&= nbsp;           Mr. Minnich: There's a problem here Gary.&= nbsp; Both of our agendas were together.&= nbsp; This Commission is in Public Hearing at this moment. You just voted to switch it around= , so we can't be both in Public Hearing and in your Meeting. What the thought was when we got t= o the point of finishing the Joint Public Participation, the Planning and Zoning Commission would Recess its meeting and you would then continue with your meeting, but I'm not clear now how we're going to be at the same time in Pu= blic Hearing and at a Meeting.

        &= nbsp;   Mr. Stewart: Does any member = of the Police Commission have input?

&= nbsp;          Mr. LeBlanc: I'm confused here. Is this a Police Commission meetin= g or a Zoning Meeting? The way I rea= d it, this was a discussion for the Police Commission and nobody else. They will be in attendance, that's= all it says, so is this what we're doing now?

&= nbsp;          Mr. Stewart: That was my understanding, but appa= rently there's a miscommunication.

&= nbsp;          Mr. LeBlanc: Well I won't sit in on a miscommunication. As far as I= 'm concerned, we have a Special Meeting to discuss the problems that were put before the Police Commission, not before the Zoning Board.

&= nbsp;          Mr. Stewart: Well it's a Joint Meeting, Bob, and= so I guess there's some confusion as to whether two meetings can go on simultaneously and I'm not sure I know the answer to that specifically, but= I don't think that there would be a problem with what Dave just recommended.<= /p>

&= nbsp;          Ms. Wick: Why don't we just Recess?

&= nbsp;          Ms. LaForme: How was the meeting noticed? Was it noticed as a Joint Meeting?=

&= nbsp;          Mr. Minnich: As two separate meetings, which we = both have identical agendas, as to what the order of the agendas are going to be, well that isn't necessarily true, but I thought the concept was we were goi= ng to listen to the issue before us, we were going to get comments from the pu= blic, and you were going to have that all under consideration and discuss it as y= our meeting, we would be Recessed and you make your decision whichever way you want.

&= nbsp;          Mr. Stewart: So it's really a question of who Re= cesses first?

&= nbsp;          Mr. Minnich: We will Recess first. And you go on to your regular meet= ing.

&= nbsp;          Mr. Martin: So that clarity will become the big= ger part of this before Commission discussion happens so that all ideas, though= ts, concerns, objections are voiced prior to the two commissions discussing it amongst themselves.

&= nbsp;          Mr. Minnich: Whatever is your pleasure but . . .= .

&= nbsp;          Mr. Martin: Deal with (inaudible) if that works= for everybody else.

&= nbsp;          Ms. Kropp: Mr. Stewart, the purpose of the ide= a I had to move public participation to after the presentation was so that the = public gets the information the rest of us are getting simultaneously, because they could get up and for the next two hours say this, that, and the other thing about Davis Street Extension without having information, so if we have the discussion with however brought the easel, etc., and then have questions fr= om the public on what this presentation is all about it just seems to make more sense. The Council has two pu= blic participations on their Agenda, they have the one right after the Roll Call, and then anot= her one at the end of the Agenda. So rather than adding a second public participation, it was just my idea to mo= ve it cause I don't think this is going to be a two hour presentation.

&= nbsp;          Mr. Franson: Who is making the presentation?

&= nbsp;          Ms. Kropp: I have no idea.

&= nbsp;          Mr. Minnich: Roy Cavanaugh has been asked to giv= e a presentation. If that's what = you want to do that's fine. Norma= lly our process is those kinds of presentations are made during public participation, but if that's your practice that's fine. We can Recess our Hearing, let's m= ove beyond these procedural things, it's a little ridiculous because we all wan= t to get this issue resolved one way or the other, so if you want us to Recess o= ur Meeting, if that's what you want to do, and you want to proceed that way, that's fine.

&= nbsp;          Mr. Stewart: At what point would you come back i= nto session?

&= nbsp;          Mr. Minnich: We would want to come back into ses= sion so at least the public and everyone else has an opportunity to talk before = you make a decision.

4.         = Discussion Related to Off-Site Improvements Regarding the Heritage Woods Subdivision/R= eversal of Traffic Flow on Davis S= treet Extension and Possible Vote

        &= nbsp;   Mr. Stewart: Why don't we hea= r the presentation by Mr. Cavanaugh, and then have a discussion.

        &= nbsp;   Roy Cavanaugh, Director of Public Works, Town of Watertown

        &= nbsp;   Mr. Cavanaugh: I'm going to g= ive you a little bit of history of where we were and where we're at, and that w= ill clarify things. Heritage Development came in with an approximate 400 unit (inaudible) development, w= hat they call the former Paparazzo piece, Bunker Hill Road, which is almost opposite Davis Stre= et Extension, also known as one way Davis. That would be down here where you = see the area (inaudible) pond right here. The map in front of you shows the topographic, GIS map on the Engine= ering Department's records, so this is an official town map. What we do have is Bunker Hill Road is running from le= ft to right, horizontally across the page, and then we have Route 63 running up a= nd down the page, and Davis Street Extension is running kiddy corner between t= he two right here. This is 63 th= ere is currently a light right here, 63 also has a no turn on red sign right here = and then coming out here it's one way, so that's the existing conditions the wa= y it is right now. As a result of = the submission of the original project, there was a design and review period conducted by both Planning and Zoning and Inland Wetlands. As part of the original design what Heritage Development was proposing a driveway directly opposite Davis Street Extension. There was a lot of concern expressed about this driveway, about the location, about the site l= ine on Bunker Hill Road and about changing the character of Davis Street Extens= ion with the fear that this would become useful as a cut through for people com= ing south on 63 and then trying to get into the Heritage Development, we thought this would possibly increase traffic so we requested that the applicant, du= ring the design and review process, shift the driveway further over to the right= , or toward the east to improve the site line and offset and to reduce the possibility that that could be turned into a cut through. The applicant did do that, the app= licant had a traffic study commissioned back in 2005 and then the traffic engineer evaluated our recommendation and concurred with the shifting of the driveway further to the east. As a mat= ter of fact, in the consultant's report, I believe February 2007, he said that that would improve the site line there and he did endorse that recommendation to shift the driveway down to the right, or to the east. That's where we're at in that rega= rd.

&= nbsp;          As part of that there was some concern expressed about the site line on Bunker Hill Road and coming out of Davis Street Extension also in relationship to the site l= ine and the driveway. One of the = bones of contention was that the developer's traffic engineer reported that coming down Davis Street right now, during peak hour traffic a.m. and peak hour th= ere is somewhere between 70 and 80 cars traversing on Davis Street Extension. Of them 5 cars or 8 cars, somewhere between 6% or 8% of the cars were making a left turn onto Bunker Hill Road = and the rest of the cars were proceeding westerly towards Woodbury. It was the contention of the traff= ic engineer for the developer at that time that there would be no traffic generated down Davis Street Extension making the left and then subsequently entering the Heritage complex, in other words using Davis Street Extension = as a cut through.

&= nbsp;          This was the source of some controversy because some people don't believe that t= here would be zero people using that as a cut through. Based on local experience and local knowledge, some members of the Commission and myself didn't feel that that = was a reasonable presumption, the fact that nobody would use it as a cut throug= h. And if I could speculate for a mom= ent, after one piece of credibility is shot in particular consultant design repo= rt, the rest of it tends to be brought into doubt, so that was an area of conce= rn.

&= nbsp;          So in an effort to resolve that and resolve the existing site condition on Bunker Hill Road, there was considerable discussion about realigning Bunker Hill Road and eliminating th= e bad site condition which exists out there right now. It is an existing condition and I = think everybody acknowledges that at that portion of Bunker Hill Road that there is a tr= affic condition. The concern that w= as expressed on many parts, is that as vehicles are exiting Davis Street Extension, making the left and then subsequently either trying to make the right in here or being delayed because people are making a left hand turn as they're coming from Bunker Hill Road that they would be a sitting duck ther= e, as people coming down around the curve and around the corner that there cou= ld be a significant possibility of rear end collisions down there because ther= e is inadequate site line. When I = say there's inadequate site line, the traffic study commissioned by the develop= ers indicated that the 85th percentile speed coming down Bunker Hill Road was 43 mph, or 42.7. This (inaudible) that t= he posted speed limit is 25 mph. Now at 43 mph you need about 400 and some odd feet for site distance. In other words site distance is a = car coming down the road, sees that there is a problem and has time to recognize that there is a problem and time to (inaudible) stop the car. The concern was that if you have a= car sitting here or coming out of Davis Street Extension, that it was an unsafe condition, particularly with regards to a car sitting here trying to make a right into the new Heritage Development.&n= bsp; As a result of that it was requested of the consultant that they evaluate reversing traffic on one way Davis, in other words right now traff= ic is going from 63 to Bunker Hill, take a look at going from Bunker Hill to 63. As part of this it was al= so recommended that there be a no left turn on this condition right here, so a person comi= ng down Bunker Hill Road would be prohibited from making a left hand turn onto Davis Street Extension and using that as a cut through.

&= nbsp;          Now there were a couple of very attractive parts of that. #1 it would virtually eliminate al= l, it was felt it would virtually eliminate all cut through traffic through here = so traffic going through there right now would be radically reduced. Of the 70 or 80 cars going through= there on peak hour traffic, all of a sudden you're going to be knocking that down= to 5 or 6. In other words it's g= oing to be almost a cul de sac condition because the 5 or 6 houses that are currently there right now would be the only people using the street, which = would be a benefit to the neighborhood.

&= nbsp;          There are 2 downsides to that. The = first downside is one of the driveway configurations down here is not set up for making a left hand turn and going into the house off, if you're (inaudible). The other house = that's down there, the other 5 houses probably would not experience any difficulti= es reversing access into their driveways, so that is one concern.

&= nbsp;          The other concern would be that the residents on Davis Street Extension as you = were going eastbound on Bunker = Hill Road, they would not be allowed to make the le= ft hand turn down Davis Street Extension to get to their house. They would have to make a U-turn somewhere down the road and then go back in and make the turn into their driveway, so that would be another adverse impact. To mitigate that the boulevard her= e at Heritage would be very conducive to making that type of U-turn. Now during the course of discussio= ns the developer also offered to put up approximately $30,000 for improvements, I don't know if that offer is still on the table, but as part of reversing the traffic on Davis Street, there would be some signalization changes down her= e at the intersection of Route 63, in other words rather than people turning rig= ht off the existing traffic light there would have to be another signal added = so people can safely egress from Davis Street Extension onto Straits Turnpike. The consultant took= a look at the traffic controller down there and determined that there would n= ot be significant modifications required, in other words it has the capacity to handle another head so the expenses down there would be the addition of ano= ther head. Also there would probab= ly have to be some realignment changes down there because (inaudible) island a= nd it would have to be little changes. One of the other things that was discussed was the turn from Davis Street Extension onto Bunk= er Hill Road. Right now it comes in like a trumpet shape, or 90 degrees, this isn't very conducive to making left hand turns and the possibility was discussed = of revising that interchange a little bit more to make it even tougher to make= a left hand turn in there and make it more conducive to making the right hand turn out of there.

&= nbsp;          So that's pretty much my understanding of where we're at, what the issues are right now. The Planning and Z= oning Commission voted in favor of it. The Police Commission denied making= a recommendation. The Police Co= mmission is the local traffic authority in Town.&nb= sp; For those unfamiliar, only the Police Commission can make that determination, with regards to the road, through their powers as the local traffic authority.

&= nbsp;          The other thought that occurred to me as I was looking at this over the last co= uple of days is as you're sitting here on Bunker Hill Road waiting to make your = turn into Heritage, I know that at one point there was some discussion about mak= ing dedicated turn lanes, both right hand and left hand off of Bunker Hill Road which would probably require a little bit of widening the road for that. The applicant's property probably towards the applicant's side so it would be property, but I thought that I'= d at least throw out the possibility in my opinion that the possibility if dedic= ated turn lanes on Bunker Hill Road, while they may not be certainly warranted by traffic conditions out there, I think this could be another, a source of possible resolution to this particular issue. By a dedicated turn lane there wou= ld be a lane dedicated to through traffic, and another lane for cars strictly mak= ing the turn which would probably serve to eliminate the potential conflicts as= a result of speeding cars and the inadequate site line, so I'll throw that out there for your discussion purposes. It's the first time I've mentioned that to 99% of you.

&= nbsp;          So that's my understanding of the situation and where we're at right now. I'm sure there are questions out t= here.

        &= nbsp;   Ms. Kropp: With the driveway = being moved from the Heritage project, do you have any idea approximately, you do= n't have to tell me to the foot, is there close to that 400 feet now? Is it 200 feet?

&= nbsp;          Mr. Cavanaugh: By moving the driveway further to t= he right or to the east we do meet the requirement for a site line at that particular intersection.

        &= nbsp;   Ms. Kropp: You mentioned that= by doing all this it would turn it into something like a cul de sac. Has there been any consideration a= t all of just making Davis Street Extension a cul de sac?

&= nbsp;          Mr. Cavanaugh: Yes, there was a lot of discussion = and evaluation of that. It's not feasible to make it into a cul de sac.&nbs= p; There are places on Davis Street Extension where the pavement goes d= own to about 16 feet and we can't get 2 way traffic safely in and out of there,= and certainly you can't (inaudible).

        &= nbsp;   Ms. Kropp: But it would be servicing 6 properties, 6 driveways then, 7.

&= nbsp;          Mr. Cavanaugh: The one at the end has access off o= f Bunker Hill Road, but the fact of the matter is if this were a new development we would never allow a 16 foot paved (inaudible).

        &= nbsp;   Ms. Kropp: True.

&= nbsp;          Mr. Cavanaugh: And even with the existing one, even though there are only 6 houses, it would be, it was my opinion that by givi= ng it an inadequate for 2 way traffic for only 6 houses, you're still setting = up a dangerous situation. Let me g= ive you an example. A snow plow, = those plows in front of the big trucks, those are 11 feet wide, they're 10 foot angled so literally you can't get two vehicles by each other over those con= ditions. Also topographically we're challen= ged there. We did look at expandi= ng out the (inaudible) pavement width. You've got a sharp drop-off down to the street down here and you've = got private property, (inaudible) and lawns up here, it could be done, but it w= ould be a very costly proposition, but yea, we did look at it and (inaudible). Thank you.

        &= nbsp;   Mr. Tedesco: I'm here tonight= to try to clarify a few things. = I was a member of the Planning and Zoning Commission for two years while this who= le Heritage Paparazzo group came into effect.= First I would like to apologize to the Police Commission and also to= the public regarding some lack of communication regarding this whole episode. This should have been, in my eyes,= the public also has to realize that the Zoning Commission at the time was under= a constraint of getting this either denied or approved with a very limited am= ount of time. Again this took almo= st 2 years from start to finish. <= st1:place w:st=3D"on">Roy did a very goo= d job in explaining things, and again I am a road builder and designer of roads. This is what I've done for a living= for the last 30 years. Most of the members know what's going on here, I'd like to just move this a little so t= he public can see. Like Roy was saying, pretty much this is how Davis Street right now, and the worry that = I had as a Commission member, and during negotiations with the Heritage Group, for their site plan review and for their special permit, there was a lot of negotiating and compromise, but in my eyes when it comes to public safety, there's no compromise, and that's just my personal opinion. What I was worried about, as Roy was saying, i= s cars coming this way, taking a left and a quick right into the Heritage Group. I'm also going to pass some pictur= es around basically showing you, the public can look at this also, I'll start = over here, you can see the car coming down the hill, another car taking a left a= nd a quick right into Heritage. I = think Roy was misquoted = as far as the site line. I think they missed their site line by about 110 feet, I think they have 340 feet of site line, the need 420. Here's the hill, the car coming over it.

        &= nbsp;   Mr. George: And that's at 25 = mph?

&= nbsp;          Mr. Tedesco: I travel this road quite a bit. I have a . . . .

        &= nbsp;   Mr. George: But that's the sp= eed limit?

&= nbsp;          Mr. Tedesco: The speed limit is 25, I've caught = myself going between 45 and 50.

        &= nbsp;   Mr. George: You speed?

&= nbsp;          Mr. Tedesco: Yes, and I'd be the first one to ad= mit it. There's quite a few people that do that. I also have here, if you want to p= ass it around, the driveway entrances to each of those houses, and there is, like = Roy said, a probl= em with one of the driveways, not exiting the property but entering their property, again they do have a problem. Anyone who says that the Heritage Group, that none of their people, = 350 units, about 500 cars, when fully built, is not going to use this to take a quick left and then 65 feet into their development is crazy, that's what is= going to happen. So this is what, I= mean the best case scenario is that if Heritage would take that hill down, the g= ame is over, we wouldn't be here tonight, but they're playing hardball a little= bit regarding that situation, they feel they don't have to do any kind of public improvements, which again keep in mind this was a special permit, I think w= e as a Commission are allowed to ask for public improvements on a special permit, but again we don't want to see them just walk away, they're going to bring = in, I calculate close to $2,000,000 in taxes by the time they start and finish within the next 5 years.

&= nbsp;          We played the blinking game once with Mr. Paparazzo and we lost regarding the industrial piece when he had the approval there, so as Roy was saying, the = pros and cons to this, if I was living on this street, the pros and cons are now, let's start with the pro, this will virtually be almost a dead end road. No other cars other than the people themselves that live on that road, would be using this or their visitors. And if you could make this here cu= rve conducive that any traffic coming from let's say Lynnfield Acres, let's say= the west . . . .

        &= nbsp;   Mr. Minnich: Mark, can you st= and on the other side of that please so everybody can see, they can't see through = you.

&= nbsp;          Mr. Tedesco: Well that means the public is not g= oing to be able to see.

        &= nbsp;   Mr. Mancini: Stand back a lit= tle bit, Mark.

&= nbsp;          Mr. Tedesco: The other problem is we can't make = a cul de sac here because the Town doesn't own the property and it's pretty crazy= to go spend $100,000 to acquire this property when realistically I don't know where the Heritage Group is thinking, because to put a new traffic light he= re is approximately $10,000 to $15,000 and I did talk to Mr. Houlihan this morning. Being a private resi= dent now and not being on the Board, I have that right to call him, and he said Mark, you can let them know whatever needs to be done with these driveways = will be taken care of by the Group, the island entrance which would now be an ex= ist would be taken care of by them. The light, the sidewalks, pretty much anything that needs to be done there will= be taken care of without a penny from the Town coffers, having to cough up anything, and again if you can make this swing that will definitely keep pe= ople from coming in that way. The = only con I see is what Roy was saying, people coming from Middlebury, Quassapaug Road, they're in a little bit of a dilemma to get into their property and t= he only thing I could see is they'd have to make a U-turn at the boulevard here for Heritage or down on Commercial Street, that's the only hang up I can see here. But personally I'd do t= hat all day long to have a nice, private road.= One second Gary, I spent just one hour last week from 7:00 to 8:00, 43 cars passed through t= his on Davis Street. That's just an hour. I calculated close to 250 cars use = that road, and pretty soon something is going to have to be done with that road = because it's in pretty bad disrepair right now.&nb= sp; (Tape #1, Side A ended - may have missed some.) 200 to 300 cars a day on there, yo= u'll be in trouble.

        &= nbsp;   Mr. George: Did you observe w= hat direction they went, those cars? Did they go east or west on Bunker Hill? Did they turn right or left? No, you had it right.

&= nbsp;          Mr. Tedesco: No, this is how it is right now.

        &= nbsp;   Mr. George: No, I'm talking a= bout if you, turn it back, would they be going right or left? When they come down, did they turn= in there to the left? The ones y= ou observed, you can turn that around. Because did they go right or left, right there the way it is now?

&= nbsp;          Mr. Tedesco: I was parked right here, the inters= ection of Davis.

        &= nbsp;   Mr. George: Well park down at= the other end and tell us how many go right or left?

        &= nbsp;   Mr. Tedesco: Duane, I can't a= nswer that.

&= nbsp;          Mr. George: Maybe we'll get an answer.

&= nbsp;          Mr. Cavanaugh: According to the traffic study whic= h was submitted by Heritage Woods, conducted by Wilbur Smith Associates, dated 20= 05, existing peak hour traffic comprises 62 vehicles traversing Davis Street Extension from Straits over to Bunker Hill. Of the 62, 5 cars or 8% make the l= eft hand turn and 57 or 92% make the right hand turn, and then the p.m. peak ho= ur traffic which is 4:30 to 5:30, the first one was 7:30 to 8:30 so Mark had t= he peak hour pretty right there according to the traffic engineer, p.m. peak h= our traffic 7% make the left hand turn coming out of there, so that's why I cam= e up with somewhere in between the existing traffic 5% to 7% are making the left hand turnout of Davis Street Extension onto Bunker Hill Road.

        &= nbsp;   Mr. George: It doesn't appear= like it's a major amount of people wanting to go that way now. I can't believe with 2 intersection= s with no right turn that that would encourage anybody to come down and make that turn.

&= nbsp;          Mr. Martin: I have a question for Mark, because= you made a statement that an opportunity for them to get back into Davis Street, flip it around again if you would please, would be to go into Heritage, now= you said they'd make a U-turn in Heritage, but in actuality Heritage as shown, there's an island that they put in there so you could go in and make a fair= ly easy turn around the island and back out, you wouldn't be swinging a u-turn right at that corner.

        &= nbsp;   Mr. Tedesco: There's a boulev= ard at Heritage, correct. The other = thing to keep in mind, I'm hearing a lot of what I call rhetoric, about what it w= ould cost to take that hill down, and I speak through experience of having to ta= ke down one of 7 hills at Bellmeadow Subdivision up at Lynnfield, to take that hill down, conservative figures, you're looking at $35,000 to $40,000. Now I'm hearing $100,000, $200,000= ; it's not that. There's no sewer, no water, and there's no storm or electric to worry about. It's basically get the dirt out and pretty much there's no ledge there from what I understand, it's not a big endeavor to take that hill down, so if you want to, as I say play politics = with this and deny this, there is also that other, if the Town Council wants to cough up $40,000 they can do it themselves.

There was a statement in the traff= ic study contained in the January 10, 2007 report prepared by Wilbur Smith Associates to the effect that there will be no reduction level of service, planned site development is operated level service B, due to the offset, has improved the level of service on Davis Street Extension at the Bunker Hill = Road is an improvement in comparison to the original plans. #6, the project does not require a= ny off site road traffic control improvements on Bunker Hil= l and intersections with Mid= dlebury Road, side driveway and Route 63 as a result of this driveway according to Wilbur Smith. One thing that jumped out at me whe= n I read that comment is they don't make any statement with regards to Davis St= reet Extension under #6 as part of their January 10, 2007 report. I hope that answered your question= .

You have more accidents at the end = of Everitt Lane and Evelyn Street than we have up there. Now here's = the problem, you're bringing traffic down onto 63, regardless whether it's the homes there or not. Heritage = Woods is trying to develop an area, they want 400 units, 350. It's their problem. It's not our problem. Why should we create a problem down here? Straighten out the hill= . If you don't want to straighten ou= t the hill, then bring it in from Middlebury Road, take out units #1 through #11, put the r= oad up there on Middlebury Roa= d, let them go towards Taft<= /st1:PlaceName> School. Why do we want to reconfigure all = of this area for Heritage Woods? That site line that you're talking about, that he's got pictures of it, it's not just a hill, it's a curve. Al= so you have a 3:00 no see situation on that road, going west you see nothing. So you put cars turning in, turnin= g out of there, somebody trying to make a U-turn as you're talking about, you're looking for trouble? Why crea= te a big problem? Level the hill, = Heritage Woods doesn't want to put his unit in there, hey, Heritage Woods is losing millions, we're losing maybe $1,500,000, $2,000,000.

&= nbsp;          Mr. Karaski: Okay, I was pleased to hear Mr. Cav= anaugh acknowledge the fact and support what I've been talking to this Planning and Zoning Commission from the get go, that the stretch of Bunker Hill Road approximately from Planter's Choice going east to Straits Turnpike is a tra= ffic disaster, whether they build this project or they don't. The issue before you should not be = to resolve which direction Davis Stre= et goes. Davis Street is fine the way it is.= It has zero impact on the safety o= r Bunker Hill Road. As the gentleman before me just po= inted out, he said to take the knob off of where the old Panilaitis home is, that would alleviate some of the problem. Again some of the problems there is elevations as well as change in direction where people driving cars lose si= te of the other people further up on Bunker Hill Road.&nb= sp; Now the traffic study said something about certain number of cars. It was also indicated here that th= e site lines were acceptable. I chal= lenge anyone on both of these commissions to take their car and park it on Bunker Hill where there's a circle in the road presently as well as a survey stake= and you tell me going east or west on Bunker Hill as well as coming down on Commercial Street and looking to turn onto Bunker Hill going west, at what point you would see that car, and I'm standing here tonight and telling you that it fails every parameter of site lines regardless of what the engineers say. So bottom line is Davis Street should stay the same, it's not an issue for this development. I've said to this Commission befor= e that the proper exit and entrance to this development should be on New Wood Road, and if this Police Commission has any impact on that, I suggest that they consider it hard and fast because that would take all the traffic off of Bu= nker Hill and that New Wood Road is a nice wide road, it has sidewalks because of the Dunkin Donuts that was built all the way to Commercial Street, so the capital layout on the part of the developers is minimal just to put in some sidewalks just to make a safety issue.&nbs= p; One other quick point, it was brought up that be reconfiguring Davis Street that they could turn around in the boulevard for this development. I wasn't quite clear of what that = was all about. Could you clarify = that for me?

They're not going to be able to ta= ke a left here, because of the sweep that's going to be taken in so that other people don't use that road, they're going to have to somehow make a U-turn = here at Heritage or on Commerci= al Street.

        &= nbsp;   Mr. Everitt: I don't believe = this is a matter for Roy Cavanaugh, I believe it's for the Police Commission. I don't think it's acceptable at a= ll for these people not to be able to go home and I know Deputy Chief John, where = he lives on the corner, if somebody put up a sign there no left turn, or any o= ne of you no left turn into your driveway, you wouldn't accept it very well and the traffic that goes up Davis Street Extension is a lot, a lot more than w= hat was said here, and already there's backup from the light up on Bunker Hill = and Straits Turnpike down to Davis Street and Straits Turnpike, never mind the bypass that they cut through there. There's nothing stopping the people from Heritage from taking a left= and a right going down that road, if there's a little jam up at the other intersection. I tried at the = Police Station to get a count of how many accidents up at that intersection, but t= hey never did get back to me, but I'm, our the Police Commission knows how many times they're called out there. As far as the 352 units in there and 500 cars, I could say there's at least do= uble that, and these people are at least 50 years old and probably have moms and dads in their 70's still alive and there's nothing keeping them out, it's j= ust not acceptable to do this to the people on Davis Street Extension. Besides the two lights from Bunker= Hill to Davis Street are what, 800, 1,000 feet apart, and they almost backup rig= ht now, and we all know the building that's going on on Bunker Hill, and if to, jus= t go up there and take a look some time, see what' going on. This is not just Davis Street Exte= nsion only. This is Elena Drive, Bunker Hill towards Waterbury, Davis Street down the ways, Straits Turnpike, people can't get out of their driveway right now. Put another light up the= re, especially a 4 way signal, and where are these people going to go? How are they going to go? I think it's up to the Police Commissioners and the Police Department and the State, because it's a State Highway, to get together and see what's acceptable or not. I just know there isn't one of you= men or women that would like now to have a sign put up, no left turn into your driveway and that's what you're asking these people to do, and these people from Heritage Woods will make a left turn and a right and there won't be 6 = or 7 cars going down there, especially if there's a little commotion up at the traffic light on 63 on Bunker Hill there, they'll all be going down that wa= y.

I don’t know if anybody reme= mbers, but this angle was changed about 10 or 12 years ago. It used to be a straight shot, it = was changed to a 90 degree angle. As a result of that we had to change our routes in the Fire Department cause we can't make the turn to take the right. What I'm looking at right now, if y= ou make this one way going the other way, I don’t know how we're going to get into Davis Street Extension to be able to make that turn to get any fire apparatus in here, cause if you look at the size of the fire apparatus, tha= t's my major concern right now.

        &= nbsp;   Ms. Wick: Does the Fire Depar= tment, I would assume that the only time you would have to get into Davis Street Extension is if there is a fire on Davis Street Extension, right? Wouldn't you, since, wouldn't it be likely that you would go in the most direct way, which is the wrong way on = that street, rather than trying to turn in?

&= nbsp;          Mr. Primini: You can't do that. Just recent memory there was a fire truck accident, where one firefighter got hurt. I don't know if you noticed, but al= l fire apparatus in this Town stops at every traffic light, even when we have the right of way. We're not about= to drive down a one way street the opposite way, I don't see that happening. I'm just bringing up, I think it w= as about 10 or 12 years ago we got money from the State to make that a 90 degree ang= le and as a result of that we had to change our routes. We used to go down Davis Street extension, to be able = to go down Bunker Hill Road. We had to take that off, and all f= ire apparatus has to go down Straits Turnpike and take the right onto Bunker Hi= ll, but the way I'm looking at that turn, we'll never be able to, the only way = to make that turn you have to make a real wide angle to get in there, and that= 's just almost impossible for the trucks.&nbs= p; If you look at the size of other ladder trucks, you're just not goin= g to do it, without being way over in the opposite lane. I think that's just creating a very hazardous situation for all the firefighters.

&= nbsp;          Mr. Paternoster: I disagree with turning around on t= he boulevard, that's forcing people to go on private property which Heritage W= oods made it clear that that is private property, so you're forcing people to tu= rn there, they're going to pull out who is responsible for making them turn th= ere, that's a hazard. The second t= hing is right where that entrance is Sunday morning, there was a police officer having a car towed, had his lights on, I had to stop to go around him, I al= most got rear ended and that's with a police officer with his lights on sitting there, so there's no site line at all.

&= nbsp;          Ms. Kling: Resident there 35 years. I have had 2 fires at my house and= the first time they came they went past me, they didn't know 620 Davis Street Extension. They came right back, and put the = fire out. I lost half my house on = that one. The other one before tha= t was I flipped a switch and the lights didn't go off and smoke came out of the w= all, so 911, everybody comes up, tells me to turn off the lights, turn off that fuse, have an electrician fix it, which I did, but I'm telling you if he sa= ys it's dangerous. I will also t= ell you about that hill, on Bunker Hill when= you come over past what was Panilaitis Farm.&n= bsp; That hill is dangerous. When my children were at Judso= n School, the bus wou= ld stop at the turnaround. Can I= tell you how many times crazy cars came zipping over that at 50 mph, could not s= top for the bus and pulled around and almost, I mean we didn't get inured or anything, but that hill is dangerous and it happened more than once in the = 4 or 5 years that my 2 children were at Judson School and that's where they got dropped off. I had requested = at the time because the Board of Education for the bus to come around, down Bunker Hill, down Route 63 and come and I would pick them up at your house, the corner, right there, we can't do that, we won't let the children cross Stra= its Turnpike.

        &= nbsp;   Mr. Brophy: The Police Commis= sion is here now and I've spoken to everyone else and you guys haven't heard me = and there's a lot of things that I've said in the other meetings and I'm going = to say a few different things that they've heard already but a couple of thing= s, the site line, I'm confused as to whether it meets the 400 feet or whatever it's supposed to meet, and the way this gentleman explained it before, they moved their driveway down the road so that it was better so it wouldn't be directly across from Davis Street Extension. Well if their site line isn't meeti= ng now, it definitely wasn't meeting before, so they didn't move it to get away from Davis Street Extension, they moved it to get their site line better I’m sure. It seems like= these kinds of things are happening in this whole project that just don't make se= nse to me. Another one, the zero = cars on Davis Street, that traffic study to me is a joke. I was here the night the gentleman spoke and I don't think he said anything to be honest with you. There's 350 units going gin there, I'm pretty sure that the way it's stated they can have up to 5 people per unit, and I noticed that wouldn't be the case but if everybody had a car, 5 x 350, you're not looking at 500 cars, you're lookin= g at a lot more than that, and I realize there won't be that number either, but = it won't be the lower number of 700 what people were talking about before. The left hand turn, the 8% that are going to turn left, that's going to change dramatically when you put these = 1,000 cars right across the street, that left hand turn thing isn't going to be 8% anymore, it's going to go probably to 70% or 80%. The way I see it they either need = to take down the hill, or go to New Wood Road, that's the best place, but I do= n't think they'll go there because the wetlands would go over but they either h= ave to take down the hill or go to New Wood Road, one or the other to fix the problem in my estimation. If that Davis Street Extension is changed, I'll be there until lunch before I go to work. And nobody is going to do this? Make the left and then the right o= nto the one way street going here to avoid all the traffic up here. No. The older people are going to say I don't want to wait, and there's = much less traffic here and they're all going to be coming down here to go either north or south or whatever. T= hey'll want to avoid all the traffic here, and I think the 3 lanes from what was i= t, that was the benefit we got from Stop & Shop I think, they're not going= to do all this, they're going to come down and do that, and it's going to be j= ust as crowded on this street with the (inaudible) 500 cars coming out of there= as it would be if the street was going the other way. &= nbsp;          Mr. Cavanaugh: Again for the record I want to resp= ond to a couple of comments that have been made.&= nbsp; The first comment with regard to fire protection, Chief Black of the Fire Department has reviewed both alternatives with regards to the traffic = flow and he didn't feel it would be compromising safety by reversing the traffic= as we have discussed here. He did acknowledge and we do acknowledge that there would be a couple of second li= terally a matter of a few seconds increase in response time when you go down to the light and make a right, but again he did not feel that changing the traffic would compromise public safety.

&= nbsp;          The second point I'd like to make is the site lines as proposed, after the improvements are made and freely acknowledge and the applicant I'm sure wou= ld agree with me that the existing conditions would not meet the site line requirements but what we are looking at is the improved site line which is proposed on the plans, on record, and it's approved by Planning and Zoning would meet the site lines in accordance with D.O.T. for the 85th percentile, which is 43 mph. It does not = meet it for people coming 70, but the 85th percentile as you know is the designed speed based upon the traffic studies there.

&= nbsp;          Finally the plan does outline the improvements to be made on Bunker Hill Road to get the site line. Those are the improveme= nts which were approved by the Planning and Zoning Commission so I can emphasize again that while the proposed driveway location does not currently meet the site line according to the engineer's report as reviewed by the Town Engine= ers, after the project is constructed, if it is constructed in accordance with t= he plan, it would meet the site line requirements for this development without doing the elf there so for the record those are the facts as I see them.
