            Mr. Mitchell Acting Chairman, Called the Public Hearing to Order at 7:36 p.m.

            Mr. Griffith, Acting Secretary, executed the Roll Call.

 

3.         Hearing of Cases=

 

        &= nbsp;   A.        Application #812 of New Cingular Wireless, PCS, LLC d/b/a Cingular requests for a 23 fo= ot height variance to permit the installation of a  panel antennas at 27 Main Street, Oakville, CT.

        &= nbsp;   Recess or Adjourn, the Public Hearing, must be Closed by January 18, 2006 unless applicant grants a time extension.

Mr. Mitchell: <= /b> I’m going to Recess the Public Hearing until January because there is no quorum.

 

Mr. Rafey:  I can’t give you a date without speaking to the members for their availability; if not we will hold it on the 4th<= /sup> Wednesday in January.

 

Unidentified Person:  I was reading the Zoning Enforceme= nt Officer’s memorandum and the State Statutes require that the Hearing = be Closed by January 18th and your next regular meeting is January = 25th.  I just want to give you consent un= til the end of January because I don’t know when your date is going to be.  If it’s later than = the 18th . . . .

 

Mr. Rafey:<= span style=3D'font-size:12.0pt;mso-bidi-font-size:10.0pt'>  We have a meeting scheduled for Ja= nuary 25th, that’s the next Regular meeting.  If enough board members are availa= ble we can have a special meeting before that date, but if you can give us a 35 day extension . . . .

 

Unidentified Person:  Yea, that’s what I want to d= o, is give you through the end of January so that the 25th works and we don’t have a problem.

 

Mr. Rafey:<= span style=3D'font-size:12.0pt;mso-bidi-font-size:10.0pt'>  We are not closing the public hear= ing, it’s not the opening of the public hearing.  The opening will start whenever we= hold the next meeting.  Then they h= ave 35 days to close it.  They didn&#= 8217;t open the public hearing tonight because there was no quorum so there is no = need for an extension from you.
