Mr. LeBlanc: At the last meeting I spoke about a= certain street that had the wrong name, on the deeds, assessment records, tax recor= ds, social security records, bank accounts, and now I come to find out that also the voting records are wrong, so are these people eligible to vote because = if they don't have the correct address on the voting records or they'd be knoc= ked out. The reason I came here tonight is to find out does the Council agree t= hat in order to correct this situation I have to go through all the people to g= et them to form a committee to have the street name corrected? Is that the Councils' opinion?

= ; Mr. Frigon: I did research the minutes of the last meeting, and what was suggested, without any objection = was that the residents on that particular street petition the Public Works Subcommittee to have the name changed.

= ; Mr. LeBlanc: I appreciate that information, so I must go through and see these people. Why can't I just challenge the vot= ing records when they try to vote, and let you people worry about changing the name? Couldn’t I do it = that way?
= ; Mr. Pawlak: You could, but it= would probably be faster if they circulated a petition. There are only about what, 5 or 7 = of them?
= ; Mr. LeBlanc: I was thinking t= hey could get more up in arms if they couldn't vote, cause if someone refused to let me vote for some stupid reason I would be up in arms, but I want to tha= nk you for that suggestion.

Lou Salamone,
Mr. Salamone: I'm here this evening along with a = number of my neighbors regarding the use of a parcel of land which abuts my proper= ty as well as the Rectenwald property on that road. This matter has been before this C= ouncil twice, along with a number of other times in front of other commissions, however with that being said, this Council has voted twice unanimously to l= eave the land as is. Most of you m= ay or may not be aware of all the details. The individual who is trying to access this parcel of land to build a driveway so that he can access two other lots in that area is Town's Assist= ant Zoning Officer. Now the reaso= n this is coming to a head, that it's my understanding that that is Town owned property, the Council has final say on how that property is used. Most recently there was an applica= tion acted on and approved by the Wetlands Commission. The timeline on this application is phenomenal. You know, talk ab= out fast tracking something, it's incredible.&= nbsp; On June 7th there was an update given to the Planning and Zoning Com= mission this year, in which the Zoning Officer at the time, Mary Barton, was going = to seek an independent legal opinion as to whether this individual can access = or utilize that parcel of land. = On June 9th of this year there was an application filed and received at the Planning and Zoning Office. O= n June 15th it appeared on the Wetlands Commission agenda. It's quite clear that the deadline= for the June 15th agenda was June 1st, the application wasn't received until Ju= ne 9th, and it gets a little bit better beyond that, when I finally got a hold= of the application I found that our Acting Town Manager at the time had 2 signatures on it, one that was dated 7/2 and that was to access the property for inspection by the Commission. The other one, just so that I don't give you a wrong piece of information here,= was dated on 8/2 and what that second signature is on a page which basically authorizes the applicant to construct a road on that parcel of land. Now the question I have here is be= ing that the Council unanimously turned down any other use of that land other t= han open space as it currently is, when and who authorized the Acting Town Mana= ger to sign that application? I w= as at the first meeting of the Wetlands Commission and I asked that very question, again because this Council had turned that down twice and I said how can this Commission act on an application where the applicant is neither the owner nor has consent from the owner to use that parcel of land. I was given t= he response by one of the commissioners that ownership of the property is not = an element in their consideration as to act on an application or not. I'm not a lawyer, but I don't think that's correct. We forced a p= ublic hearing for the meeting on the 20th of July. The application was approved later= that evening at the regular meeting. Again I asked the question is it proper for this Commission to take = this application under consideration and I even asked the question if the applic= ant was acting on behalf of the Town in submitting that application. At that time there was no answer whatsoever. The Commission bo= wed their heads, observed a moment of silence, and waited for me to leave. I guess my being here tonight alon= g with my neighbors, did this Council authorize the Act= ing Town Manager to sign over the use of that parcel of land?

= ; Mr. Nardelli: When this appli= cation was put in front of me, again it was August 2nd, which I believe comes after all the dates that you've described, it was said to me just sign the application just to keep the permit process going. I wasn't committing the Town to anything, but come to find out I believe I was, but I was misled when that = was put in front of me as far as this application goes, and I sent a letter to = the Town Manager about my concerns the way this was handled, and Chuck has a co= py of that letter, but there was no authorization by the Council because it was put in front of me just to say that this application should be processed and just put your signature on it.
Mr. Salamone: It is our intention to file an appeal for the certificate of compliance that was issued based on that application. Where it goes fr= om here I'm not sure, however, there seems to be a push from certain people, c= ertain individuals on commissions in this Town that are pushing my neighbors and I= to the point of seeking a legal remedy here.&= nbsp; What that does is that it causes the taxpayers of the Town not only = to defend the Town against the suit, but in effect it defends the applicant in that same suit and I don't think that's proper. Again where this goes from here, I= 'm not sure. I'd like to ask if a co= py of that letter is available to the public?

Mr. Salamone: There was an independent legal opi= nion rendered by Atty. Hess which was based primarily on the findings of a previ= ous opinion rendered by Atty. Pilicy. In Atty. Hess' opinion he alludes to the fact that the applicant can enter an agreement with the Town Council moving our Town Attorney in a hold harmless agreement and I would question again as to whether or not our Town Attorney= had the authority to enter such an agreement.&= nbsp; And one other thing I had spoken to attorneys myself, hold harmless agreements are fine, they may prevent you from paying any damages but they = will not keep you from having to defend yourself in a court of law in case of any type of accident, so again the taxpayers of this town would be put at risk = from a financial standpoint for the benefit of one individual. Joe Monroe, if I'm not mistaken, is the Wolcott Athletic Director.
= ; Mr. Pawlak: As far as I know, absolutely not. We've had discussions regarding that and the Bonding Commission which gave us this mo= ney is I guess the best way I can describe it is "detached" from the elections. This is money that= is in place for us, we've talked to several people and they said it's really up t= o us as to how and when we spend it. Obviously we want to get it spent in the (inaudible) possible, but no, as far as I kn= ow, in the last discussions had, it's not in jeopardy.

Mr. Guerrera: The other number I'm going to = give you cause I told Mr. Stone I would mention his name, he said give them my number, I'll be more than willing to meet with any of them on the field and= explain everything. Yes, general construction, Mr. Monroe had nothing but fantastic things to say about them= , so they are very reasonable people, and all we try to do is give you their hon= est information, we never try to deceive anybody, we gave you every answer that= we could possibly get that we knew was a true answer, so we just ask that it n= ot be forgotten and that you know what, we're not going to go away until hopef= ully something is decided. Mr. Petroccia: I want to make some comments on Ms. Spinella and Mr. Salamone's comments, but first I want (inaudible) new Town Manager, I think it's a very good appointment and I want to congratulate and the first Town Manager was put in in 1962, James Sullivan, that's 44 years = ago, and since that time we've had like revolving door at that position and I'm = glad that Mr. Frigon has taken the job because I think we can expect some tenure= at least a dozen years or so, (inaudible).&nb= sp; But I think he'll be around for awhile and I’m glad the revolv= ing door has stopped.

respect to the property that's being talked about on

Mr. Rinaldi: I would like to know if somebody (i= naudible) new management we got for the Town. Who is he?
Mr. Pawlak: Right there.
Mr. Rinaldi: Thank you very much. I saw the paper but I just wanted = to see what he looked like. Now we t= alk about the fields, like Mr. Guerrera said are these contractors going to com= e in and do these fields, are they going to guarantee not to (inaudible) because we've been through a lot of these contractors, some are good, some aren't, = they give you a price, problem is the first time (inaudible) guaranteed they will not disturbed the track. That= 's what I would like to know. If= a contractor comes in there, from wherever, they say they can do the field, w= ill they guarantee they won't disturb other things? That's another thing, we do things in this Town (inaudible).&nbs= p; Now we got the Fire Department going up, we got the school going up,= I was wondering if we're using union contractors or out of contractors?

Mr. Pawlak: I think they're union.
= ; Mr. Frigon: Some are union; s= ome are not. They are all paid according to the State's prevailing wage laws.
Mr. Rinaldi: I understand that, but I want to k= now if these people that the Town hired are union or non-union? Not because I'm a union guy, I've = been a union man all my life, but somebody made a remark one time that union guys don't necessarily do better work than other guys. I have to (inaudible) on that. Now with union people do some of t= he schools and they're mediocre, but union people are good. Same thing with the (inaudible), l= ike they have to do the track and put a bridge, or whatever it is, I want to kn= ow, before we pay these people, (inaudible) do it. I want them to write on a pi= ece of paper, we will guarantee not to disturb this, if they do, they have to be responsible for it, not the Town. Some times lawyers look at things, all of= a sudden something went wrong. = $6,000,000, $7,000,000 how come? Oh, beca= use they missed this thing over here. Like I said, I worked in construction all my life, I did (inaudible)= jobs, there's no question about it, if I didn't like the job, I (inaudible) cause= I didn't like the way the people were situated. They were doing the school up here= , I wouldn't go on the contracts, I won't mention no names, and I bid on a job,= but cause it was Town's the way they were talking about, I bid as high as I cou= ld, cause I didn't want the job. = Not because I was union guy, but because (inaudible). I don't know if I'm making myself = clear on that or not, but I will say don't let these contractors fool you. Put it on paper, have a lawyer, an= d I see the way they're doing the school, even the other school, (inaudible) I = said shame on us. (Inaudible) how = come this cracked? This is suppose= d to be 4 pieces of (inaudible) you put 2 pieces. Why? Try to get things done the cheapes= t way they can, but in the long run we get beat.= That's my point. These contractors (inaudible). They're here today, gone tomorrow.= Today we live = in a world (inaudible) things, no question about it. We don't want that happening in To= wn when we build something. Buil= d it the proper way. Don't let it = come back and things are falling off, what happened ,= they disappeared. And they try to = blame the contractor. I don't blame= the contractor one bit. You put i= t on paper and say the way you want it done, not anything else. I want it on paper that if somethi= ng goes wrong, they're responsible for it, not the Town. So I think based on just Atty. Pilicy's opinion this whole thing picked up aga= in and (inaudible) Atty. Pilicy's opinion is directly contradictory to two previous opinions given by two previous town attorneys on this matter, those being Randy McHugh and Charles Stauffacher, who didn't think that this Town= had any right to grant Mr. Rafey or the previous applicant, Mr. Overton, access= to the property via this 50 foot strip of Town land and that was always a ques= tion in mind that seemed kind of odd, and then of course Atty. Hess (inaudible) legal opinions from Atty. Pilicy's legal opinions so that doesn't seem righ= t to me (inaudible) taking it upon himself to write opinions that frankly just d= on't make a lot of sense. Thank yo= u.

Ms. Rectenwald: I live abutting the property in que= stion. I just have one simple question fo= r this Council. I'm sure some of you recognize me cause we've been around for what seems like a million times, I know it's not, but it feels like that and I'm sure you people have a lot of other things to do with your time, I know I do. I'm trying to get an answer as to = when is no, no? When does no mean = no? Evid= ently I can't get an answer and Mr. Rafey, every time he's brought to what we think= is the topic was no, no, he just finds some other board of some other council = or some other place that he goes (inaudible) and all that other stuff, so I'm = just trying to find out who really has the final authority on this and why he's = been allowed to jump from board to board until finally, it's like having teenage= rs which I have 3 of, they wear you down, you just can't stand it anymore so y= ou finally just say yes, because it's (inaudible) and that's really the tactic he's using over the last 3 years and I for one can't afford another attorney bill, or another time sitting here wasting more people's time. So I want to know when does no mea= n no and who has the final say on all of this?
Mr. Pawlak: My understanding is, and I was not= aware of (inaudible) other lawyers, Stauffacher and McHugh. In my opinion quite frankly I don't understand why it was brought before the Town Council when it's a land use issue. I can tell you that I = am somewhat familiar in general germs with respect to the opinions that were rendered by Atty. Pilicy and Atty. Hess in effect holding that Mr. Rafey has the right to access his property, whether you agree with that or not is not= the issue. I know that there were= some variations with respect to each of those opinions, but they basically enfor= ced his right to access through that right of way or easement, whatever you wan= t to call it. I know that there we= re several discussion with respect to this particular issue, at I believe Plan= ning and Zoning, and Z.B.A., I really don't know how many times they did discuss= it, but I would say that I really can't answer when no means no, because I've s= een other things that came up, not particularly here at the Town Council meetin= g, but another issue for example, how many times a referendum for a school in Oxford was set or broken, I think it was broken down 5 or 6 times, but it j= ust kept coming back, I don't know, I will say this though, I believe in my opi= nion that the discussion and the decision regarding this, since it is a land use issue, properly belongs with either P & Z or Z.B.A., and I believe with this one, probably Z.B.A. I b= elieve a (inaudible) Mr. Rafey, at this point I do not have any plans to bring thi= s up and put it on the Agenda for Town Council consideration because I don't thi= nk properly we have a reason or the authority to look at it., I think if it's going to be decided finally, once and for all, it has to be at a land use commission or board, and if there are disagreements with respect to the ultimate outcome, then the recourse would be through the courts.

= ; Mr. Pawlak: I would suspect t= hat if nothing else changed, I wouldn't change my mind, but that's just a hypothet= ical question with a hypothetical answer. I just don't know, but I would suspect that if everything else stayed the same . . . .
Ms. Rectanwald: If you guys aren't going to put in= on your Agenda, what are we going to do about that whole other (inaudible) Mr.= Salamone had brought up about getting it signed (inaudibl= e)?
= ; Mr. Pawlak: I would review it= with Chuck Frigon, we would, if we have to, get a third party opinion with respe= ct to the procedure that was followed by one of our counsel, and since there i= s discussion here or question with respect to the impartiality of Atty. Pilicy, then we'= ll proceed with another, we do have 2 other counsels that we could use.
Ms. Rectanwald: That's fine. My last comment is I'm sure I don'= t have to remind you, but in the course of all these goings on, there have been numerous tax dollars paid for this one single person to have use of his property when in fact he does have use of his property, he just doesn't like it, he doesn't want to access it through Route 6 because it's all about the almighty dollar. Why has this persisted and suffered for the last I don't know how many years, asking the travesty that I have sat through many and many Z.B.A. meetings in regards to this, and we were always put as letters D, X or Y on the Agenda so that we = can sit there all night, and I have listened to a parade of people come up and = the minute anybody says anything about money they are shot down, goodbye, end of story, so the reality is he does have access through Route 6, and he doesn't want to use it, and he's using his position within the Town to get somebody, somewhere, on some board to agree with him. Pilicy based on the opinion (inaudible) and the zoning compliance certificate have the right to reach an agreement with and sign off on between Rafey, CL&P and the Town. I would suspect not, I don't see ho= w (inaudible) for the Town Council without (inaudible) and specifically with respect to t= he spelling, I don't know if it was a mistake, (inaudible) but it doesn't make= a lot of sense to me. scenarios, and Ms. Adams brought up to Georgetown issue, that I believe was=

paper street, so that was designated some type of access at that point in

know is this, when a development comes to (inaudible) and you designate open
space, it is not a fact that when the project is done and that land is deed=
ed

there was no designated open space, but we assumed that this was going to t=

open space that was connected to this piece of property, it did not state t=
hat
on the subdivision map but I think most of the commissioners assumed that is
what it was meant to be. Mr. Rinaldi: If this was assumed that this was g=
oing to
be open space, and it was deeded to the Town of Watertown, is it fair to say
that that open space is expected to stay open space? Mr. Masayda: Normally that is the intent. We try to, there was an attempt to=
get
access to that rear property and we were informed by Atty. Stauffacher that
there was no reason for Mr. Garrassino to allow access back there and that
should be made as open space. And
the same thing on the other side of the street it goes form Highmeadow to F=
ern
Hill, there's a 50 foot strip, (inaudible) down Fern Hill it opens up to a =
larger
piece but it's also says deeded to the Town of Watertown without the
designation of open space. Ryan Fahey, Mr. Fahey: (Inaudible) all the land in that
subdivision (inaudible) open space that was supposed to be deeded to the To=
wn
of Watertown did not (inaudible) to the Town of Watertown until this happen=
ed,
until Atty. Pilicy contacted Mrs. Garrassino and said look, we need for you=
to
sign this (inaudible) to the Town, and then at that time Mrs. Garrassino
deeded, I think there was 2 separate deeds and one of them was just this pi=
ece
of property and then the other one was the rest of the open space in the
subdivision, both of which were between Old Farms Road and Oak Drive, I bel=
ieve
there was another piece of there that was deeded to the Town as well, and t=
hat
was all deeded to the Town (inaudible) 2001, but from 1987 when the subdivi=
sion
was basically finished until 2001 the (inaudible). Enrico Rinaldi, Mr. Rinaldi: Open space, our land, I assume you =
can't
build on anything, that's open space.

build on it, I don't know why people complain about it. I used to say if you buy a piece o=
f land
anywhere, you better make sure that it's not wetlands or open space, then you buy the land.
These people want to get rid of the land for tax purposes, so they h=

to right off (inaudible) and some people are very, I mean it, they don't th=

I was very critical of their permi= tting process which up to this point has taken about 5.5 years and allowed CRRA to act we= ll outside of their permitted daily usage and we will be setting up a meeting = with them to (inaudible) our differences.

Ms. Adams: It's a good opportunity for the townspeople to work during the day or whatever to stop by and say hello.
Mr. Pawlak: We'll publicize it with the help o= f our (inaudible). I just wanted to comment very briefly on Item 10F, regarding tax relief for the elderly and veterans. I just wanted to ta= ke a few moments to express my opinions on this. Frank Nardelli, when he was acting= Town Manager and I had a discussion and I wanted to talk to him about the feasibility about doing this, because there are 2 groups in our town, state, and society who I believe through various (inaudible) reasons who need spec= ial consideration. One of them is= the elderly, many of whom are members of the greatest generation and the other = are military people who have given so much to protect us both here and overseas= , and I think we as a society do not express our gratitude towards these groups in anywhere near the fashion or form that we should. I think very often talk is cheap b= ut when it comes down to action we are sadly lacking so I put this item on the agenda, it may seem like a little bit early to be concerned about it, but I want to have something in place, that is my goal, in time for our next budg= et season, which I believe will probably start around December in its prelimin= ary stages because there are a lot of ways that we can, a lot of avenues we can take to provide some additional tax relief to the elderly and the veterans = and depending on the options that we look at, these can have widely different impacts on our revenues, so in order for us to make an intelligent decision= and come up with the right decision which will help our elderly and our veterans I've asked that we put this on the agenda and give Chuck and Frank marching orders so we can put all of our options on the table, come up with a reason= able plan which we can then put into action come next budget time.

· Residual vacancy in the Manager's office; Li= sa Cattaneo and I have been working, developing evaluation criteria specific to filling that vacancy and the position will be advertised soon in all hopes = of having an individual in place by the end of the month.
· We are continuing our search for an Administrator for Land Use Zoning Enforcement Officer. A meeting of the search committee = is scheduled for this Thursday at 6:30 p.m. and further discussion of the candidates.
· In a recent conversation with Connecticut O.S.H.A. it's my understand that their office is satisfied that the Town is compliant with our mediation efforts relating to their citations. In part the = agreement stipulates that we monitor indoor air quality and proceed with intervention methods that will eventually resolve the deteriorating condition of the Town Hall. Third quarter monitorin= g is scheduled for late October.

Mr. Rafey received a me= mo from Mr. Nardelli asking us to review 2 parcels of land for potential sale = in accordance with the ordinance. I did that, and I sent my comments to the Planning and Zoning Commission. They discussed it at length and ma= de no decisions on it, they told me to come back and inform the Town Manager that they should read the minutes of that meeting because it was such a large discussion. The Pin Shop Pond property is a landlocked piece and I have a map here, I don't know if anybo= dy (inaudible) everybody has seen it?

third piece that would be taken from that whole parcel, and the Commission
concurred that yes, it is a subdivision, we would have to come up with some
type of map showing the entire area and the amount of land being taken off =
to
go with the house, so that's where it is now. I spoke to Chuck Berger today and =
he
said he's working on it and that's the extent of it. &=
