&= nbsp; A. Continuation of Public Hearing from November 18, 2004, Application #505 of Guernseytown Farms, LLC for construction of Guernseytown Farms Estates Phase III, 10-lot residential subdivision located on Guernseytown Road and Killorin Road, Watertown.

&= nbsp; &nbs= p; Recess or Adjourn Public Hearing must be Closed by January 13, 2005.

&nbs= p; &= nbsp; Franklin Pilicy, Attorney Representing the Applicant=

&nb= sp;

&= nbsp; &nbs= p; Atty. Pilicy: This Public Hearing was contin= ued from the last public hearing session in order to provide an opportunity for= Mr. Berger to review some additional information and to seek some additional information. At this point we= have nothing else to offer. I woul= d ask the Commission to consider closing it and consider voting tonight and to ad= d a condition to any vote that if there are any comments or requirements of Mr. Berger as a result of his final review, that those would be considered conditions of the application and requirements for the applicant. The reason I ask for that is it wo= uld seem to me that all of the usual components of this application have (inaudible) and discussed and digested by the Commission and we should be f= ar enough along now where the Commission is satisfied that there will be no ad= verse impacts on wetlands and that the drainage plan is satisfactory. That plan was reviewed thoroughly = with respect to the Section 1 and Section 2 which have been already approved. This is only a relative small numb= er of lots and the wetland impacts are actually quite minor so we would ask the Commission again to consider closing the Hearing and acting on your regular agenda to approve this application, but we are mindful that Mr. Berger shou= ld have the final say when he does his final review so we would request that t= he Commission add a condition to the vote that any modifications or requiremen= ts of Mr. Berger during final review will be considered conditions and requirements of the applicant. Other than that Mr. Calabrese and I are here to try and answer any questions, but again this is a small number of lots essentially along Guernseytown Road, the major branch issues were resolved in the first two sections, and I believe there is only one real impact of any consequence he= re. &= nbsp; &nbs= p; Mr. Berger: Just to update the Commission from what’s transpired at the last meeting, as you recall the applicant provided a significant amount of information at the last public hearing tha= t we went over. He also had a meet= ing scheduled with the applicant (inaudible) Tuesday after our last meeting. We met and requested additional in= formation (inaudible) Mr. Sakonchick and I did receive a substantial portion of that = last Wednesday and Thursday. I hav= e not been in the office the beginning of this week so I have not had an opportun= ity to review it. I believe there= are some pieces that are still missing, but they have provided substantially wh= at I’ve asked for, I just haven’t had time to review it.

&nb= sp;

Mr. Zawadzki: Yea, the problem is = these things arrive on like this evening or the day of the meeting or (inaudible)= and you don’t have time to review them and so I’m a little leery of prematurely closing the Hearing, but actually you’re the key on that,= and you have to be satisfied that, and as Mr. Pilicy said, we could put that in= as a condition, but I don’t want for some hidden item that we haven̵= 7;t thought of. I agree this isn’t a real complicated item here.&= nbsp; It’s a few number of lots and also the minimum impact on the wetlands, but I think we still have to be sure we’re comfortable with= the information provided. Did you= get stuff today that you haven’t had a chance to look at?

Mr. Berger: I got stuff last Wedne= sday, Thursday and I was out on business Friday and Monday, Tuesday, and Wednesda= y I was not in the office so I have not had an opportunity to review the information. I (inaudible) ex= cuse but remember we did have last month’s meeting late because of Veteran’s Day so we had a very short turnaround time and I did not ge= t to complete my review.

Mr. Polletta: = How many (inaudible) d= o you have to review before you’re satisfied?

&nb= sp;

        &= nbsp;           &nbs= p;   Mr. Berger: I have to review all of the informa= tion that’s been submitted. = At last month’s hearing plus the information I requested at the subseque= nt meeting that I have received, and I believe there is still a piece missing = from that. But they are technical issues, drainage issues, some of (inaudible) the existing swale along Guernseytown Road which eventually discharges down to the wetlands, but aga= in I’m not sure what that impact may be at this point.=

Atty. Pilicy: = Anything that ERG is s= eeking with respect to that swale the applicant has stated previously and wetland,= the applicant is prepared to perform, it is a requirement. Again for the most part that swale= is already there, constructed by the Town several years ago.=

        &= nbsp;           &nbs= p;   Mr. Duplissie: If I remember correctly there are = some calculations as far as the storm and whether or not some of the culverts th= at were in place were large enough because you were switching from 15 inch to = 18 inch and back and forth. I= 217;m not sure if you really want to stipulate his stipulations, I mean as Mr. .B= erger said, if we vote on this, to close this, and Mr. Berger later says that wel= l he feels it should go to 18 inch, are you stating now that you’ll go to whatever he says?

        &= nbsp;           &nbs= p;   Atty. Pilicy: In the unlikely event that Mr. Berger added a requirement that the applicant thought was unreasonable, all that would mean is that we would have to come back here. But we are very confident that Mr. Berger, whatever he has asked for in the past, there has always been a reas= on for it and it’s always been reasonable, he’s always been able to justify it and the applicant has always agreed to do it.<= /p>

        &= nbsp;           &nbs= p;   Joseph Calabrese, Applicant

&nb= sp;

        &= nbsp;   Mr. Calabrese: Here is the swale that was don= e by the Town a few years back. We= had discussions with Chuck on it. There are a few areas where the rocks are going to be placed that will have to be adjusted, made a little deeper, and part of the problem with that is that t= he trucks that were operating on the, concrete trucks, put on the side of the = road and they push some of the dirt in and so we just have to redig where pushed= in, but basically the main swale is okay. There are maybe 2 or 3 places that would have to be (inaudible) told Chuck was at the farmhouse, there’s another place by the pole on the corner of my lot, an electricity goes by it has to be deep in the road, but basically the rest of the swale, except at some places where trucks have pu= shed in the dirt have to be adjusted. We’re willing to do that, and I stated to Chuck that I would do that. I also told him that th= ere is, we had discussions way back when we were doing Phase II before there is= an area that I would improve, add to make it a 24 foot road. In some places it was a foot and a= half, some places 6 inches, and it’s a 500 foot stretch that I agreed to do= and the other portion was done by the party across the street, so we had discussions on that and I think I satisfied Chuck on that, I hope I did, bu= t I mean if there are a few more areas we’ll certainly fix them. I’m not going to not do the = lots because of it. And the other = point I think for the wetlands is, I believe, and correct me if I’m wrong, = the swales in the road are really a Zoning problem, I don’t think it has = to do with wetlands. Am I wrong = on that?

        &= nbsp;           &nbs= p;   Mr. Zawadzki: Well we’re concerned with sto= rm water runoff and the overall general picture which includes swales.

&nb= sp;

        &= nbsp;           &nbs= p;   Mr. Calabrese: I understand that, but like I said,= I am willing to do what I have to adjust where my lots are, not some place else. But basically the swale= is deep enough in most areas so if that helps, I’d like to get that into= the record. And one other thing i= s I did talk to Jim Sakonchick and in fact I have a copy of it, we sent to Chuck that there is going to be no additional runoff from the swales, not the swa= les, from the runoff from the 9 lots. There will not be additional runoff. He gave me a copy of it and this i= s, and Chuck has copies, but he stated, he wrote a letter stating it does not have= any additional runoff after he did all the calculations, excluding the retention pond, he doesn’t (inaudible) that, we don’t even need that afte= r he did all his calculations and all the information, so we’re just asking that so we wouldn’t have to come to another meeting and send out all = the letters and all, that the option to refuse it or ask for whatever Chuck is requiring and I’m willing to do that. It’s really not a big deal either. There’s not tha= t many lots, only 9 lots, and 2 of them are on Killorin Road which don’t even affect Guernseytown Road.

        &= nbsp;   Mr. Zawadzki: These items 4 and 5, MoosaR= 17;s letter, Chuck, did you receive that information and some are available for review. Is that the part you haven’t been able to review yet?

&nb= sp;

        &= nbsp;           &nbs= p;   Mr. Berger: Correct. I think I’m not sure of this= , but I think I’ve only received half of Item #4 in Moosa’s memo.

&nb= sp;

Mr. Zawadzki: = Well that’s a ma= tter of record that that’s been requested and (inaudible) the only thing we have to worry about is stuff that we haven’t asked for.

  &nbs= p;            &= nbsp;        Mr. Rafey: I did mention that Mr. Berger is waiting for additional information. The only concern that I have is if= Mr. Berger receives all the information that he was waiting for you Close the Public Hearing with the condition that Mr. Berger reviews everything, but o= nce you close the Public Hearing the applicant cannot submit additional information, new information. That is something that you should keep in mind.

        &= nbsp;   = ;           Mr. Polletta: Let’s say= he needs more information, he cannot request that from the applicant?

        &= nbsp;   = ;           Mr. Berger: I have that infor= mation for the proposed conditions; I need to compare that to what exists out there now, what increase is the proposed development causing. I have the proposed conditions; I don’t have the existing conditions.

  &nbs= p;            &= nbsp;        Mr. Calabrese: I thought, from my information I thought that was part of the information.

        &= nbsp;           &nbs= p;   Mr. Berger: I don’t believe I receiv= ed that information. I talked to= Jim about that and . . . . .

        &= nbsp;   = ;           Mr. Calabrese: I think the important factor is what was necessary for the additional water coming off = for that?

  &nbs= p;            &= nbsp;        Mr. Berger: Here’s my concer= n, we don’t know what the existing conditions are in that swale, for what M= r. Sakonchick has tried to show to me that the proposed conditions with some modifications of swale is adequate. When you get down to the bottom of the hill, all that drains into a = 12 inch pipe which I don’t have any calculations to support either exist= ing or proposed conditions, will that carry the extra water, the water and the water.

        &= nbsp;   = ;           Mr. Berger: But if you are ca= using an increase in that swale from the subdivision down to an inadequate pipe, you’re going to have to provide detention in that swale so that you don’t cause any . . . .

        &= nbsp;   = ;           Mr. Calabrese: Okay, but part= of the information you have and you have that letter, cause I read it, there i= s no increase from that (inaudible) lots.

        &= nbsp;   = ;           Mr. Berger: That’s a different subject. That’= ;s looking at the entire subdivision; I’m looking at the, you can look at the picture and there’s also two separate drainage areas there, the drainage area that drains to the swale and the drainage area that drains to= the wetlands in the back of those properties.

        &= nbsp;   = ;           Mr. Calabrese: But there is no increase.

&nb= sp;

        &= nbsp;   = ;           Mr. Berger: There is an incre= ase in the swales.

        &= nbsp;           &nbs= p;   Mr. Berger: He hasn’t shown me, I don’t have the existing conditions in the swales. I’ve got the proposed condit= ions in the swales.

        &= nbsp;           &nbs= p;   Mr. Calabrese: Wait a minute, let me understa= nd, first of all the request was for what is the impact of the water, it’s zero impact and that’s what the requirement is for wetlands, zero imp= act water going into the trees and that’s what we have, we have zero impact. He did the calculatio= ns on that and a diagram at least how you what . . . . .

        &= nbsp;   = ;           Mr. Berger: The entire subdiv= ision that is true, now we’ve got to break it down to the different drainage areas . . . . .

        &= nbsp;           &nbs= p;   Mr. Calabrese: No, but I read the letter, the letter states for Phase III there is no additional water, we have zero impa= ct of water coming onto the street. That’s a fact. N= ow there are some problems in the street, it has nothing to do with the development I’m doing, that exists now, and that has existed and I’m correct that.

Mr. Berger: But in that small drai= nage area draining to the street where the swale is, we are adding impervious area. He’s not provided= an existing condition analysis to be compared to the proposed conditions analy= sis which I have. If there is an increase in an already inadequate system, you’re going to have to add= ress that.

        &= nbsp;   = ;           Mr. Calabrese: I’m sorr= y, I beg to differ. I saw the lett= er stating there is no additional, zero runoff from this project. We’re talking about 9 lots.<= span style=3D'mso-spacerun:yes'> 2 are on Killorin Road which has n= othing to do with this Guernseytown Road. We have 2 lots down the bottom of Guernseytown Road, which that driv= eway is going directly into the brook. There’s my daughter’s house, and then 1 lot after that, = is we only have one driveway coming in to that swale at that point. Then there’s my house. Then there are 2 lots after that, = which 90%, maybe 95% of that water all those lots, 85 to 90% of all the drains to= the back of the property, we are not going to the driveway. We have zero impact increase with = the 7 lots that we’re doing now, because one of those lots is the farmhouse which exists, there’s another driveway which exists, so you’re really only talking about 4 driveways entering (inaudible) calculations and= we have a requirement for wetlands that we have zero impact going into the sys= tem and that’s what we have. Now again there’s another question that you’re talking about in the road, I said what I’m not required to do it by law, but I said I was willing to do it, and I don’t feel I can do anymore than that. As far as doing something that whe= re the pipes were already put in by the Town, that’s not in the new lot area. We’re not going t= o be draining in from the (inaudible). It’s in front of an existing house. So from the lots that = we are developing, we will improve and there’s 500 feet of road which I revi= ewed with you that I will add to make the road 24 feet whereas some places it wi= ll be 6 inches, some 18 inches, and I’m not even required to do that but I’m willing to do that. Now were talking about again, we are meeting our requirement as zero impact that drains into the road or into the wetlands even. We provided that information.=

        &= nbsp;           &nbs= p;   Mr. Polletta: Can I suggest something? It seems to me that there’s = going to be not a disagreement, but I don’t think he’s had the chance= to review the proposal so maybe what we could do is take a few weeks and have a special meeting so the Town Engineer can review it because it seems to me t= hat you’re not happy cause you haven’t had a chance to review it. <= span style=3D'mso-spacerun:yes'> Am I correct?

Mr. Berger: I have not had a chanc= e to review it and I do not believe existing conditions analysis of the (inaudib= le).

        &= nbsp;   = ;           Mr. Polletta: Maybe within a = couple of weeks we can have a special meeting or something so if the engineer is n= ot happy or has not reviewed what he received, it’s tough for this Board= to vote on something that he’s not happy with.

        &= nbsp;           &nbs= p;   Mr. Rafey: Mr. Chairman, just to remind y= ou that you can continue the hearing until January 13^th which is the next meeting, you don’t need an extension for a special . . . . .

        &= nbsp;           &nbs= p;   Mr. Calabrese: I’m not in a hurry, it&#= 8217;s not a case of, it’s a case of all the cost and everything that goes i= n, for every (inaudible) to her. (Inaudible) letters, I have to get them back, I gave the committee e= xtra time just for this reason, and it’s not helping me at all, I didnR= 17;t gain anything.

        &= nbsp;   = ;           Mr. Polletta: Yes, Mr. Calabr= ese, however if we don’t have all the information in we depend on him to review it because we don’t know any calculations, so we depend on them and (inaudible) and the road can go the other way, however if he has a chan= ce to review it then maybe we could have a special meeting and everybody would= be happy.

        &= nbsp;           &nbs= p;   Mr. Calabrese: Well that’s your decision. I can’t make it. I’m just disappoint= ed because it just keeps going on and on and on, and every time we meet we give him all the information he asks, and then he asks for more information and = then I guarantee he’ll request more information, (inaudible), and I’m really getting fed up to tell you the truth. All I do is keep paying my enginee= rs for more information, more information, more information (inaudible) information that I’m not even legally bound to do in the street. I can refuse to do that if I want.= I’m not legally bound to do = that, especially that I don’t have zero impact on water, but sometimes I get upset. I mean it goes on and = on and on and we do give all the information that is requested.<= /p>

        &= nbsp;   = ;           Mr. Duplissie: Don’t get upset. Don’t get upset.= From what Chuck is saying some information that he’s asked for that he doesn’t believe he̵= 7;s received. Give him a chance to review it. Unfortunately if h= e says he doesn’t have the information and you ask us to vote tonight, then we’re not going to go against him, so give him the time to review it = and if there is something missing, he’ll review it tomorrow or the next d= ay and he’ll get it from your engineer and then we’ll have a posit= ive vote for you.

        &= nbsp;           &nbs= p;   Mr. Zawadzki: I just wanted to clarify one p= oint too, that the extension is helping you in the sense that by giving us the extension you have prevented us from having to disapprove the application b= ased on (inaudible) or main.

  &nbs= p;         Mr. Calabrese: I don’t have a (inaudible) extension, I’m not in a hurry to get these lots. I’ve got plenty of lots. That’s not my problem. The problem is cost. It just keeps requesting more information, more information, more information and it gets stale after awh= ile, and every time we come to a meeting I’ve got to pay him, the lawyer, = it’s getting expensive.

        &= nbsp;           &nbs= p;   Mr. Rafey: I think Mr. Berger, with Mr. Calabrese and Mr. Sakonchick, they should have a meeting in Mr. Berger̵= 7;s office and go through the list of what he’s waiting for, all he’= ;s expecting from Jim. This Comm= ission needs a memo from Chuck saying that he received all of the information, he = has no objection with this application. At the next meeting if we receive that memo, you don’t need to bring your engineer or Mr. Pilicy. You can just come and the Commission can Close the Public Hearing. But you should satisfy Mr. Berger = during this time.

        &= nbsp;   = ;           Mr. Zawadzki: I’d just = like to point out on Mr. Sakonchick’s reply to Mr. Berger’s original letter, on Page 15 of his fax, he has a handwritten note here that says in reference to this swale problem to be discussed with Town staff, so I guess that’s where we are.

Pilicy: I have no place else to go on = the second Thursday of every month, but I think part of Mr. Calabrese’s frustration is this seems to be boiling down to Guernseytown Road. From a legal perspective the Town = has no ability to require Mr. Calabrese to do anything on Guernseytown Road, but he has agreed to do that. (Inaud= ible) without questions, he’s going to make these (inaudible). Doesn’t want to be further d= elayed by something that he shouldn’t have to do anyway, but again I believe= you understand, and that’s fine. Thank you.
