what I’m trying to do, I’m not really sure how to tell you guys,
but if you’re looking at the drawing, #2 is existing on the house
already, it’s an attached garage, just a narrow garage that is more or
less used as a shed. Mr. Rafey: If you=
look
at your packet you have a little map like this that shows the wetland. Mr. Voghel: #2 is=
an
existing garage that is already attached to my house. I’m proposing to do an addit=
ion of
12 x 24 which is #1, and incorporate the garage into this addition so I end=
up
with a large family room. The
problem is I get too close to the wetlands. My house is already within the buf=
fer
zone; it wasn’t when I bought the property. Those 2 lots were listed as buildi=
ng
lots when I bought them, believe it or not, but the situation is I want to =
try
and add this on to get a bigger room out of my house. On the setback from the existing h=
ouse
is 41 feet to what they consider wetlands now. That’s the garage that was t=
aken
off of the house and 35 foot in another point. So basically if I took the 22 feet
they’re saying, I’m basically, I think what 14 feet and about 1=
2 or
13 feet from the wetlands. The
property is actually 5 or 6 feet above the wetlands as it is right now. I won’t be actually disturbi=
ng the
wetlands. Right now that̵=
7;s
part of my lawn, and where I’m adding on to it would have a foundation
but it’s not actually encroaching into the wetlands. Another thing with the sh=
ed, I
would get rid of my useless garage and build another shed towards the back =
of
my property and that also falls within 28 and 35 feet of the wetlands. The reason I’m proposing to =
put
the shed back there is I have a septic system and if I bring my shed too far
forward, I’m afraid if I ever have to do anything with the septic sys=
tem,
I’m not going to have room to actually do the septic system. I did look into other options as o=
pposed
to going, adding on #1, which is going up, which is very costly because I h=
ad
to change everything, all the bedrooms would have to be changed, I’d =
have
to change the whole first floor of the house, so it’s very costly and=
not
too effective. The other way,=
if I
want to the opposite end of the house and did an addition, and I would be
cutting off any access to my back yard basically, being able to drive down =
to
it for any reason. #3, which is, I don’=
;t think
that’s really too much of an issue.&=

That’s just turning a porch into a 3 season (inaudible). Mr. Undercuffler:

And I didn’t have a problem with that. That’s not a regulated activ=
ity
because the deck is existing, they want to put a second floor on top of the
existing deck. Mr. Undercuffler: So
this line that’s marked here is actually the wetlands and not the buf=
fer? Mr. Voghel:
That’s the wetlands.
What has happened, the stream actually comes in on Woodpark Drive, t=
he
stream actually comes under the road, almost right on the corner, but over =
the
course of the years it’s filled in with sand from the street. I mean if I went into my property =
and
dug, I could probably dig two feet deep and get street sand, so as it’=
;s
been slowly filling in, it’s been spreading the water out over the
property over the years, and between that and believe it or not in 88 or 89=
, I
lost a lot of trees and uproot and it changed the course of the water
somewhat. Where it is near the
shed, the brook actually goes underground for a good section of it, towards=
the
back of my property the brook disappears on the rocks, you don’t even=
see
it, and then it reappears in my neighbor’s yard. Mr. Undercuffler: Well
how does your septic system work then? Mr. Voghel=
: I’m sorry, I should have poi=
nted
that out. My leaching fields =
are
not where they’re shown on this drawing. I don’t’ know why they=
were
put there. My house originall=
y was
Lot #34, you could see there’s #33, #34, #35. My septic system is actually locat=
ed to
the left, and back on #3 where my deck is, so my whole septic system is on =
Lot
#34. What I did was I had bou=
ght
Lots #33 and #35 and just incorporated that into my property, that was abou=
t in
1990. That’s very
misleading. If that was the c=
ase
I’d be in the stream where the leaching fields are. Mr. Undercuffler: So what is Lot #33,
that’s an open lot of some kind? Mr. Voghel: Yea, that’s my
property. Mr. Polletta: You combined all of =
the
lots together? Mr. Rafey: They’re’ =
all
combined into one lot. Mr. Polletta: So they’re pro=
bably
more conforming, right? Mr. Voghel: They were listed as

the actual watercourse you say goes from kind of the corner there? Mr. Voghel=
: Yes, it comes from like the corner=

Woodpark and Kaye, it crosses the road there, it comes underneath,
there’s a small pipe, and it sort of runs, it follows the property li=
ne
along Ellen Kaye to a degree, but it spread out over the years and Lot #33 =
is
pretty much gone more or less where it wanted to, it just slowly fills in.<=

you known this was wetlands all along? Mr. Voghel: I nev=
er
dreamed that the wetlands were considered that close to my property. I mean I bought these lots. I didn’t pay a tremendous am=
ount
of money, but they were listed as building lots when I purchased them. Mr. Rafey: What h=
appens
is Mr. Voghel submitted an application for a Zoning Permit to put this addi=
tion
and also to build a shed, and I always go to the property to see where
it’s located, and I noticed that there were some wetlands on this sid=
e of
the property. I asked Mr. Vog=
hel if
he knew he had wetlands on his property and he said no. I told him unfortunately he would =
have
to hire a soil scientist to flag the wetlands. They did and they flagged the wetl=
ands
here. When I went back and
measured, I noticed that even the house was in the 50 foot buffer zone. Mr. Polletta: So
it’s non-conforming. Mr. Rafey: It is =
an
existing situation. All of th=
is
area on the side of the house that they want to put the addition is already
(inaudible) and graded. I thi=
nk the
only thing they may do is just remove some of the materials from there and =
put
the foundation for the addition. Mr. Zawadzki: You
already have a foundation there?’ Mr. Voghel: No. Mr. Rafey: No.

Mr. Voghel: It= 217;s not a foundation, it’s a floating pier type of foundation on the deck= so we’re not doing anything to the soil, we’re not digging into it= .
Mr. Rafey:= I had some concerns about the loca= tion of the septic system on this property, that’s why (inaudible).
Mr. Polletta: Yea= , but it’s existing.
Mr. Rafey: Yes, Mr. Voghel submitted an application to the Torrington Area Health District and they approved the location of the addit= ion and the shed. This was approv= ed, not the shed.
Mr. Undercuffler: Did they say they can’t put the shed there, Torrington Area Health Distri= ct or did they just . . . . .
Mr. Rafey: No, I = think there is a building code issue that you need some approval from the Building Department before the Torrington Area Health District approves this.
Mr. Undercuffler: Maybe they just said they don’t have any jurisdiction.
Mr. Rafey: No, I = talked to Mr. Smith and he said that you need some kind of permit from the Building Department before he gives you the okay for this.
Mr. Voghel: Yes, = he regretfully, my builder is not here. He was going to come with me today in case there were questions I didn’t have the answers to, but I was under the impression that Mr. S= mith had no problems with it, I thought. I thought it was more or less an issue with Wetlands because of the proximity to it.
Mr. Rafey: I thin= k he did approve the addition and also the other addition on top of the deck, bu= t he did not approve the shed. He = said that you should contact the Building Department for some changes that you h= ave to get from the State or something. I don’t know.

Mr. Rafey: I mean= the impact is not that significant of an impact because this area is (inaudible) already filled and graded for the house, when they built the house they alr= eady filled this area and graded it and all they have to do is just dig a hole t= here for this addition and put it next to the garage. They also want to have a walkway n= ext to this to get to the back of the property.&n= bsp; I think the addition is going to be 13 feet from the edge of the wetlands?
Mr. Voghel: Yes, I believe the f=

Mr. Polletta: There is no other pl=
ace to
put that in.
Mr. Voghel: Not realistically. I have a strai= ght Ranch. To go with another sto= ry would be very costly.
Mr. Polletta: You can’t put it behind. I = mean it’s an existing situation.
Mr. Voghel: I can’t go behind cause I’ll go onto my septic tank.
Mr. Rafey: They a= lso need a variance if they go to the side because it doesn’t meet the setback requirements.

I made a few suggestions, I didn’t see any soil erosion and sediment control measures. You need a silt fen= ce around that entire area before you dig.&nb= sp; If you want to do more grading you should show that on the plan. We want to know the limit of the disturbance, of how far you want to go toward the wetlands. If you can draw a line on the plan= and show me that before the next meeting.

Mr. Rafey: The on= ly big item that we added to this budget, I think, is because Mr. Berger is coming= to your meetings as staff, and he’s also reviewing other applications, w= hen Mr. Berger comes to your meetings, your budget should pay for those hours t= hat Mr. Berger is here, cause their department doesn’t have a budget for that. I think that’s on= e of the biggest items that we have in the budget this year. The others are . . .

Ms. Allen: It was= just an approximation because you don’t know exactly how much, for example= you don’t know if one meeting is going to be 4 hours or 6 hours.
Mr. Rafey: We go = by how many scheduled meetings we have, and then we take an average of how many ho= urs, and we came up with this number.
Mr. Zawadzki: I don’t see any problem with it. That’s what department heads are supposed to do.

Mr. Polletta: If = he works 4 hours a night, let’s say at the end of the year, 72 hours, I = mean overtime is not even $50.00 an hour. I think based on the meeting, I think this should be at least $4,000. Any individual today = makes $35.00 an hour at that level, and actually overtime, I don’t think th= is is enough money.
Mr. Rafey: All of= the meetings are not this long.
Mr. Polletta: I w= ould just make that at least $4,000 cause I don’t think you’re going= to have enough.
Mr. Berger: I get= paid straight time for the first 5 hours, and then I go into comp time after tha= t, so I think what we did is we assumed 4 or 5 hours per meeting, times 12 mon= ths, times my hourly rate.

Mr. Rafey: The st= aff meets with the developer and the contractor and their engineer on site every week, once a week. Me and Mr. Berger go to the site on Reflections at Echo Lake, the condominium project = on Icehouse Road, and because we had some problems with erosion and sedimentat= ion on that site, we want to make sure that all the measures are working and in place, and if any additional (inaudible) measures are needed . . . .

Mr. Polletta: They replanted, they seeded, what did they do up on top?
Mr. Rafey: I thin= k this time it is too late to seed, they just hayed. We told them to cover the area.
Mr. Berger: They = did do some seeding up there as well in early Winter.
Mr. Rafey: ItR= 17;s too cold for seeds to germinate now; we are looking for the Spring. But every week we go to the site a= nd walk the site with them and we tell them what to do, and we want to make su= re that the engineer from the developer agreed with our comments and that they prepare these reports each week, and then we go through the reports to make sure that what they say they did. Sometimes they say they are doing what we tell them to do, sometimes they get lazy, but overall I mean the site is under control the way it is n= ow, and . . . . .
Mr. Undercuffler: This first paragraph, little work has been done to address the concerns raised in the previous report. Doesn= 217;t sound very good.
Mr. Rafey: No, th= ey were working on something. Th= ey got an approval for two units, to build, I think they are working on that area,= and they are also working on a drainage system to divert the water from these 2 units (inaudible).
Mr. Polletta: Is = this place going to have a community house?
Mr. Rafey: No.
Mr. Berger: It= 217;s taking up more of our time than it should, much more of our time.
Mr. Rafey: They s= tarted working on this subdivision. = This is the first phase of Pond View Estates, Hidden Oaks, and they just started cutting trees, and recently they started to put in some silt fence there and (inaudible) we are hoping that they just follow the plan that they submitted and this Commission approved.
Mr. Zawadzki: That’s why we need a regulation to put some teeth into this ordinance so we can enforce it, right?
Mr. Thermer: That’s what we talked about last month.
