Duties Section
1 The
officers of the Commission shall consists of a
Chairperson, Vice Chairperson, and a Secretary. Section
2 The
Chairperson presides at all meetings and hearings of the Commission and sha=
ll
have the duties normally conferred by parliamentary usage on such
officers. The Chairperson sha=
ll
have the authority to appoint committees, certify expenditure of funds up to
$100.00 without prior approval of the Commission, call special meetings, and
generally perform other duties as may be prescribed by these By-Laws. Section
3 The
Chairperson shall be one of the Commission members and shall have the privi=
lege
of discussing all matters before the Commission and voting thereon. Section
4 The
Vice Chairperson shall act for the Chairperson I the absence of the Chairpe=
rson
and have the authority to perform the duties prescribed for that office. Section
5 The
Secretary, with staff assistance, shall keep the Minutes and records of the
Commission, shall prepare the Agenda and Regular and Special Meetings under=
the
direction of the Chairperson, shall provide notice of all meetings to
Commission members, shall arrange proper and legal notice of hearings, shall
attend to correspondence of the Commission, and shall perform other duties =
as
normally carried out by a Secretary.
The Secretary shall act for the Chairperson in the absence of the
Chairperson and Vice Chairperson and shall have the authority to perform the
duties prescribed for that office.

Yes. Mr. Tedesco revis=
ed the
plan and showed that there is an oil water separator to be installed upstre=
am
of the detention pond and they’re going to use grass pavers for the
driveways to the detention pond.
Here is a memo from Mr. Berger regarding this application, if you ju=

want to look at this. All of =

issues are just addressed.

the open space versus a fee? I
don’t see anything on this.
Mr. Zawadzki: Well we need to make a recommendat=
ion on
that and write a letter to Planning and Zoning recommending that they reque=
st a
fee in lieu of the 6/10 of an acre.
Is that correct?
Mr. Rafey:
Yes, the Planning and Zoning Commission will approve the open space,=
but
this Commission can make recommendations to the Planning and Zoning Commiss=
ion.
Mr. Zawadzki: Okay, so at this moment we can app=
rove
it with conditions.
Mr. Rafey:
Yes, you can put a condition, yes.
Mr. Polletta: I understand this oil separator th=
at
we’re doing, but who is going to maintain it?
Mr. Berger: The Town will after =
the
road acceptance.
Mr. Polletta: How often do you check or clean
these?’
Mr. Berger: I can’t answer
historically, other than to say in general the Town, as most towns, have not done a good job with that.
Mr. Polletta: I mean the Town is already busy wi=
th
everything. Do you need this =

separator if the detention pond, and from what I understand by reading this,
they’re going beyond what they’re supposed to use to keep it cl=
ean,
do you feel that the Town needs like another (inaudible) on their hands eve=

year to clean them?
Mr. Berger: The Town by the enac=
tment
of a recent State Permit will have to, will be required to clean all catch
basins and structures like this every year, and in the next 5 years we will
have to implement a program to do that, so it will have to be cleaned on a
regular basis and it’s installation is supported by the Town Planner =
and
Director of Public Works who is responsible for the cleaning.
Mr. Polletta: Do you think that we need it?

design to improve water quality.
D.O.T. guidelines would say that you don’t need it here. D.E.P. guidelines encourage the us=
e of,
what they refer to as in their draft manual a treatment train where you have
several measures that if one fails it rolls over=
to
the next one, and if that fails, several measures in a row. This project will have several mea=
sures
in a row. It will have deep s=
umps
and catch basins, it will have the oil water separator and it will have the
detention basin.
Mr. Polletta: Do you feel that when you use the =
storm
drain and the sump, it will be sufficient without this unit? I’m just thinking why the To=
wn has
to come up with an additional problem that every so many months they have to
come up and clean it. I mean =
if you
don’t really need the well we got to have it. I mean for maintenance it’s =
going
to cost the Town money.
Mr. Berger: Every new catch basi=
n in
Town is going to cost the Town money.
It can be treated like that and it will just be another . . . . .
Mr. Polletta: But the catch basins, you don̵=
7;t
clean them as often as one of these?
Mr. Berger: No, we’ll have=
to
clean them every year.

thing I mean here we are as land use commissions requiring these deep sumps, and detention basins and require these storm sc=

designed to catch the extra (inaudible).

and commissions for many years. I
never remember seeing these except maybe going into a lake. Do you remember ever using these b=

This is because it’s very close to Turkey =

quality.
Mr. Zawadzki: Well you mentioned yourself, Joe, that Turkey Brook is a very touchy thing here.
Mr. Polletta: I know, but because we have so many
catch basins and so many sumps underneath each catch basin, then I understa=

the detention pond is constructed better than code, I figured maybe why you
need something else to clean?
It’s just a question, but I don’t remember seeing these
before.

I reviewed this application last meeting I think the Commission was
ready to make a decision on this, but according to General Statutes you had=
to
wait 14 days, and the only thing I asked Mr. Voghel
to provide is a silt fence around this area that they’re going to dis=
turb
(inaudible) on this map, and also the limit of disturbance will be the same
where they put the silt fence. This
area is already graded, they’re just putti=
ng an
addition to the existing house.
Mr. Polletta: Do you feel comfortable with what you see on thi=
s?
Mr. Rafey:
Yes, I do.
Mr. Zawadzki: Did you take a look at this Chuck?
Mr. Berger: No, I have not looked =
at
this one.
Mr. Zawadzki: Well it’s pretty straightfor=
ward
to me. We discussed it the la=

time.

There are no drainage issues, there are no structures, nothing
involved. I didn’t want=

waste Mr. Berger’s time.

we’re doing though. This
parcel is actually vacant, there’s nothing there right now, but
there’s no road in front of the lot though.

paper street is, but we’re ultimately draining the storm water into t=

brook that’s shown in purple over here. The flows are very low, it’s
something like 2.5 cfs which is very low flows,
it’s not a big drainage area, but nonetheless we have to divert water
into this stream and this is really the only place. We have to catch it somewhere and =
this
is the easiest place to catch it.

I think this is the only place that they can discharge this because =

don’t own the land in the back.

at is a plan for repairing our existing septic system. We purchased the house in November=

we found has been vacant for almost 14 years, and it needs major surgery, a
good portion of which is to add to or modify the existing septic system.
Mr. Zawadzki: Well I guess the big question is wh=

options do you have, what are the alternatives?
Mr. Gaddis: That’s a good question. If you look further= down beyond my property in line with where the old system is, we’re going = down to a brook which runs through the cemetery so we can’t go in that direction. We can’t go = to the left of my house because the well is over there. My house is only about 40 feet fro= m the road so really I guess it only looks into that one locations perpendicular to the existing system, to the right of the house when you look at it, between the house and the garage. So they= did some soil testing and felt that was satisfactory in the proposed location.<= o:p>
Mr. Polletta: So basically you’re moving f=

one place to another?
Mr. Gaddis: Basically yes. We’re getting rid of the old
septic and putting a new one in.

I’m a little familiar with this property, if you remember in
October, 2003, I think it was Joe Barbieri the
previous owner of the property and they built this deck as you can see, wit=

a permit. After I went to ins=

this for a Zoning Permit I noticed that this was within the 50 foot buffer =
one, and he came to this Commission and got a permit f=
or the
deck. I walked this property =
a few
times because of the deck and as you can see there is a wall on this side of
the property. My first questi=
on was
why couldn’t they put the system on this side? But the well is on this side and t=
here
is a 75 foot radius requirement by health code that they cannot put the sep=
tic
system on this side of the house, and if you look at this little map here, =
on
the same page, it shows how small this lot is, it’s only 33,000 sq. f=
t.

is the
only place that they can put the septic system. I spoke to Bob Smith of the Torrin=
gton
Area Health District.
Mr. Polletta: They probably did this before Zoni=

Mr. Rafey: And Bob Smith already approved this
location for the septic system. And
actually the new system is farther away from the watercourse. The old system was 40 feet from the
watercourse and this is 50 feet.

with the developer to get temporary sediment traps properly installed out h=

which are not installed at this point, but they are making progress towards
that goal. All of the other
sediment erosion control measures are in.&=

They did, they were aggressive yesterday in taking some material off=
the
site without approval which was reported to us. We stopped them from doing that, a=
nd in
doing that they tracked a lot of material out on the road similar to what m=
ay
have happened down on
Mr. Polletta: As a board member, a lot of times =
you
just want to say remember when I asked you on Icehouse Road, when they had =
the
little pond, and then they go across the street with a pipe, and all this b=
rown
stuff was going into a lake and then you told me it was just discolored, it=
was
okay, so to me it was a big thing and come to find out it was nothing reall=
y.
Mr. Berger: Well I encourage
commissioners to call with concerns.
Mr. Polletta: A lot of times I ask questions and
it’s nothing.
Mr. Rafey:
The silt fence doesn’t filter the water 100%, it removes all t=
he
sediments, but the fines, there is no way you can stop the fines from going
into the wetlands. It slows d=
own
and takes care of all the courser materials.
Mr. Polletta: But I think at the beginning when =
you
start anything you’re not ready with the detention pond, the water was
going all over the place, they couldn’t co=
ntrol
it.
Mr. Rafey: One day we had a big problem there.=
Mr. Polletta: Well that was the day I was there.=
Mr. Rafey:
And that was the problem, that they stamped the whole area without
getting a permit. They did not
follow the construction sequence, that’s why we had that problem, but
since then I think we are controlling almost everything on that site, we kn=
ow
what’s going on every day.
