&= nbsp; A. Continuation of the Public Hearing from October 13, 2005 - Application #531 of Nelson Ly= nn for construction of a 13-lot residential subdivision and 1,000 linear feet = of new roadway off Bunker Hill Road, Watertown, CT.

&nb= sp;

Ms. Jones: At our previous meeting we asked for an extensio= n of the Public Hearing because there were a couple of minor issues that we still needed to go over with the Town Engineer.&= nbsp; Since then we have the comments from Mr. Berger, we received a memo = from him dated November 4, and I also met with him to discuss the revisions that were made to the plans so that we could close up all of these issues and conclude the Public Hearing hopefully tonight. We also, if you’ve noticed, = the biggest change on the plans is the number of lots. We were denied in Planning and Zon= ing last month so we had to reduce the number of lots from 14 to 12. It doesn’t have any effect o= n the wetlands. Everything on the e= astern side of the road, the road, the drainage, and all the rock on the eastern s= ide of the road, the sedimentation basin, everything were unaffected. There was one lot on the western s= ide of the road that was eliminated. So I have some copies of a response latter, I’ll submit one to Mr. Berger = and one for the record and I’ll just go over some of those revisions quic= kly so that we can understand where the final plans have come to rest.

As I said I met with C= huck Monday to go over some of these revisions.= The revisions included adding some details. The Town plantings detail and simp= le things the high level overflow for the infiltrator, as a safety measure. We added some clarification on the existing outlet structure that goes under Bunker Hill Road. That structure consists of a swale= that leads from the existing farm pond to the 32 inch culvert under Bunker Hill Road, and the question was, was that when you go out and look at it, there = it appears to, well there is, a 15 inch pipe that is sort of just thrown in the swale, it doesn’t really serve any purpose and was kind of teetering = on a rock, in the swale, it’s not really touching the ground at either end= so we added some clarification on the existing out let structure and how that would be remedied and changed to good working order prior to construction w= hich would be remove the silt and sediment buildup from the 32 inch pipe which we had discussed previously and to remove that 15 inch CMP pipe which really isn’t doing anything.

We also added some win= gs to the silt fence for the 2002 Connecticut Erosion Control Guidelines. This is in areas where the silt fe= nce runs perpendicular to the contours, so that instead of getting somewhat of a wall that the water can run down and deposit silt you have perpendicular wi= ngs so that it will collect the soil every so often as the water runs down the = hill so you don’t end up with a big pile on the bottom.<= /p>

There were some discre= pancies in sedimentation basin profile elevations which we have resolved. It should be noted that the berm i= n the sediment basin is 1 foot higher in the area of the outlet than it is in the rest of the area to accommodate the 24 inch pipe because it is such a shall= ow pond, and that was discussed with Mr. Berger as well.

We also provided a sedimentation basin slightly, the Town subdivision regulations state that detention basins must have 3:1 side slopes and a 15 foot access way. This is not a detention basin and it’s much smaller than a detention basin, therefore we weren’t = able to get the 3:1 side slopes, and in order to not increase the earthwork in t= he regulated area, the cuts and fills and such, I slightly elongated and shift= ed the sedimentation basin slowly out of the regulated area so that we still a= re talking about the same amount of regulated activity.

I also provided a 10 f= oot access way around the northern side of the berm again. I spoke with Mr. Berger about this= and I’m making the statement, I guess, that this is a large detention basin. I mean you could get o= ut of your truck and you could walk across it and pick up stick out of if if you wanted to, it’s not a huge basin so we felt that the 15 foot access w= ay was a little bit overkill.

We also added a cross section of the emergency spillway as requested by Mr. Berger.

Another comment we had= dealt with the rip rap pads both in and out of the sediment basin and we actually revised the last section of pipe that goes from the roadway to the sediment basin so that it’s at a lower slope.= Because it’s at a lower slope the water travels through it slo= wer so we’ve slowed the water down and reduced our need from standard rip= rap which is huge, to modified rip rap because the velocity is now less than 8 = feet per second so that allows us to have less excavation for the rip rap pad itself. I also stated that th= e rip rap pad from the outlet of the sediment basin is not sized any differently = from that in the sediment basin because that basin is not defined as a detention pond, it won’t detain water, so the assumption was, the worst case scenario the flow in is equal to the flow out so we made them the same.

We also revised the construction sequence, we added some information about a preconstruction meeting that’s required, the submission of weekly erosion and sediment control reports. There is also discussion that the whole site should be temporarily seeded and stabilized before construction begins and I guess we could talk about when that should happen. To put it in the plan= s we said maybe upon approval, but considering it’s now November, we might want to wait until early Spring to seed that, but that’s up for discussion.

We also submitted calculations, at the last meeting I had stated that we had to resize the sediment basin, increase the size slightly. It’s stayed the same size as= that that we just submitted, the calculations that correspond to the 2004 Connecticut Storm Water Quality Manual that uses a different calculation th= at I had originally used to size that basin.

Here are a couple of d= etails that are more Planning issues, a detail of the guide rail needs to be modif= ied and details of the anchoring for the fire tanks, but those are all outside = of the regulated area and more Planning issues than small technical details th= at we can resolve.

The last thing that I = want to say is that the planting plan was revised slightly in the sediment basin= on the side towards the road by Environmental Planting Services today, because= I requested of them, some lower growth shrubs. I did a site line profile, this wa= s a requirement from Planning and Zoning to ensure adequate site distance, and although the road is well above where that sediment basin is, our request (inaudible) 9 feet or less because we essentially have 12 feet where your e= ye level is from where you’re sitting at the roadway to see over those shrubs, so we reduced some of those, substituted some shorter shrubs essentially that were still suitable.

And that pretty much s= ums up the revisions that we made and I spoke with Mr. Berger about this, he may h= ave some comments, but I think we resolved really all of the issues that were l= eft open from the last meeting, and I’d be happy to answer any questions.=

Mr. Polletta: <= /b> Did you receive from the Torrington Health District?

Ms. Jones: = No. I have received comments from Bob Smith, but not an approval.

Mr. Polletta: <= /b> That’s for your septic system= and wells right?

Ms. Jones: = Yes.

Mr. Undercuffler: Is it a little tight, these houses = here 7 and 10 between the house and the setback area?

Ms. Jones: = There are some areas where the hous= e is fairly close to the setback area. Keep in mind that the first dash line you see is the 75 foot Torring= ton Area Health District setback area that’s for septic systems and so it doesn’t get to the point where, where the yellow shading is, thatR= 17;s where the wetlands regulated area starts, so it’s 75 feet away from t= he wetlands and more than 25 feet outside of the regulated area.

Mr. Duplissie:<= /b> Is it still early enough to plant = Winter Rye, for stabilization? It= 217;s supposed to be beautiful all next week.

Mr. Rafey: You can throw some seeds.

Mr. Berger: And I do believe it would come up i= n the Spring, but without all the approvals, it’s hard to require the appli= cant to do that right now. I belie= ve they’ll be starting again in Planning and Zoning very soon, so it wil= l be another couple of months before, assuming they get approved here . . . . .<= o:p>

Mr. Duplissie: So it will be January.

Mr. Berger: And it’s been in this condition for years,= as a cornfield, so I’m leaning more towards requiring the seeding first thing in the Spring, before they start any construction.<= /p>

Mr. Duplissie: So if they seed in the Spring, when do they start construction? I mean if they = get approval, they can start construction in the Spring, right?

Ms. Jones: = Yes, my guess is probably I guess we’ll be submitting for the December meeting, then January, February, maybe by the time all the paperwork is in place April or May?

Mr. Duplissie: And then your client has every intention of star= ting right away?

Ms. Jones: = I believe so.

Ms. Jones: = Yes, the red shaded area. It’s kind of a wet meadow ty= pe of . . . .

Mr. Undercuffler: Are there conservation easements back there at a= ll?

Ms. Jones: = There aren’t right now, but I= mean certainly it’s something we can talk about, we can’t develop ba= ck there anyway so there’s no reason why we can’t put an easement,= but it hasn’t been required thus far so I haven’t put it on the pla= ns.

Mr. Undercuffler: My way of thinking, it would be good to have a c= onservation easement back there. Maybe ev= en that buffer area.

Ms. Jones: = The regulated area?

Mr. Undercuffler: Yea.

Ms. Jones: = The 50 foot regulated area?

Mr. Undercuffler: Yea.

Mr. Duplissie: And basically all of the open space is basically wetlands.

Ms. Jones: = Yes. The Planning and Zoning Commission has, well they were discussing wetlands, they wanted the open space or a fee in lieu of open space, so if = it isn’t open space, maybe it is a good idea to have an easement on the = back of those lots so that it’s always protected even if it isn’t op= en space.

Mr. Duplissie: Because you have it listed as open space, but basically there’s nothing you can do on it so . . . .

Ms. Jones: = Right, it would be passive walking recreation.

Mr. Polletta: And the access way that goes to the open space is part of the wetlands, right?

Ms. Jones: = Yes, it’s pedestrian access only. No grading, it’s = very flat in that area.

Mr. Duplissie: But it’s not wetlands though, Joe, it̵= 7;s green shaded.

Mr. Rafey: = It’s in the 50 foot buffer zo= ne.

Mr. Duplissie: So it’s not wetlands, that little pass way= ?

Ms. Jones: = Right.

Mr. Undercuffler: And then with the conservation easements there w= ould be placards put up to designate that.

Ms. Jones: = Right.

Mr. Polletta: By you moving these houses around, if you recall= at the last meeting, I was concerned about curtain drains around the foundatio= n, I mean you’re keeping it the same way, right?

Ms. Jones: = Actually it got a little easier too because there were a couple of lots, before that were on that western prope= rty line and now there’s only one interior lot so all the footing and cur= tain drains on that side, except for Lot #1 which goes into the wetlands, all tie into the storm drainage system and then on this side, on the eastern side of the road, they all go into the wetlands so they’re all now (inaudible= ) or going into a drainage area in better locations than they were even.

Mr. Polletta: And they piped in all the way to the road, is th= at what you’re saying?

Ms. Jones: = Yes.

Mr. Duplissie: So that’s 2, 3, 4, 5?

Ms. Jones: = 2, 3, 4, 5, yes.<= /p>

Mr. Duplissie: And 6 goes into . . . .

Ms. Jones: = The wetlands.

Mr. Duplissie: And 1 also goes into the wetlands?

Ms. Jones: = Yes.

Mr. Undercuffler: Do you have any comments, Moosa?

Mr. Rafey: Well the conservation easement area should be pu= t on all the wetlands and 50 foot setback area, that will protect the future disturbance of the wetlands, and probably they will see where the limits ar= e.

Mr. Undercuffler: Particularly with the houses as close as they ar= e.

Mr. Duplissie: There’s an awful lot of wetlands, not just= in that open space area, but Lots 7, 8, 9, 10, all of that area should be considered conservation, shouldn’t it?

Mr. Rafey: = I think that area is off limits bec= ause it is wetlands and regulated by this Commission. It’s better to put a conserv= ation easement and put the placards up.

Ms. Jones: = Right.

Mr. Duplissie: Well by doing that for future there is no disturbance cause you have to go in and remove plants in order to excavate = or do something like that.

Ms. Jones: = (Inaudible) the layout or the use o= f the lot it makes it clear so you don’t have people coming back.

Mr. Duplissie: It makes delineation, yes.

Mr. Rafey: It provides another layer of protection for the wetlands.

Ms. Sturgis: Can you do the same thing with 1?

Ms. Jones: = The wetlands on 1, it’s kind = of interesting, if you walk in there you can see there’s grass instead o= f cornfield, but it’s not the same type or productivity than the wetlands of the r= ear, and since it’s kind of a little pocket it would be a little more difficult because it goes between the house and the road.=

Mr. Undercuffler: Any other comments?

Mr. Polletta: Right where the road comes down, in the Winter t= ime I see a lot of water crossing the road, is that pipe going across (inaudibl= e) all the runoff off that pond, whatever crosses the road?<= /p>

Mr. Berger: The pipe under Bunker Hill Road?

Mr. Polletta: Yea, the size of that pipe is sufficient?

Mr. Berger: Yes, after it’s cleaned out i= t is sufficient, which is now on the plans of the applicant.

Mr. Polletta: My question is where will all that water be put?=

Ms. Jones: = It’s a 32 inch pipe but when = we went out and looked at it it was filled except for 19 inches with silt. So it’s not functioning as it should and I did do the calculations for up to a 100 year storm and it came past that safely, if it’s in working condition, which we’re preparing to do before any construction starts, so that it’s all functioning before we start construction.

Mr. Polletta: So it’s plugged up now?<= /p>

Ms. Jones: = It’s plugged up.

Mr. Duplissie: I don’t know if you talked to the Town but= I know they’ve been out there 2 or 3 past Winters where they had ice fl= ows across that section of the road, that they were actually out there with the trucks plowing and trying to get the, there was basically sludge, slush and= ice that was built up there, they had been there 2 or 3 years taking care of th= at, so when this pipe is cleaned out it will be adequate now? It seems like it’s just a bottleneck there, it just pulls everything and that one low point in the ro= ad always has a flow.

Mr. Berger: I would talk to the Highway Departm= ent to know exactly where the ice flow is occurring that you’re speaking of,= I don’t know that it’s all related to the pipe in the road, based= on what I hear you and Mr. Polletta saying.&n= bsp; It could be that there are some issues with the swale alongside the = road that may need to be cleaned out to be more effective to get the water down = along that side of Bunker Hill.

Mr. Duplissie: It has been a problem. I just want to make sure, I don= 217;t know if we’re actually adding or not. The calculations say we’re n= ot adding any extra.

Mr. Berger: I don’t think we’re add= ing any extra based on the calculations, and when we get the grass growing and = get everything in place, and I’m looking at the plans here tonight and I’m wondering if some of that ice flow isn’t related to the wetlands on Lot #1. It’s flowing in that general direction.

Mr. Duplissie: But it’s coming from just below the farmho= use so that, right in the crook in the road, (inaudible).

Mr. Berger: It’s probably not a good one.=

Mr. Duplissie: I’m hoping that when they clean out the pi= pe that will stop that. Especial= ly now with traffic trying to pull out on that corner. I just want to avoid an accident, that’s all.

Mr. Berger: Well we’ll certainly watch th= at and assuming it goes forward that during construction, if modification is neede= d to the swale out front, we can accommodate that.

Mr. Duplissie: At least somebody is watching for it, at least you’ll take note anyway.

Mr. Berger: And there is a little note at the b= ottom of the signature, on sheet 2 of 13, additional improvements and/or modifications can be requested as field conditions warrant. See where all the signatures are?<= o:p>

Mr. Duplissie: I only see the stamp . . . . . I see it.

Mr. Berger: That bottom note there, that catch = all, should we find something that is not being addressed during construction, we can step in and ask for it at that point.

Mr. Rafey: And that statement is one of your standard conditions for approval.

Mr. Duplissie: I’m just worried that if they need an additional pipe there, for that crossing, will that get done or can you actually demand another pipe?

Mr. Berger: Yes, we can.

Ms. Jones: And I think the issue may be more an improvement cause the roadside swale comes down and meets up so it would be flow from t= he outlet of the pond before they go into the pipe so it might be more of a redirecting of that swale, if it’s maybe not pointing in the right direction.

Mr. Duplissie: It may be hitting the berm on the side of the po= nd and not being allowed to flow into the pond and it’s coming across the road. I’m not sure that it’s the pipe itself.

Ms. Jones: = Yea, I’m not sure either, I haven’t been out there during one of those events.<= /p>

Mr. Undercuffler: Chuck, have you seen that response there that she gave you tonight beforehand?

Mr. Berger: I did not see that response before,= but as she said we did meet on Monday and we reviewed all of the points in my memo. I was left with, I guess I’ll say a preview of these plans which substantially addressed all o= f my comments. There were a couple= of other minor issues and we spoke of tonight that I believe are on these plan= s, the standard tree planting detail, things of that nature that I provided to= her at the Monday meeting so I’m comfortable with . . . . .

Mr. Undercuffler: Cause we’re getting close to the limit on closing this and if we were to close it tonight . . . . .=

Mr. Berger: I believe there may be minor techni= cal details but there is nothing major outstanding from my perspective.

Mr. Undercuffler: Anybody else?&n= bsp; Okay. Anybody from the public have any comments or questions?&nbs= p; I guess not.

Mr. Rafey: = Emily, just for the record, are you= going to submit a revised planting plan for the . . . . .

Ms. Jones: = It’s on there. It’s already incorporated in= to the plans.

Mr. Duplissie: I think as long as we get those conservation easements put in I think as long as they’re going to address this possible situation with this ice flow problem, it’s fine.<= /span>

Mr. Polletta: <= /b> How important is the Torrington Are= a Health District? It should be okay, = right?

Ms. Jones: = Yea, I mean we have to get approval before we can get final approval anyway and I have incorporated a lot of Bob Smith’s comments into here anyway, but just the meshing of the time schedules, we haven’t met to go over all of those, but we do need his approval.
