property adjoining the YMCA Camp. I
have 10 acres over there. The=
whole
property was flagged for wetlands.
There are no wetlands on this property, but where the Y Camp is there
are wetlands. I’m assum=

that they’re close. Moo=

I had walked the property. On=
the
part that adjoins the Y Camp, this Farm is probably it dates back to 1825, =
all
the dump and all the materials from the last 150 years was dumped on this s=
ide,
junk cars, parts of old wagons, old pots and pans, trees growing right up
through them or whatever, and I was just cleaning it up, and some lady call=
ed,
I think it was Miss Humiston who lives on the other side of the pond said t=
hat
the pond is being polluted, but this is below the dam side, so there was no
encroachment on the pond per say and nothing was, it wasn’t going uph=
ill. But I was disturbing ground, not o=
n any
wetlands on this property, I didn’t flag the Y Camp’s
property. The Y was aware, th=
ey
were over the same day I was working, the lady called up and made a complai=
nt,
and here I am.

How much area were you disturbing w=

you were moving soil?

I’m not even, it’s an o=

road that went up through there, so to get to the cars to do whatever, I
removed the cars, I removed a lot of the debris, took out 3 truckloads of
garbage, old garbage, rusted stuff, whatsoever that was sitting in wetlands,
there are pictures taken of what’s left there, you know, small stuff,=
I
didn’t go on the Y part to clean up or whatever, but on my part, and I
just stopped and that was it.

neighbors who lives on the other side of Smith Pond that there was something
going on on this property. I =

there and talked to Mr. Stack, he already cleared this area to remove the g=
arbage. I noticed that there was some wetl=

on the Y property, that’s why I asked Mr. Stack to submit an applicat=
ion.
It’s like an after the fact situation.

This is probably like 20 or 25 feet from the edge of the wetlands, b=

The 50 foot buffer zone. After I went there and I noticed t=
hat
Mr. Stack already created that driveway there and there was nothing on the
sides, and I suggested he put some mulch on both sides to use wood chips to=
at
least stabilize both sides of the driveway from erosion. And here are some pictures of what=
Mr.
Stack did, so now it is kind of stabilized.
Mr. Undercuffler: What’s going to happen on this
property? Are you going to de=

it?
Mr. Stack: =
I’ve already taken it through
subdivision. It’s taken=
2
years to get approval for one lot.
The approvals were actually 8 months ago, still being signed off.
Mr. Undercuffler: Well I guess my question would be w=
as it
your intent that that was going to be a permanent driveway there?
Mr. Stack: =
No, that driveway was there, and yo=
u can
tell by the trees that line the side of the road there. There was a fence on one side and =
it was
an access way for tractors to come up and use it and whatever, and I can ge=
t an
affidavit from Tom and Arlene Traver, who’s parents worked the farm f=
or
almost 100 years. The propert=
y has
transferred only twice in 200 years or so, so the original owners grew up
there.
Mr. Undercuffler: So Moosa, what is that, a pre-exist=
ing,
non-conforming situation?
Mr. Rafey: =
No, this property is conforming.
Mr. Undercuffler: No, I’m talking about the dri=
veway.

The driveway, something happened th=
at I
wish Mr. Stack came before this happened to get a permit to do this, this is
like an after the fact situation.

thing out, he has in mind that he’s going to maybe develop it, maybe =

a house down there or something.

piece there is an existing house and actually recently Mr. Stack got a perm=
it. There was an existing foundation i=

location, and he got a permit to put a barn there. We already issued a zoning and bui=
lding
permit to put a barn there, that’s it for this property. There is no more construction here=
, no more
buildings.

way would be used anymore, then, is what you’re saying?

Along with the development I had to=
do a
master site plan for future development of this piece of property which is
costly and lengthy and the reason I split it off into 1 lot is to give the Y
another couple of years if they can come up with their funding to buy this
piece of property because they do want the property. It would be advantageous for me to
subdivide it all into 5 lots which I could have gotten, that met all the zo=
ning
and wetlands requirements, cause there are no wetlands on the property, but=
I
would like to see the Y also get it, that’s why I only took one lot o=
ff
of it at this time.

I have a map of the entire property=
here
if you want to see it.

This lot #1 that says 6.99 acres is=
for
all one lot?
Mr. Rafey: =
This was all one piece and Mr. Stack
wants to cut this as a second lot, and this will remain the way it is. And this is the existing driveway =
for
the house.

And what is the one lot?
Mr. Stack: =
On this 6.99 acres it’s actua=
lly
7.99 acres, 1 acre along the front of Smith Pond was given as a permanent
conservation easement to the Town to have no future development, and if I do
develop the property there are also 4 other cottages right on the property
which I would have to remove and take down. Now that would, if I sell it to th=
e Y,
the Y would like to keep the cottages, that’s why, it’s kind of=
a
long convoluted deal between myself and the Y and the Town acting as a, I w=
ant
to say as a mediator, we’ll say.

Right, it will be hayed and be
mowed. It was under farm perm=

the Town pulled the farm permit (inaudible) when I filed an application, bu=
t they
should have pulled it after a map was filed, a Mylar was filed, which has n=
ot
been filed today as far as I know.
It goes from one agency to the next, to the next . . . .

Yea, or live there myself with 8 ac=

No, it’s basically an old
road. You can tell it’s=

road from the tree growth on the side.

No, but I wanted to get rid of the
garbage.
Mr. Undercuffler: No. I understand that. But once you finish cleaning it al=

then that will just revert back to a part of the woods, so to speak?

Right. If in fact future development alon=

the master site plan wants to come there, that is shown as a driveway for an
interior lot down there also, so there’s a master plan if that ever g=

put into affect, if I ever go for a resubdivision of the property which I h=

Commission that that’s another activity. There is an existing well within t=

regulated area that Mr. Stack wants to fix, just do some masonry work around
it.

this point.

Mr. Smith: I̵= 7;m representing the Bureau of Water. Haestad Engineers were the designers for the repairs to the water transmission main. The City h= as an old 36 inch cast iron transmission main coming down from the water treatment plant going to the City of Waterbury. It comes down through Black Rock State Park, and where it crosses Purgatory Brook, which is almost at its confluence with Branch Brook, the stream channel has eroded exposing the top portion of this pipe. The City wants to protect the pipe, therefore we propose to encase it in concrete so there won’t be any m= ore erosion there or exposing the pipe to vandalism or any other damage. We expect to do this during mid to= late Summer when stream flows are at a minimum.= They will put some, divert the water around the area where we’= ll be working either by pumping of siphoning it, and then excavate under the p= ipe, pour concrete, and run about a 6 inch layer of concrete and have some wire = mesh reinforcing it over the pipe, and we tend to get stones in the top of that concrete so that it has the appearance of being a stone bottom and not just concrete. The rest of the are= a on both sides of the stream channel and downstream will be protected with some= rip rap. There’s a lot of s= tone there already, we’ll use that to the extent we can.

sediment and erosion control measures to make sure that once we get back up=
and
running in the Spring, everything is taken care of. And that really is true for all 3 =

sites. We have been pretty
conservative in maintaining their bonds for sediment and erosion control

would provide at Reflections is that their on site manager has left to work=

another company back in New Jersey, where he was from, but we did meet with=

new site manager and I did do a field inspection with both site managers as=
