3.&nb= sp;        Discussion and Information Sharing regarding the 3 School Project Moratorium

        &= nbsp;   Mr. LoFrese: Thank you to eve= ryone for being able to make it here on short notice tonight. This meeting is meant to share information in regards to the moratorium that was placed on the 3 school project on last Tuesday evening. Immediately following the meeting there were numerous questions that started to surface= in regards to what exactly this meant, what the impact is on the school projec= ts, the scheduling, the phasing, and the like.= This information is meant to kind of update both the Public Buildings Committee, the people who are here this evening, and the Board of Education= in regards to exactly what we believe the impact is on the school projects. We have representatives from Kaest= le Boos with us this evening as well as O & G, the construction manager, w= ho can comment further if there are questions in regards to how this impacts t= he project phasing and the schedules.

&= nbsp;           I&= #8217;ve prepared a handout this evening that’s broken into several sections a= nd I’ll just briefly go through these sections to describe what is conta= ined in each of them and then at the end if there are questions, or during the process if there are questions, feel free to fire away.

&= nbsp;           Fi= rst of all we have some school start up issues and what I’m referencing is being able to be prepared to open school in August. The first question that has come u= p is the location of Judson School. Most recently the Board of Educati= on voted to move Judson School to Heminway Park for next year.= With the moratorium all expenditure= s have been put on hold, and that was confirmed by our legal counsel, so the physi= cal move by the moving company to move Judson School to Heminway = has not occurred and it is currently on hold awaiting further information. Bus routes for the 2008/2009 schoo= l year are also under review and we’re having to make dual bus routes at the current moment to try to plan for either Judson<= /st1:PlaceName> School or Heminway School for grades 3 through 5. Those routes are impacted, obviously the school location question that we have at= the current moment. Parents are concerned because of daycare arrangements.= Some parents, depending on where the school is located. have differe= nt daycare needs based on the bus routes, after school care. whether the stude= nt would be dropped off at a caregiver or whether they would be dropped off at= a daycare center.

&= nbsp;           Cl= eaning of the building – we are moving forward basically cleaning all facilities, Heminway, Judson, Watertown High School as if all of the buildi= ngs are going to be occupied, so our district resources have been, I guess, reallocated or reinstructed to clean the buildings throughout the school system.

&= nbsp;           Wi= th this, though, we have uncertainties about where temporary moves are going to be. We had plans in place to = have satellite nurses offices, move the guidance office to allow for asbestos abatement to occur at Watertown High School, food services, the department = was being moved out of Watertown High School to another location to make accommodations for special education needs here at Water town High School, = all of those moves have been put on hold and we’re awaiting further instruction on that.

&= nbsp;           The Watertown High School schedule is being impacted because as you know a significant amount of asbestos abatement was scheduled to occur here this Summer and the rooms were being planned to be off line and not in use, and obviously if we could use the rooms, or use the library or use the guidance offices or the world language labs we’d like to know that answer so M= r. Geary can properly schedule the building.

&= nbsp;           And these are what we’ve come up with for school start up issues to date. I’m sure there= 217;s more as the principals get further into the Summer and start to go through = some of the routines and start up material for August.

&= nbsp;           Pr= oject Phasing Issues at Waterto= wn High school, a significant amount of asbestos abatement was scheduled to occur which would allow for renovation in the areas of the building to be renovated in Phase I and then also for the new addition. Steam pipes in the tunnels needed to be abated, exterior window wall= s in all likelihood have asbestos caulking needed to be removed to allow us to remove, to allow us to begin the construction of the addition in the front = of the building, so not only is the renovation portion affected by the asbestos abatement hold, but the addition area as well.

&= nbsp;           Ot= her Items for Watertown High School, there needed to be a temporary access driv= eway installed and additional parking to allow for the construction to occur in = the front of the building and all of that needed to be installed prior to the beginning of school opening so we could make accommodations for busses, students, parent drop offs, and allow traffic to enter and exit the site. There is a water main that runs ri= ght across the front of the parking lot where the new addition was to be instal= led, that’s a significant amount of work. That delay really drives the rest o= f the project and delaying that into possibly later Fall or Winter months could a= dd costs to the project. Schedul= ing delays as far as pavement, masonry, concrete work, Winter construction cost= s, we’re concerned that those delays could add costs to the project.

&= nbsp;           Mo= ving on to Judson School, there’s less of an impact there because we were planning on vacating the school entirely,,,, however again similar type of delays with Winter construction work, a large portion of Judson with the addition and site work that’s planned to occur starting on July 7th and delaying that for 60 days plus obviously could affect that schedule and move Winter cause Winter construction work. The project was slated to be a 12 = month project once we vacated the building entirely and delaying this could creat= e a situation where Judson School would not be= ready for the start of the 2009/2010 school year.

&= nbsp;           Th= is then has a ripple affect at Polk Elementary School.<= span style=3D'mso-spacerun:yes'> Although the Board of Education ha= d not determined this as of yet, some people have been having discussions, there = were discussion that once Judson was done then we could basically repeat the con= cept and move Polk into Heminway Park and obviously a delay at Judson School cou= ld create a situation where we would either have to look at a September or an October move or not move those students at all that year.

&= nbsp;           Mo= ving on to project costs, expenditures to date, and I apologize there’s an= error on this, Watertown High School and Polk Elementary School need to be flipped. We have spent nearly= $4,000,000 to date on the projects and with that $4,000,000, that encompasses consulta= nts, the architect, the design work, some funding to O & G, consultants such= as the traffic engineer, the geotechnical engineers, survey work, and that encompasses $4,000,000 to date. There is also an additional $2,000,000 that still remains encumbered and obviously we’ve been doing work up until this point and invoices continue to co= me into the office and we are required to pay those funds.

&= nbsp;           Fl= ipping over to the second sheet, discussions with both Kaestle Boos and O & G I asked the question what does the delay mean for construction costs and I as= ked them to give me an average percentage if construction is delayed a year, and their answers varied and in each case they basically said there’s a l= ot of uncertainty right now with global economy, the fuel oil situation, gasol= ine, electric rates, all of these things obviously are of great concern. In any case they said that’s= it reasonable to expect a 7% to 10% increase in construction costs on an annualized basis. If you look at an 8% i= ncrease, the increase at Watertown= High School would be $3,800,000 per year, the increase at Judson would be $1,100,000 per year, a= nd Polk would be an increase of about $850,000 per year.

&= nbsp;           So= me other points that are important to mention and consider, with the school projects we were not planning on replacing the roofs at Watertown High School or Judson Elementary S= chool. Those roofs were replaced in 2001,= so they are currently 7 years old, however we had to pursue an extended warran= ty and we’re concerned that if the projects are delayed, that the roofin= g manufacturer may no longer be able to offer us an extended warranty which is required to meet the State’s requirement of a 20 year life expectancy.

&= nbsp;           I&= #8217;ve heard comments both out in the public, I’ve read in the paper, what a= bout the concept of reducing the scope of the projects. This obviously will require additi= onal architectural fees, the architectural design process took over a year. We started in earnest on June 6th last year and there are still some details outstanding with Planning and Zo= ning that we were hoping to wrap up shortly, but a redesign to reduce the scope would be a significant redesign and it would take a significant amount of time. We would then have to r= evisit the State Department for approval of that redesign as well as our local Planning and Zoning Department. In all likelihood, and my personal belief is that if that avenue was pursued, depending on the scope of the redesign, we could basically be looking at a = similar project cost a year or so from now, but substantially less in what you actu= ally get for the money.

&= nbsp;           So= me other information, I was asked how long is the State grant commitment there for, it is 2 years from when it was voted into law or approved by the Governor. That date was June = 13^th this year so construction must begin by June 13, 2010 or we risk losing the= State grant.

&= nbsp;           NE= ASC, Mr. Geary is required to report any substantive change that negatively affe= cts the school’s ability to meet the accreditation standards and our Febr= uary 1, 2009 report to NEASC asked for specific questions, evidence, photographs, progress notes on the construction of Watertown High School, that was somet= hing we were required to report regardless on February 1, 2009 and under the substantive change policy we were required to report it within 60 days of t= hat change.

&= nbsp;           Ot= her information, the mechanical systems at both Polk and Judson, as Board membe= rs are aware and many Public Buildings Committee are aware, we’ve had so= me issues at Judson with the boilers. <= /span>The manufacturer has agreed to provide the replacement parts free of charge, ho= wever the costs to install those parts is estimated to be between $25,000 and $30,000. That was scheduled to occur with the project. At Po= lk currently one of the boilers has a leak, the other boiler is functioning. The cost to repair that boiler at = Polk is estimated to be between $10,000 and $13,000. So those are items that we are con= cerned about from an operational standpoint for the upcoming Winter season.

&= nbsp;           La= stly I’d just like to remind everyone that the Polk basement was used as a shooting range by the community before the building was combined in the late 80’s and there is a significant lead hazard in the basement and the Connecticut State Department of Environmental Protection is monitoring our progress towards fixing that issue.

&= nbsp;           A lot of information in a little bit of time. Are there questions? We have our experts here to help a= nswer some of these questions. The principals of Judson and = Watertown High School are her= e to answer questions on how their buildings will be impacted.

        &= nbsp;   Ms. Dzioba: If we don’t= use Heminway Park School as a school this year, and it’s closed for a year, don’t we lose use of the building as a future school?

        &= nbsp;   Mr. LoFrese: Yes. We are grandfathered in for the co= de work at Heminway Park School to bring the building up to the current buildi= ng, fire, and American with disabilities act codes, and if we vacate that build= ing and do not use it for a school year, actually I believe it’s if we don’t start the school year in that building, then we are forced to basically bring the building up to code before we can move back in.

        &= nbsp;   Mr. Griffith: I think one of = the items that we’re overlooking is the fact that we had all of our child= ren that are going to be attending Judson School go to that s= chool to look at that building to see what they can expect in the Fall. We’re now going to change th= at to Heminway Park School. Those children, unless they have s= iblings or for another nature have not seen that building yet, so we are also delay= ing them from getting familiarized with the building and that layout.

        &= nbsp;   Mr. LoFrese: That’s correct. We had planned on ha= ving walk throughs for the John Trumbull students at = Judson School, but once we moved it to = Heminway Park we have not had an opportunit= y yet for grades 3 and 4 students next year.

        &= nbsp;   Mr. Killeen: To anyone who fe= els capable of answering it, what’s our drop dead date for beginning any = form of construction asbestos abatement? I guess from my estimation, having sat at the Council’s meetin= g, I just don’t think they get the gravity of the situation, or at least s= ome don’t. Are the expectat= ions that if we do not begin this we might as well not? I’ve heard some comments sta= ted that even if we begin the asbestos abatement and we’re able to go for= ward with that, that we can be in equally as bad a predicament if we encounter further delays in pursuing the project.&nb= sp; I guess that question would to go any of our professionals or anyone= who feels confident to answer it.

        &= nbsp;   Ms. Purcell: At Judson Elemen= tary School, I’m in charge of that job, Larry Shilling is here, he’s in char= ge of Watertown High School, in both instances we have gone back and revised o= ur schedules with a drop dead start date of August 11^th for the asbestos abatement, as well as for awarding contracts because shop drawings= are critical in the beginning as well, so we also need to award those contracts= as well. That is the absolute last date that asbestos abatement could start at the High School. Any further delay would have a ser= ious impact.

        &= nbsp;   Mr. LoFrese: In regards to the August 11^th start date for asbestos abatement however, we’= re not talking the same scope of work.

        &= nbsp;   Ms. Purcell: No, you’re= doing the minimal amount necessary in order to install the addition. You’re also doing the tech area as well here.

        &= nbsp;   Mr. Schilling: (Inaudible) we= would renovate the first phase of the work, which is just the front of the buildi= ng, we’re not going to the back of the building like we originally intended to do. This is just the bare minimum.

        &= nbsp;   Ms. Colangelo: How much damag= e does the abatement do to the High School in the event that they don’t lift= the moratorium to use it for students next year?

        &= nbsp;   Ms. Purcell: I’m assumi= ng that if they don’t lift the moratorium no asbestos abatement will sta= rt, which means the building stays the way that it is and you are basically put= off for a whole year.

        &= nbsp;   Ms. Colangelo: Some of the Co= uncil members have said that we can go ahead with the asbestos abatement (inaudib= le) lift the moratorium for asbestos abatement, I want to know what kind of an impact that’s going to have on using the building if we do that much and then don’t do any other construction?

        &= nbsp;   Mr. LoFrese: What will the bu= ilding look like at the end of asbestos abatement?

        &= nbsp;   Mr. Schilling: The whole fron= t of the building will be off. We = will take down the window walls in the front, the window walls along the media center and the brick has to come off the front of the building, plus we hav= e to open up all the walls and the ceiling to remove the asbestos (inaudible) fittings and we also removed it off the heating system in the basement, so = the basement steam lines would have no insulation.

        &= nbsp;   Mr. Killeen: At that point, however, the building is occupy-able and it would have been a projection of= use anyway?

        &= nbsp;   Mr. Schilling: The intent wou= ld be only to put plywood back where we take the windows out to provide some security. The front of the bu= ilding would not be usable cause it would be all ripped up, the floor tile would be removed.

&= nbsp;           Mr. LoFrese: The school would have been also at= the same time been relocated to other areas.&n= bsp; The nurse would have been moved out of the front of the building, of= fice administrative, those areas would then have been relocated.

        &= nbsp;   Mr. Killeen: So the impact ar= eas would not be in use?

&= nbsp;           Mr. LoFrese: No, not under the phasing plan.

&= nbsp;           Mr. Porter: It seems to me that it would not be= a wise move to do the asbestos abatement even if the Council lifts the morato= rium if the building is unusable and we don’t proceed with the constructio= n.

&= nbsp;           Mr. Schilling: That’s a fair assessment.

        &= nbsp;   Mr. Porter: And if we do asbe= stos abatement at Judson, we would be doing the same process, taking the window walls out, boarding up the school, and it would be like that until construc= tion is allowed, is that correct?

&= nbsp;           Ms. Purcell: Yes.

        &= nbsp;   Mr. Porter So there’s a= nother abandoned school.

&= nbsp;           Ms. Calabrese: So correct me if I’m wrong, i= f we were to ask the Town Council for permission to lift the moratorium just for= the asbestos abatement, then they decided that they would not life the moratori= um, later on we would be left with the schools in disarray?

&= nbsp;           Mr. Schilling: Yes.

&= nbsp;           Ms. Calabrese: And they would not be usable?

        &= nbsp;   Mr. Schilling: Those portions= would not be.

        &= nbsp;   Mr. LoFrese: And Judson in its entirety would not be usable.

&= nbsp;           Mr. Killeen: Then I would suppose my question o= r position might go on as follows, imagine the worst case scenario and we’re prevented under moratorium from beginning or continuing with these projects= , we have already expended substantial funds that were granted to us by the Stat= e of Connecticut under the reimbursement of whatever, 58%, how much of that will= the Town incur as a commitment to the State because we didn’t complete the projects as we had indicated?

        &= nbsp;   Mr. LoFrese: If we do not move forward, the State will not reimburse us $1.00 on what we’ve expended= .

&= nbsp;           Mr. Killeen: So we will be on the hook for . . .= .

&= nbsp;           Mr. LoFrese: Upwards of $6,000,000.

&= nbsp;           Mr. Killeen: With a backward of effort to show f= or it.

&= nbsp;           Ms. Calabrese: Mr. LoFrese, thank you for a very interesting and very informative presentation. At this time I would like to ask M= s. Carol Parmalee-Blancato, who will take over as our interim superintendent tomorrow, to please contact the Town Council and invite them to a joint mee= ting and perhaps also with the Public Buildings Committee, because I would like = to ask them to lift the moratorium in its entirety. If you could do that, thank you. Is there any more discussion?

        &= nbsp;   Mr. Killeen: I just want the = public and the Town Council to recognize that we’re on the hook for $6,000,0= 00 because of potentially not doing these projects.

        &= nbsp;   Ms. Calabrese: I think it wou= ld benefit all of us to sit down across the table and discuss it publicly and that’s why we should have this meeting.

&= nbsp;           Mr. Dzioba: Quick note, that’s not the e= nd of it. We still have to replace = all of the boilers in the two schools and we have all of the problems that we currently have, most of which still will have to be fixed; in the end we wi= ll have spent more money.

&= nbsp;           Mr. Killeen: Peter, thank you very much for= . . . .

&= nbsp;           Ms. Calabrese: Without any reimbursement at all.<= /p>

&= nbsp;           Mr. Dzioba: All out of our pockets.

        &= nbsp;   Mr. Killeen: That’s an excellent addition.=

&= nbsp;           Mr. Kuegler: Todd, if the projects are held up f= or a year, and we do utilize Heminway Park to keep it occupied in some manner, a= nd we rebid the project and the project is then 10% more, do we still get that= parentage of State reimbursement?

&= nbsp;           Mr. LoFrese: Yes, our State reimbursement percen= tage is good for the duration of the project, however our concerns obviously are= is a year later the projects will then come in over budget and depending on how much over budget, we could be looking at a situation similar to Swift Middle School where there was a referendum needed because the amount the project w= as over was too large where we could actually do value engineering on the project. What that would enta= il is an additional referendum as well as an additional approval by the General Assembly, so there are two bodies that need to approve additional funds if = we were in that type of situation.

&= nbsp;           Mr. Kuegler: And if we didn’t get that, th= en we’d be on the hook for 100% of the 10% or 8%?

        &= nbsp;   Mr. LoFrese: If the Town refe= rendum didn’t pass, we couldn’t move forward; if the State General Assembly did not authorize the cost increase, I believe we would be on the = hook for 100% of the cost increase, but I would need to verify that, but I belie= ve that would be the case.

&= nbsp;           Mr. Chipko: When are the bids due now?

&= nbsp;           Ms. Purcell: Right now all of the bids are due = on both schools on July 10^th, Thursday.

        &= nbsp;   Mr. Chipko: Per the requireme= nts how long are the prices held for?

&= nbsp;           Ms. Purcell: They are held for 90 days.

&= nbsp;           Mr. Chipko: So we only have until September?

        &= nbsp;   Ms. Purcell: Last Wednesday, = the 26^th.

        &= nbsp;   Mr. Killeen: Would the presum= ption be that in all likelihood that the number of bidders wouldn’t change = and in all likelihood they would present the same . . . .

        &= nbsp;   Ms. Purcell: We expect the sa= me amount of bidders.

        &= nbsp;   Mr. Killeen: And the same bids?

        &= nbsp;   Ms. Purcell: Yes.
