, so we're not going to be able to easily divide that house from the rest of the John Trumbull property. It's = going to be treated as a subdivision and with that in mind, the Engineering Departme= nt is now discussing or getting some quotes from some land surveyors to survey= the property for us and we will submit a subdivision application to P & Z w= ith an 8-24 approval request at the same time.= We hope to move that forward as quickly as we possibly can, it's a cumbersome process but we'll work through it.

=            Legal opinions, as Joe reported earlier, the 3 questions that were asked of the T= own Council at the last meeting have been formally requested of Franklin Pilicy= and I'm sure that his opinions will be available, I'm assured they'll be availa= ble for the next meeting.

=            The Economic Development Coordinator, although I was not a participant in the application process, the job was formally offered to an individual who has since declined, they took a position elsewhere, so I will be discussing this with the Economic Development Commission this Thursday and we will either revisit the applications that we received or re-advertise; I'll let you kno= w at the next meeting.

Now I know, I talked to Chuck, he = does not have a problem with it, but just a word of caution, when something is t= his detailed, that you basically almost tie your own hands because you can't re= ally ask the person to do anything else and if there is ever a problem, it's not= in my job description, we have no leg to stand on, so just a word of caution t= o Zoning and to yourself.

Mr. Pawlak: In spending some time looking at th= e job description, I did pick up one area where it seemed to be redundant, and th= ere may have been more, it was just a question of reading the Description of Du= ties and then reading the Knowledge, Skills and Abilities and then trying to remember what was in the fist part and compare that to the second part, but there was one in particular that I was able to look at and it was saying the same thing in 2 places and that is on page 2 the very top line it says "reads, and interprets maps, statutes, ordinances and regulations" under Duties, and then it says Knowledge, Skills, and Abilities, the 5th li= ne down, right in the middle, it says "considerable ability to read and interpret laws and ordinances, regulations, maps and building plans."<= span style=3D'mso-spacerun:yes'> It seems to be saying the same thing. If these are your duti= es, then you have to have the ability to do that, it sort of goes without saying. There may be other ar= eas where there are redundancies, at least in my opinion, but I didn't really q= uite frankly pick them out.

I just question some other things that were there, it says good knowledge of = (inaudible) requirements of building construction and safety, knowledge of standard too= ls and materials of building trades is helpful but not required. That caveat at the end is fine bec= ause we do have the building inspector, and that's what he gets paid for, so I t= oo had the same concern that you did, it's extremely wordy and it is very, very detailed and if at some point in the future someone and incumbent chooses to take issue with something that may not be in here, then we could have a problem. On the other hand if= we couch these job descriptions in more general terms, leaving ourselves more flexibility, then it's a way to prevent problems down the road. My personal opinion would be to as= k the Planning and Zoning and the Town Manager to look at this again to see if we= can streamline a little bit and simplify it just so that we have some flexibili= ty down the road. Dave, do you w= ant to weigh in on this at all?

Mr. Minnich: We added some additional words to = the job description and it quite frankly was due to the issues we had with the former administrator. We went= with the Zoning Board of Appeals and the Inland Wetlands Commission we had 2 meetings on this topic and we also brought it back to you also and we feel = what you have before you is what we have accepted as the job description. It is more wor= dy than others, that is true, but we find it is necessary to do so, and that's= all I can say. We have approved t= hat job description after consultation with all the boards that I mentioned, so= we are comfortable with it and we also worked with the Assistant Town Manager.=

Mr. Pawlak: Again, I just say that very key sentence, "personnel decisions, including performance evaluation, discipline, recommended salary, and similar matters shall be administered by the Town Manager only in concurrence with the Planning and Zoning Commissio= n." We approve this, we're all in it, = so if there are any problems down the road, you know, those problems would be of = our own making, so as long as you people are satisfied, you, Z.B.A. and the Tow= n Manager . . . .

Mr. Minnich: We are, and the last sentence that= you read, is your language, you put that in the ordinance = that helped to establish this job description.

        &= nbsp;           &nbs= p;            &= nbsp;           &nbs= p; Mr. Pawlak: Roy Cavanaugh, Chuck Berger, and myself interviewed 5 engineering companies and the ori= ginal thought was that we were going to have to replace the bridge. We asked if we could repair it, do= we qualify for grant money, and we do qualify for grant money but the problem = is we'd have to go with the Army Corps of Engineer guidelines which requires a= 100 year flood plan would be a 32% grant it would also add 8 months onto the project to go through all the approval process and all the engineers confir= med that they didn't think we needed a 100 year flood plan, so yes, we would qualify for a grant at 32% but it would actually cost us more money in the = long run. It was confirmed, all 5 engineers did agree, it can be realigned, and that was one thing we (inaudi= ble) we asked that question, so it is a good benefit for the town to do it and t= he life expectancy was the same.

        &= nbsp;           &nbs= p;            &= nbsp;           &nbs= p; Ms. Adams: This is all coming out of, you may = all remember the Cherry Avenue bridge collapse, so this is one of the bridges a= nd especially since Davis Street, Davis Street is (inaudible) than Echo Lake R= oad, if you can believe it, we did the study, we did the traffic count, and this= is probably our busiest east/west road that we have. The Subcommittee back then we figu= red let's start with what is the major impact.= If the Davis Street= bridge were to have a problem, we would basicall= y be disrupting traffic tremendously, unlike Cherry Avenue, there were alternate= s they could go, we just don't have that here with Davis Street, that's why we decided= to go forward with this as our first process.

        &= nbsp;           &nbs= p;            &= nbsp;           &nbs= p; Mr. Primini: Well the alternative was going to b= e, if anybody remembers what happened with the Echo Lake Road bridge, where half = the road was shut down, so we'll do something similar to that, we asked the question how long would it take if we shut the road down with alternate rou= tes and it would be about 3 or 4 months, so we didn't think that was viable eit= her.
