Mr. LeClerc: My property abuts the proposed Application #526 of P & A Enterprises for the construction of = the 3 lot residential subdivision in the Oakville section of Town. I’ve l= ived there for 18 years. I’v= e got some concerns about trying to stick 3 houses in a small area which abuts the wetlands area. We already hav= e many issues with the wetlands currently with all the silt and everything else running down to the, well it used to be a pond, now you can call it a glori= fied swamp, and adding 3 houses to this mix is not going to make it any better by any stretch of the imagination, so those are my big concerns and I’d = like to see what their proposal is laid out on maps and how they propose the 3 houses in that little spot.

Mr. Markey: My property also bord= ers that property and my property has a 20 foot right of way that comes down and borders that property all the way down to Stanley Avenue Extension, so when they look at that, part of it cannot be built on and I just want to make su= re that they realize there is a 20 foot pass way. We had walked it before so you kno= w that means they have to be even closer to the wetlands; just make sure that you = walk it and take a good look at it. You could tell our pass way cause it’s all cleaned up so you'll be able to notice it.

Mr. Rafey: I suggest that the Commission have a site walk to see the property.

Mr. Ranaudo: <= /b>This same property is = right behind my house. There certai= nly isn’t enough land back there for 3 homes, and it still puzzles me how= , I don’t know what Commission gave permission or oka= yed the fact that there’s enough room back there for 3 homes, I’m n= ot understanding that cause there isn’t enough room back there for 3 homes. Th= ere’s wetlands on one side, not to mention the fact that there’s a family of deer that I feed back there. There’s a lot of wildlife goi= ng on back there and as you know Wat= ertown is losing it all the time. I’ve been up there for 7 years now, and I think in my neighbor= hood they’ve built about a dozen houses.&= nbsp; There’s less and less woods all the time; a lot of kids coming into the neighborhood. That&#= 8217;s great, except for the fact that they’re cutting the education budget,= the classrooms are getting big. W= hen my daughter first started going to school in the Watertown public schools her classrooms were 22, 23 kids. = This year she’s got 30. I don’t know when it’s going to stop. We're just putting houses on top of houses, there’s no more land, there’s no more woods. It’s got to stop. These people are coming in and developing, they’re going back home, they’re not even living in= the area. They’re just goin= g back home. All it is is money, the= bottom line is money.

Mr. Undercuffler: Is this an approved subdivision?

Mr. Rafey: No, this is Applicati= on #526. They’ve got a var= iance to subdivide the land, there’s an existing house. Actually it’s a good idea to= have a public hearing on this later on so the public can come and speak.

Mr. Ranaudo: How do you get a var= iance?

Mr. Rafey: That’s not an = issue for this Commission, that’s the Zoning Board of appeals.

Mr. Ranaudo: So this is already d= one?

Mr. Rafey: They got the varianc= e for that, yes, but regarding the wetlands application, I think that this Commis= sion will have a site walk to see this property.

Mr. Ranaudo: <= /b>It won’t take lo= ng, cause it’s not very big.

Mr. Rafey: They may have a publ= ic hearing.

Mr. Kennedy: I own the property fr= om Sunnyside to Stanley Avenu= e. The guy that owned that property b= efore, this guy bought in, the simple reason he bought in was because he wanted a = lot of money to turn it over, but I know the property up there. When they started putting the pipe= s down Stanley Avenue they ran into a lot of ledge. Basically on the top of that area there’s a lot of ledge up in that area, and if you start drilling and what would that do with all the wa= ter that’s going to be going down into that pond like my neighbor was tal= king about?

Mr. Undercuffler: I don’t think = we can answer that at this point without looking at it.

Mr. Kennedy: But I know there̵= 7;s a lot of ledge in that area. Th= ank you.

Lois Joyce Markey, Oakville, CT 06779=

Ms. Markey: I own the land adjac= ent to the property that they want to build on.&n= bsp; I’m down below where they put the through the land there, down= at the bottom of the hill and I own up in back of the people’s houses. And I live on (inaudible) my garde= n is in the back there. My right o= f way runs down to Sunnyside Ave= nue, it’s a 20 foot right of way. I’d like to know how they could sell it and put this road thro= ugh there (inaudible) and build all these houses. I don’t think there’s = enough land up there.

Mr. Undercuffler: I don’t think w= e can answer that. That’s Pla= nning and Zoning. We’re respo= nsible for the wetlands so I don’t think we can answer your question.

Ms. Markey: I’ve been there= 40 years and my parents and grandparents owned it before me, and like I said, I don’t think it’s right that they can= build on it. What I brought was (inaudible). When I was young= er when they put up Porter & Chester and all that, that’s where my horses grazed. When I was a k= id where they put all these houses where these people live now, I played baseb= all when I was a kid, and now they’re trying to develop all this land. Where is the country going to? It’s being all taken from us= . We need to stop.=

Ms. Agate: When I lived there 20= years ago I was actually one of the people, well actually my sister and I put in = the road on Winthrop Street and we paid for the excavation of that road with our own money. Since that time when we did move i= n, we had to adhere to every law that they put forth regarding the wetlands, and = they were very strict, we have followed every rule and we have protected those wetlands. I own about ¾= ; of an acre for my home and of that I really don’t have the full usage of= it and I understand about the wetland rules so I am one who protects the wetla= nds and the wildlife that I have behind in my back yard. In the past couple of years becaus= e of some of the development in our area and the disturbances of land around me,= I have noticed a big difference in the brooks that run behind my land and the wetlands. I noticed a big disturbance, and when I think of them putting more property on an area that= if you took a site walk like you said you were, you wouldn't believe they could actually put 3 homes there. I= f that happens I could also see a further problem with the runoff of that elevation. It looks like from= just, where that area is, it is higher, and I can see the runoff coming down at t= his high slope, if you’ve ever seen the edge of these cliffs that are beh= ind there, and there is wetlands immediately abutting this area and it looks definitely within, I know there’s supposed to be a 50 foot buffer, fr= om what I understand, and I've always adhered to that. I cannot possibly see how 3 lots c= an go there and following this lot, so I am opposed to this idea.

Ms. LeClerc: Our property is direc= tly in front of this subdivision. If= you truly are the Conservation Commission and that’s what your chartered = with is conserving wetland areas, then you do need to know that that pond and the stream that comes through used to have an abundance of wildlife that is now over the years diminished, and it’s diminished as she stated by, I th= ink, an increase in housing in the area. The bullfrogs aren’t nearly there anymore. There used to be cranes that would= come in the Pin Shop would also fly into this pond, they have not been there in 2 years. The mallards used to c= ome and pair up and stay in the pond throughout the Fall and sometimes in the Spring we’d see them, aren’t there anymore= .

There’s been qui= te a huge change in just the wetlands area alone and in just recent months there’s been water and sewer put through on Stanley Avenue Extension which is our street, which is changed some of the wetland area only as they= put it through, to dig through it and we understand they’ll be putting th= at back, but all these small changes that happened in this area are just amazi= ng in the changes. We used to re= ally hear bullfrogs every single night from early Spring until late Fall and the number of them really diminished. (Inaudible) we don’t get nea= rly the number of (inaudible) anymore, I don’t know why that is, but all these things you can tell have changed in probably the past 6 to 8 years. We have seen an enormous amount of= deer now in the area, that never used to be because they’re really confined to a small area. They’re using the stream pro= bably for the water and there’s very little woods left for the foraging and= to put 3 houses in there, I realize it’s been subdivided, but I don̵= 7;t think it can handle 3. I real= ly encourage you to take that walk and look at this area closely.

Mr. LeClerc: I just have one more= thing to say, we didn’t really find out about this, was this supposed to be posted in the paper or were we supposed to get letters notifying property owners of meetings that . . . . .

Mr. Undercuffler: There is a notice in= the paper.

Mr. Rafey: If the Commission de= cides to hold a public hearing then I will send a notice to all the abutting prop= erty owners and I will suggest that this Commission hold a public hearing. This is not a public hearing tonig= ht, just the night that they accept the application. The Commission will see this appli= cation for the first time tonight, they haven’t h= ad a chance to review it. If you w= ant to hold on to your comments until there is a public hearing we will notify you= to come next month or whenever the Commission wants to hold a public hearing a= nd you can come and talk during the public hearing.

Mr. LeClerc: But if we weren’= ;t here, what’s the chance if no one showed up cause no one knew about i= t, aren’t you more likely to say well no one had any interest in it, let’s just pass it?

Mr. Undercuffler: No.

Mr. LeClerc: So everything that c= omes to you goes to public hearing?

Mr. Undercuffler: No, only if it’= ;s a significant item, which this appears to be, just on the surface.=

Mr. LeClerc: Well it’s significant to us. If no one = was here to voice any opposition, what would make it significant to you?

Mr. Undercuffler: Just from looking at = what we’ve seen so far, the fact that it is a wetland area, we would go ta= ke a look at it.

Mr. LeClerc: <= /b>I just want to make su= re we’re notified in the future.

Mr. Rafey: Only if there is a pub= lic hearing will we notify you. B= ut the Commission usually holds a public hearing if there is wetland activity on a property. This one is one of = them that they are proposing some activity within the wetland area.

Mr. LeClerc: So if you come and y= ou do your walk through you can still decide that there’s not going to be a public hearing?

Mr. Duplissie: If we decide that th= ere's no disturbance to the wetlands or the wetlands buffer, our Commission takes care of wetlands and wetlands buffers, if there’s an activity within that, we will hold a public hearing, but if this application has not wetlan= ds on it, no wetlands flagging, it’s not ours to say yes or no, that goe= s to Planning and Zoning. You could attend the Planning and Zoning meeting and they would probably have a public hearing.

Mr. LeClerc: Okay, so as long as there’s something that affects the wetlands, then there would be a pu= blic hearing if anything is affected in the wetlands?

Mr. Undercuffler: Yea, if there is significant activity. If it&#= 8217;s a very minor thing, which I don’t think this is, but in addition we c= ould call a public hearing, looking around at the number of people here that are interested, obviously there’s concern so more than likely we’ll call a public hearing.

We think that the site plan as it currently exists which is before me on the podium here addresses your conce= rns; basically you told us to move all activities out of the wetlands and the buffer. The only activity that we’re proposing at this point in the buffer is some grading. We think we’ve minimized the impact to the degree possible. We did receive a letter from Mr. Berger and Lou DiStefano from Bohler Engineer= ing is here this evening if you require further confirmation, but Bohler has ta= lked to Mr. Berger and has no problems with any of the 4 suggestions (inaudible) requirements and they can easily be incorporated into the plans so we ask t= hat you, if you act on the application, we might suggest that compliance with M= r. Berger’s letter be made a condition of approval and we wouldn’t have any problem with that. I= f you would like to hear from Mr. DiStefano from Bohler, I’d be happy to introduce him, but I’ll leave that up to you. I realize they'll have to go into = it a little when they do their construction, and again that’s what our set= back area is for, to try to keep them to a minimum out of our wetlands, and I th= ink they took more property than they were originally looking at in order to get this design in, and I like this.

        &= nbsp;   A.        Application #524 of Town of Watertown, Department of Public Works, for replacing an existing culvert and drainage = pipe near Eddy Street, Oakville, CT.

      &= nbsp;           &nbs= p;     If a Public Hearing is not held, then a decision is required by June 17, 2005.=

      &= nbsp;           &nbs= p;     Roy Cavanaugh, Public Works Director, Town of Watertown

      &= nbsp;           = ;      Mr. Cavanaugh: I’m submitting an application for a wetlands permit for a construction of a replacement drainage culvert through 5 back yards on Clyde Street between Eddy Street and French Street in Watertown. For those of you who may or may no= t be familiar with the area, it appears from the records and an examination (inaudible) maps of the area that some time in the late 50’s early 60’s there was a stream going through the back yards there which was filled in by a developer for the construction of a house on Clyde Street. As a result of= filling, a rather haphazard pipe installation at that time. During the course of many, many ye= ars there has been a lot of flooding that goes on in the back yards, the pipes (inaudible) deteriorated to the point where they're not functioning, they're open to the surface and they are in fact becoming a (inaudible) existing pi= pes right there.

      &= nbsp;           &nbs= p;     In 2003 the voters of the Town of Watertown approved a Public Works bond project and one of those projects was the construction of the Clyde = Street culvert replacement project. = The culvert is replacing a 36 inch pipe concerning the (inaudible) and drainage from the street and from the upland development, specifically P & A Heights off of Eddy Street, through the back yards connecting (inaudible) discharging into a (inaudible) ditch into across (inaudible). And that water that discharges to the existing culvert underneath the Water &am= p; Sewer Authority building on French Street and then into the culvert that goes und= er Swift School. (Inaudible) it’s simply to p= revent the (inaudible) and storm water from the upper area and on the street throu= gh the property without adversely impacting their quality of life.<= /span>

      &= nbsp;           &nbs= p;     Through this specific area there were wetlands identified by Cynthia Rabinowitz, the Soil Scientist, the downstream end and (inaudible) on the property adjacent= to the Water & Sewer Authority building was delineated by her (inaudible) = that property owner decided not to participate in this project, he did not want = his back yard piped and cleaned, he wanted the stream, he wanted the (inaudible= ), and he wanted to do (inaudible). He’s got a little bridge going over it and he wanted to keep it that way and we respected his wishes, therefore we are proposing a pipe bet= ween the other 5 properties, but with minimal impact to the downstream area what we’re proposing to do is discharge the pipe on a ¾ scour hole = to dissipate the energy and then allow it to safely convey through the last property before (inaudible) at the Water & Sewer Authority.<= /span>

      &= nbsp;           &nbs= p;     The other area, the upland area essentially the pipe he’s proposing to go through some back yards, the wetlands areas are flagged by the soil scienti= st is part of these people’s back yards.&n= bsp; The problem would be (inaudible) speculate that the swale is very (inaudible) over the years, but that’s just speculation on my part, so that’s the project in a nutshell.&nb= sp; I’d be happy to entertain any questions at this time.

Mr. Polletta: Is this the water that comes from t= hat new street they just put in off of Eddy Street? It’s to the right of that new street that they put in?

Mr. Cavanaugh: Yea, they picked up part of th= at storm drainage system that picks up the existing storm drainage on Eddy Street= and it picks up all of the existing water that’s coming out of that watershed and spreads it out for (inaudible) back yard over the years.

Mr. Polletta: Right, I mean I live around th= ere so I see there is water coming behind her house, then it goes down the street,= so you’re going to pipe this behind her house?

Mr. Cavanaugh: No, we’re picking it up = in the road. What we’re doing = is (inaudible) a pipe that goes along, facing her house and the road we have a pipe on the road which picks up, there’s a pipe going to the right of= her house which picks up some of her back yard. Mr. Cavanaugh: Right. And this project is now replacing = the pipe on the (inaudible) property, it’s sta= ying within Eddy Street. We're piping it across to a new ma= nhole and then we’re going down through the back yards (inaudible). We’re also disconnecting the existing pipe that’s gone through all these back = yards, essentially we’re going to be abandoning them in place. The Town at this point, relative t= o the start of the project, the Town does not own this pipes<= /span>. What we’ve done is we’= ve acquired an easement through everybody’s back yards for installation = and maintenance of this particular pump, and (inaudible) was put in early by a developer without proper sizing and we think that’s part of the problem. So we're disconnecti= ng that pipe and we’re redirecting all the water down to this good pipe. We (inaudible) keep wit= hin the right of way of course, but that’s the low spot of the whole syst= em (inaudible).

Mr. Polletta:= You have an easement behind these people’s properties?

Mr. Cavanaugh: Yea. Of the 5 properties, 4 easement sh= ave been obtained, and the 5^th one has indicated that they will be giving us an easement, but they have not yet done that. That is not one of the properties = that has wetlands on it.&n= bsp; All of the property owners that do have wetlands on this property ha= ve signed this application and they agree with this project.

Mr. Polletta: It definitely will improve that area.

Mr. Rafey: In my memo I mentioned that there = are 4 items that aren’t included in the application. Mr. Cavanaugh submitted this with a packet but I gave you a copy and he responded to all those comments and provided information which includes the sequence of construction and #3 is a typical construction detail attached to this, and estimated disturbance wit= hin the regulated area and the 50 foot buffer zone. These were not in the application = that was provided, now you have a copy of it.

The purpose of the project is to r= eplace an undersized culvert found underneath Beach Avenue with a larger culvert, we’re taking out a 32 inch draining pipe and installing a 36 inch pipe. We're proposing to connecting storm water discharge from the street to a manhole structure immediately down gradient of the pipe structure in Beach Avenue and we're looking at a place of discharging it to a (inaudible) outlet to a (inaudible) scour hole to dissipate the energy. This project again is funded throug= h a 2003 Public Works bond project (inaudible).

      &= nbsp;           &nbs= p;     There was also one of the two last pieces of the puzzle of the Mt. Fair Farms development. The Mt. Fair Far= ms developer back in the late 80’s, early 90’s put out a really go= od sum of money for (inaudible) improvements to (inaudible) and Beach Avenue. If you’re familiar with this particular area, Beach Ave= nue is widened out to a much greater (inaudible). There’s an unsafe drop-off (inaudible) that’s developed as part of this project will be widening= out the road to a 26 foot paved width and installing the pipe to accommodate this. All of the work will be= done with any existing channel and we’re proposing rip rap swales. Both of the adjacent property owne= rs have been contacted with respect to (inaudible) the property and both have (inaudible) with the project at this time the application for June 11^t=
h. Easements have not yet been obtain= ed from either of the property owners for the majority of work we do anticipat= e, we do hope to get the work done this construction season.=

The zoning in this area is R-12.5 which the minimum lot area is 12,5= 00 square feet with public utilities. This subdivision will be serviced by both public water and public se= wer and the beginning of the subdivision is actually a paper street, Winthrop Street. We’re proposing to improve t= hat street and extend it into our property in order to create a hammerhead style turnaround in order to service the 3 single family homes. The water service will come off of= Ripley Street to service the 3 homes, the sanitary service will g= o down a right of way down to Sta= nley Avenue where they just presently constructed a new sanitary line that runs out to = Sunnyside Avenue.

      &= nbsp;           &nbs= p;     As far as the wetlands are concerned, the wetlands are in orange on the map here. They're contained entir= ely within Lot #3. There is 0% wetlands on both Lots #1 and #2. I think there is 0.40 acres of wetlands on the site and they’re totally contained on Lot #3. The wetlands were flagged by David= Lord, Soil Scientist, and accurately depicted on our map.

      &= nbsp;           &nbs= p;     As far as the storm system goes for the proposed subdivision, we are proposing= a small detention pond on Lot #3, along with a drainage easement to the Town = for maintenance purposes as well as 3 catch basins in the proposed Winthrop Str= eet Extension that will convey the runoff into the pond and provides a zero increase in runoff through a controlled release rusher and then ultimately discharging just on the edge of the wetlands. We are not disturbing any wetlands soil. We do have, I think it = is about 3,900 square feet of regulated area disturbance in order to create the pond. I think that’s in= our application, I’m not sure if I actually have that number on the prints. Also the existing are= a of Ripley Street and Winthrop Street in this area makes a 90 degree turn and it's very flat right on that 90 degree turn. We are actually going to accept some of the storm water from this area right in here into our system= and these two catch basins will be at the low point in our road, so the end of = our turnaround will actually be a high point and it will drain to these two cat= ch basins which is the low point and then this area in here will drain south to the low point and then ultimately discharge into the detention area. Mr. Duplissie: Now the detention pond or rete= ntion whatever this proposed detention pond is within that 50 foot setback?

Mr. Meyers: Yes, but that’s the only reasonable place, that’s the lowest area in there, the most distance = away from the watercourse, there’s a little pocket that jets out in here f= orm the actual, there’s a watercourse that runs up through these properti= es in here so that was the most feasible place for the detention pond in order= to convey the runoff the furthest away from the watercourse.

Mr. Polletta: How big is Lot #3?

Mr. Meyers: It’s= 1.1 acres, 0.40 acres of wetlands. It think it’s 36.5% wetlands, but t= he zone here is R-12.5 so it’s probably 4 times the size. As far as the hammerhead turnaroun= d is concerned, we did a similar development to this last year on Eve Street wit= h 20 feet of pavement and a hammerhead turnaround in order to minimize wetland disturbance as well. Cause we= did look at putting in a full cul de sc, but that requires an island in the mid= dle of it as well as a certain radius of pavement and we would disturbed more a= rea.

Mr. Polletta: Curtain drains and gutters, yo= u said it led into where, right into the front (inaudible)?

Mr. Meyers: Lot #1, both footing and roof = drains go into the storm system, Lot #2 the roof drains go into the storm system, = the footing drains go into a galley system to the rear, and Lot #3 roof drains = go into the storm system, footing drains daylight to the rear.

Mr. Duplissie: Lot #2 is 32 linear feet of galley drains?

Mr. Meyers: The sheds are going to be removed. They did belong to t= he lot that was annexed off, the 3 family house that was annexed off that was accessed through Stanley Avenue.

Mr. Ciriello: I’m representing Mr. Gra= ziano for an 11 lot subdivision which is situated directly north (inaudible) on Claxton Avenue and Chestnu= t Grove Court. I assume you’re all familiar with that area. Claxton Avenue runs south/north to = a cul de sac here, Chestnut Grove as well. To orient you, Litchfield Road Route 63 is down in this area. To reach this area, you would come= up Judson and then take a left onto Claxton, that’s the general vicinity. If you're familiar = with our recent, our more previous application Willowbrook Farms Subdivision, is the old Warner Farm opposite West Road, on Route 63, Litchfield Road, where you have the= silo standing today. This property= abuts the Willowbrook Farms Subdivision directly to the east which we recently we= nt through together on Northf= ield Road. As a matter of fact, a portion of this application is Lot #5, other land of the applicant from that previous Willowbrook Farms Subdivision. That’s gen= erally this area here.

The property general= ly slopes down and away from = Claxton Avenue and Chestnut Grove Court sloping downwa= rd to the north and to the east, in this direction. The existing zoning in this area i= s R-30 and R-12.5; abutting zones are Watertown Fire District Zones R-10 and R-20. The property can be characterized as an open field. There are some narrow clusters of trees along the various property lines. What you see here are = two parcels, a piece from the former Christie Farm and a piece from the Warner Farm. That division line is in here. This application is for activity on approximately 20.6 acres. Those 11 lots range anywhere between .9 acres and 1.9 acres, general= ly 40,000 square feet and up. We= tlands were identified on the site, September of 2004, by a certified soil scienti= st from our office, William Root. With this proposal comes roughly 2,000 linear feet of paved roadway.

In preliminary meeti= ngs with the Town staff, we’re proposing somewhat of a low impact design in th= at it’s a narrow pavement, we're proposing 24 feet, very much in charact= er with the existing roadways, both Chestnut and Claxton. If this road were to be constructe= d we would abandon those former temporary cul de sacs in order to make the two connections. We are proposing= storm drainage on the roadway. The roadway departs both Claxton and Chestnut in a downward fashion, with a low point in this area. We are proposing storm drainage in the road, outletting to two detention ponds. The detention ponds discharging via (inaudible) section (inaudible) splash pad (inaudible) for the initial remo= val of sediment for a rip rap filter berm to a structured outlet with an overfl= ow V notch and galley type distribution of the overflow for a recharge in the area. There are 2 detention p= onds proposed for this project. On= e is right here in this area, you can see the grading for that, it basically tak= es the storm drainage from here and takes it into this pond. The second pond is in this area, a= nd the storm drainage from Chestnut Grove comes down to that pond and actually som= e of the storm water bucks grade and comes this way to that pond that divide in = here somewhere. The houses themsel= ves, the 11 houses shown will have (inaudible) type units in order to dissipate = the runoff from the rooftops and that’s something that we’ve done h= ere in Watertown. It seems to be a common practice t= hat works for us.

While it's a Panning= issue, we are offering open space in fee simple to the Town on this project. Under the Willowbrook Farms Subdiv= ision we had given open space to cover this portion, which is on that former Chri= stie parcel, however the amount of open space that we're offering in this scenar= io is about 5 acres, more than compensate both of these, Mr. Graziano’s parcels here. Along with this= each of those detention ponds will be located on open space to be given to the T= own in fee simple, and in addition if you follow that Willowbrook Farms Subdivi= sion, we’re proposing to build a walking trail originally on Northfield Roa= d, coming across Watertown Land Trust property, some 5 acres, cutting across t= he Willowbrook Farms Subdivision. And what is important about it here is to provide the links, Claxton, Chestnut, Wilson neighborhoods and the trail Mr. Graziano intends to construct this Spring is on this Z shed parcel here that you already own. That was given to the Town in fee = simple on the last project. We don&#= 8217;t show that piece (inaudible) but we do show the extensions and the community links, this here being a stub for the future, if Mr. Graziano does anymore = work on the piece to the north. He= does own another 80 some odd acres to the north up to Butternut and out to Route= 63.

With that we tested = all of these sites for septic systems and we’re working very closely with Bob Smith. I’m confident th= at we have a good design for each of these lots.= The communications are going well.&= nbsp; We have been monitoring groundwater out there since the time of those test bits. You have an (inaud= ible) control plan in front of you. I don’t know if you want me to get into that kind of detail tonight, but naturally we are proposing (inaudible) controls for construction purposes.<= /p>

I’d like to ju= st review quickly the regulated activities, which there are (inaudible) 3 activities, or at least activities on 3 lots. I’ll start by saying there a= re no direct wetland impacts. The i= mpacts I’m talking about is in the upland review area. Septic systems= being kept 75 feet from wetlands. We have no watercourses in close proximity to these 5 lots for the D= epartment of Health purposes, although Steele Brook is down gradient from this site, = as you may know.

The first Lot #5, I&= #8217;ll point it out in just a moment, we attempted to minimize grading by walking = to a walkout basement and in order to grade for the filling for that house and f= or the creation of a detention pond I pointed out and installing the level spreader, there are some 8,100 sq. ft. of impact in the upland review area, about 1.8 acres. Lot #5 roughly filling to the back corner, this orange line here is the upland review area, there is some filling to the back corner to support that house= and the back side of the berm is the detention basin is woodland activity for t= he upland review area.

The second is on the adjacent Lot #6, just to the south and t= he east, some 1,500 sq. ft. of wetland upland review area filling required for that one as well, and it’s also designed as a walkout basement, .03 a= cres, and that’s the northerly corner of this home here.

The last impacts are= on the proposed open space parcel abutting Chestnut Grove Court, roughly 5,750 sq. ft., .13 acres = of grading in the review area in order to create that detention basin. There is no home proposed on that particular lot. That would be= the open space parcel and basically it’s the creation of this detention basin here, filling to the outside of that berm does encroach within 50 feet of t= he wetlands system. There’= s an isolated pocket here kind of a perched pocket if you will behind these home= s at the end of Chestnut Grove, and this here being Wilson if you’re famil= iar with the neighborhoods.

Mr. Duplissie: Actually this came up= when we were on the golf course last year, they came up and they treated the two ponds, I think Hole #3 and Hole #7, and after they treated it there were bu= rn marks, there was nothing left, there was no vegetation left from the water = line for like 5 feet up, it was gone, everything was dead all the way around tho= se two little lakes, #3 and #7, and at the time I wasn’t on this Commiss= ion and I couldn’t understand how somebody could actually go in and put t= hose pesticides or whatever they put down and control the growth and kill everything, I’m surprised it didn’t kill whatever was in the wa= ter, but I don’t know enough about what they put down, that would kill the grass, everything was burnt right down to the ground so I don’t know = if that’s what this is, if that’s what they put down last year, and they’re putting it down again, but I question what . . . . .

Mr. Undercuffler: Well this is suppose= d to be a pesticide, not a herbicide.<= /p>

Mr. Rafey: This is to treat the water, not the . . . . .

Mr. Duplissie: I’ll bring you= 6 or 8 guys, we all talked about it.

Mr. Undercuffler: How did you notice it, as you were playing golf?

Mr. Duplissie:<= /b> Yes, and it was for a 4 or 5 week = period that it killed everything from the water line up.

Mr. Undercuffler: But were you there while they're d= oing the work in the lake?

Mr. Duplissie:<= /b> Somebody was there that had done something and I don’t know if we had seen somebody while we were play= ing golf, and then we noticed it a couple of weeks later and it lasted for 5 or= 6 weeks that there was nothing that grew within that 4 or 5 foot area.

Mr. Polletta: How do we know what chemicals they= used?

Mr. Rafey:<= span style=3D'font-size:12.0pt;mso-bidi-font-size:10.0pt'> I have a list of the chemicals tha= t they use on Page 3, if you see . . . .

Mr. Duplissie: I don’t know, I’m not saying that it was these people th= at actually put that down or if it was somebody from the actual golf course th= at had come by, and you know if you put too much fertilizer on your lawn, it b= urns everything and there’s nothing left.= Well that’s exactly what you had around both ponds. So whether it was these people who= did it, and I’m not saying it was, cause I don’t know, or somebody who does maintenance around the ponds who wor= ks for the golf course, but somebody did something and it was at both ponds.

Mr. Undercuffler: And what’s it b= een like since then?

Mr. Duplissie: It grew back. There’s growth around it, but= it was the first time, and I’ve been playing up there for 7 years that I ever noticed it.

Mr. Polletta: I’m assuming t= hat if it would be that bad, I don’t think they would use it. Who can we ask about this to make = sure?

Mr. Duplissie: I was looking in here = and one of the things it said it treats is the algae, it’s an algaecide w= hich would kill the growth in the water and they’re pouring this into the water, but I don’t remember if we had high rains that brought the lev= els up in those two little ponds, and it burned whenever it overflowed.

Mr. Beauchamp: They're actually treat= ing each one a little differently as far as chemicals they’re using and t= he amount.

Mr. Duplissie: And the larger lake have numbers of gallons.

Mr. Beauchamp: Well (inaudible) copper sulphate.

Mr. Duplissie: And I don’t kn= ow enough about these chemicals.

Mr. Rafey: The D.E.P. issues the= se permits every year, and in the past 7 or 8 years that I’ve been here = no one has complained about any problems with the surrounding area of these po= nds and lakes in Town. If you wan= t I can go and check this year.

Mr. Duplissie: I’ll be aware o= f it this year and if happens again I’ll take pictures of it.

Mr. Rafey: Give me a call so I = can go there.

Mr. Undercuffler: Would it be worth se= nding a notice to these people about what happened last year?

A.        Reflections at Echo <= st1:PlaceType w:st=3D"on">Lake

Mr. Berger: I performed, I guess I’ll call it our first Spring sedimentation erosion control inspection yesterday. I walke= d the site with the new Site Manager, his assistant, and the gentleman from the construction company, the company that's on and off during the field walk.<= span style=3D'mso-spacerun:yes'> In general the site looked extreme= ly stable. There are a number of issues that I raised with them. The first one being the paved section of the road at the very top of the hill n= eeds to be swept. He was going to = try and get that done either today or tomorrow. I did not confirm whether or not i= t got done before tonight but there was a lot of fine material on the paved secti= on that needs to be swept up. There w= ere a number of smaller sediment erosion control issues that I pointed out to him= , a couple of areas where the silt fence needs to be replaced, a couple of minor erosion areas, a couple of additional drainage structures that are probably going to be put in the place where they’ve had some water problems, at some of the tops of the steeper slopes up there and we’ll be working = with them and the original engineer for the site to design something that will collect the water at the top of the slope and get it safely down to the bot= tom and stop some of the ongoing erosions which is really occurring way into the site, it’s not adjacent to the wetlands but it is on-going unstable situation.

Mr. Undercuffler: Up at the top, more = (inaudible)?

Mr. Berger: Actually as you’= ;re going up, before you reach the top on that last corner to the left there is= a very steep bank where there’s a lot of plantings and you can see some= of the plantings have slid down the hill cause there’s the issue that’s happening up there. There’s a drainage ditch for= ming up there and they helped it out a little bit, but we need to formalize that. It can’t just be = left as a (inaudible), it’s got to be formalized, stabilized, planted, and seeded, and tied into the drainage system.

Mr. Undercuffler: Are they squared awa= y up on the top?

Mr. Berger: A lot of activity goin= g on up there. A lot of the site is under construction still.

Mr. Undercuffler: Yea, I saw that, but I’m wondering if the erosion and sedimentation, (inaudible) in place,= you don’t anticipate any problems?

Mr. Berger: I don't anticipate any problems. I think the main th= ing I wanted them to do, and they paved the first coat of pavement all the way up= to the top and a little bit beyond, they need to get that fine material swept = up off of there. I did tour the area. We did have a couple of significant rain storms this Spring and on one of them, there was that real fine stuff, once it gets into the drainage system it’s tough to get it out and there was a cloud of water, you can very clearly see it in Echo Lake. We went through all the systems checks and balances we have, we need to get that up off the road, a= nd I made that point as strong as I could yesterday to them and they said they’d take care of it.

Mr. Rafey: The other project tha= t is under construction is the 25 unit condominiums on <= st1:address w:st=3D"on">Buckingham Street. There’s a permit for 3 units= , and (inaudible) and the erosion and sediment (inaudible) and so far we don̵= 7;t have any problems there.

Mr. Duplissie: It’s a pretty l= evel site there, it’s not like on a hillside like Reflections where when we get a good strong rainstorm and it’s comin= g down (inaudible). It’s pretty level and they’ve got it taken care of. It looks like they’re workin= g in there. It’s hard to tel= l as you look at the site when you drive by, but they’ve got everything pi= led up nicely.

Mr. Rafey: The other project, Fox Crossing, Mr. Berger and I met the developer’s engineer and we walked= the entire property. They flagged= all the limits of clearing, before they cut any trees we had a meeting with them and told them not to cut any trees before we inspect the entire site. And the entire clearing lines on t= he property are flagged. We chec= ked every single flag to make sure that it matches our plan and we told them th= ey can start cutting trees. They’ll probably start cutting the trees by the end of this we= ek or next week. After they cut = the trees, and before they start the stumping, we’ll do another inspectio= n to make sure that all the silt fences are in place. We will update you.

Mr. Undercuffler: Did you get a chance= to look at that, off of Iceho= use Road?

Mr. Rafey: I went there, but the= gentleman wasn’t home. He kind of started working on that driveway. One of the trailers is actually parked on that new driveway, and one= is parked in the area that you saw before.

Mr. Undercuffler: Yea, the horse proper= ty.

Mr. Duplissie: I can’t be ther= e at 6:00 p.m. Willowbrook Farms is which one?

Mr. Rafey: It’s the (inaud= ible) on Northfield Road; the horse property.

Mr. Duplissie: We talked about that = in the past, there was a walking trail (inaudible).

Mr. Rafey: They want to discuss = some of the trail with the Commission, the location and (inaudible).<= /span>

Mr. Duplissie: Who wants to discuss= that with us?

Mr. Rafey: Ms. Barton and the developer’s engineer.
