to apply under these regulations, and these regulations, specifically one of
the comments, we spent a good time talking about it, was that the caterer f=

the banquet hall could have no more than 2 events in any 24 hour period and=

discussed how to revise the regulation and that wasn&#8217;t a choice she

permit to construct a 9,600 square foot banquet hall and clubhouse.<span

-30 in
section 2325 has been superceded by section 235.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>And also in that case there was an
opportunity and I&#8217;ll provide you with the minutes, there was quite a =
bit
of discussion among the Planning and Zoning Commission members, because at =
that
time the zoning regulations for an R-30 provided (inaudible) for for proper=
ty
use and there was quite a discussion among the number of the members why
don&#8217;t you change your statement of use to include this so you could b=
e a
for profit.<span style=3D'mso-spacerun:yes'>&nbsp; </span>I don&#8217;t kno=
w if
some of the members there used to be a for profit swim club in Town out on
French Mountain Road, the white Birch Swim Club, and was one of the for pro=
fit
uses in a residential zone.<span style=3D'mso-spacerun:yes'>&nbsp; </span>A=
nother
example of a for profit was Crestbrook Park before when it was owned as a c=
ountry
club and for profit use, so at that time when you read the minutes, I&#8217=
;ll
provide them to you, as you know it&#8217;s a voluminous record, the club
decided not to pursue that under the for profit use.<o:p></o:p></span></p>

he
Z.E.O. was also asked by the club to sign an application for anew liquor
permit.<span style=3D'mso-spacerun:yes'>&nbsp; </span>On July 6, 1994 the
Commission voted to direct the Z.E.O. not to sign the application because t=
he
use was inconsistent with the special permit that was issued which was for a
membership club, mot a commercial venture, not a for profit membership club=
.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>The minutes of July 6, 1994 reflec=
t a
considerable amount of concern among Commission members that the Club&#8217=
;s
operations had become a commercial venture in a residential zone which was
beyond the scope of the use applied for and authorized in the 1990 special
permit.<o:p></o:p></span></p>

<p class=3DMsoNormal style=3D'margin-left:1.0in;text-align:justify'><span
style=3D'font-size:12.0pt;mso-bidi-font-size:10.0pt'><o:p>&nbsp;</o:p></spa=

 the
Club sought the ZEO&#8217;s execution of an application for a restaurant pe=
rmit
for a catering establishment, Mary Greene, which now I&#8217;m Barton, myse=

refused to sign the application and referred the issue to the Commission.<s=

style=3D'mso-spacerun:yes'>&nbsp; </span>The Commission denied the request =
for an
additional permit.<span style=3D'mso-spacerun:yes'>&nbsp; </span>Here again=
 the
Planning and Zoning Commission was concerned about a commercial operation at
the Club in light of the Club&#8217;s submission of an agreement with the
caterer which permitted the Club use of banquet facility for only 3 days per
year, the advertising to the public (inaudible) offerings.<o:p></o:p></span=

every right to operate a banquet facility pursuant to not for profit member=
ship
club, but in reviewing, no membership club is authorized to have a restaura=
nt
permit for a catering establishment who allows it to be a commercial ventur=
e in
a residential zone.<span style=3D'mso-spacerun:yes'>&nbsp; </span>So the Cl=
ub
currently has an application to sell liquor under the club permit but they
cannot hold a club permit and a restaurant permit for a catering establishm=
ent
at the same time. I will provide you with all this information; this is jus=
t a
brief overview and I apologize for not having copies, but it hasn&#8217;t
changed since the last time that I was here, and I&#8217;ll provide you with
the record.<span style=3D'mso-spacerun:yes'>&nbsp; </span>As you know
you&#8217;ve had it a couple of times (inaudible) minutes, but my decision =
not
to sign the liquor permit is based upon how it was approved, it was approve=
d as
a not for profit membership club, not as a commercial venture in a resident=
ial
zone.<span style=3D'mso-spacerun:yes'>&nbsp; </span>And the Planning and Zo=
ning
Commission, as I said, this started all back again, I think it was in the F=
all,
and then the Planning and Zoning Commission reviewed it, had the subcommitt=
ee
look at adopting these banquet hall regulations and they were adopted,
effective date wasn&#8217;t set, but the Grand Oak, not necessarily the
caterers, but the members of the Club were aware and actually attended some=
 of
these subcommittee meetings were aware of what the Commission was doing, and
actually had some input, so I don&#8217;t know if the caterer wasn&#8217;t
aware of it or not, but right now the regulations are there, the effective =
date
is not set, the caterer does not want to apply under those regulations, whi=
ch
you received in the packet, so based upon that, and I didn&#8217;t sign a
letter of refusal prior when we had the request in the Fall because the
Commission was working on this banquet hall regulation.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>I don&#8217;t know what else to sa=
y, so
my decision stands, I can&#8217;t sign it because it&#8217;s a violation of=
 how
the original permit was issued to the club.<span

Summer, there&#8217;s lots of kids, on bikes, walking in that area, and that
presents an additional danger to that community.<span

customers of the Club drunk, brawling, fighting on resident&#8217;s lawns,

the record, this is from residents coming to these meetings and explaining
what&#8217;s been happening, what their fears and concerns are, so it&#8217=

all in the Minutes of previous meetings.<span style=3D'mso-spacerun:yes'>&n=

</span>These are not just isolated incidents, these are continued occurrenc=
es
and in light of the situation it would be a grave error to allow the Grand =
Oak

</span>This Board&#8217;s first responsibility is to the safety and well be=
ing

we waiting for the neighbors or the children to be killed or maimed by drun=

driving in that area, or some of the things that have resulted from the

high priced lawyer comes along and makes it something else.<span

to operate as a club is already being violated and has been violated by the
fact that the activities that happened in that Club operate past sleeping h=

and in the Summer time keep us up. It&#8217;s pretty say, actually , when y=

live in a residential area and you hear somebody on a loudspeaker say
&#8220;f-ing this and f-ing that&#8221; and they&#8217;re having a grand old
time and I&#8217;m raising my children in this area, and I pleaded with the
town to stop them.<span style=3D'mso-spacerun:yes'>&nbsp; </span>I called t=
he
Police, they went down there and said we can ask them to tune it down, and =
they
turned it down, and then the Police left and they turned it right back u, a=

the Police would tell me, there is very little that w4e can do.<span

spot zoning, it&#8217;s one piece of property in the entire Watertown area

now, as Susan said before, it&#8217;s only a matter of time before somebody
leaves that facility intoxicated and hits a resident.<span

but you can&#8217;t have the wildlife operating as a business in a resident=
ial

and gentlemen of the Zoning Board of Appeals that if you take the time to r=
ead
the enormous quantity that has already been taken under advisement by the
Planning and Zoning Commission on the issue of the business that we have
running next door to our house, an d next door to the Vaichus&#8217; house =
and
next door to the Behran&#8217;s house, and next door to the Genova house and
next door to the Zdanovich&#8217;s property, etc., what you will find dug d=
eep,
deep deep in the pile of papers, certainly the previous Zoning
Enforcement&#8217;s Officer&#8217;s decision where she was found saying no =
to a
liquor license, you&#8217;re going to find also a very ably written finding,
recommendation, a study based on the permission of having the liquor licens=
e in
a residential zone that was done by Atty. Pilicy about 20 years ago, you wi=
ll
find that there are studies made by other attorneys over time, you will find
that there were suits brought by the Club against the Town of Watertown whi=
ch
have caused it a lot of money, an d each time the decision is gee, 23 words=
 in
the zoning regulations say you can&#8217;t have a business in a residential
zone in an R-30 residence area.<span style=3D'mso-spacerun:yes'>&nbsp;
</span>There&#8217;s no getting away from it.<span

ng
zone or the layover zone or the spot zoning if you will.<span

evening was to present the request for an application to be either denied o=
r accepted
for a liquor permit, but seeing that we have kind of gotten off track,
I&#8217;d just like to add my two cents if I may.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>Quickly, as the Chairperson for the
Chamber over the past 2 years, I&#8217;ve had a lot of opportunities to work
with the Economic Development Committee, with the Town Manager, with the To=
wn
Council, and with Planning and Zoning and from my perspective, I think that
this Town is really in dire need of retaining good businesses, and certainly
the Grand Oak Villa has been a good business to our community.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>I am vaguely familiar, only the la=
st 8
months, with some of the details of how all this has been transpiring over =
the
last several years.<span style=3D'mso-spacerun:yes'>&nbsp; </span>I know th=
at there
have been thousands of dollars and lots of attorneys and litigation involve=
d,
both from the Town&#8217;s perspective and the Grand Oak Villa, or the
Cercemaggiore Club and as a business representative I really am here to ask
that we please resolve this issue one way or another, once and for all,
expeditiously with no disrespect intended but this saga can just come to an
end.<span style=3D'mso-spacerun:yes'>&nbsp; </span>I certainly feel sorry f=
or the
people who have grave concerns about their children being hurt or maimed or
killed who live next to this Club, but I just can&#8217;t help but think of
facilities like the Aqua Turf in Southington, where I attend things there o=
n a
regular basis, that&#8217;s smack dab right in the middle of a residential =
zone
