        &= nbsp;   Mr. LeBlanc:  I have a few que= stions for the Town Chair concerning the Executive Buildings Committee.  It seems like I was appointed to t= he Executive Building Committee and I can’t seem to find out any informa= tion about our John Trumbull School, and I’d like to know if it’s possible to have a meeting before we either get elected or not elected, to = find out what’s going on concerning the school.  We’ve been kept in the dark.=   We’ve only had about 3 meeti= ngs in the last two years and it’s very embarrassing.

 

        &= nbsp;   Mr. Archer:  We turned over the resolution of the last items with the architect and the building (inaudible= ) to the Public Buildings Committee and they have given us a couple of interim reports in this forum, but it is probably time to get everybody together and get an update as to what’s going on.

 

        &= nbsp;   Mr. LeBlanc:  I would apprecia= te it.  I served faithfully those= 3 meetings.  Secondly I would li= ke to speak about my problem about the salt pile.  It’s not a salt and sand pile anymore, I see we had the gentleman from Public Works here, seems like now = we have a salt pile on Baird Road, and that’s not covered.  I’d like to know if we’= ;re going to cover the salt pile or are we going to let that go down into the streams and the neighbor’s houses?&n= bsp; I will volunteer to go cover it, if the Union doesn’t get on my case, but I think it’s not good for the environment, and I thank you = sir.

        &= nbsp;   Mr. Reynolds:  I’d like = to put this newspaper here dated October 12th into the Council record.<= span style=3D'mso-spacerun:yes'>  You’re going to have to bear= with me here because I’m not (inaudible) and doing all the things that I u= sed to do as fast as I used to do them because I just finished my chemo today a= nd it’s like really nasty stuff.

 

        &= nbsp;   First of all I’d like to say when did you find out that the meeting was cha= nged to this place?

 

        &= nbsp;   Ms. Robson:  It’s been n= oticed appropriately.  Well the Legal Notice was done correctly; apparently there was an issue with the Town Times.  We did put a sign up a= s on as we found out there was an issue.

        &= nbsp;   Mr. Reynolds:  Even the Fire Marshall went to the wrong place so I noticed his car was parked next to mine.  I just wanted to commen= t on this article that was in here, and it’s amazing how many people know nothing about your job, but can always do a better job themselves.  These people usually only have one= thing to gain and that is immediate power of recognition for a short period of ti= me, due to circumstances of that time.  Usually all the stuff they put is pure garbage.  The article in Sunday’s pape= r on October 12th is a prime example of that.  There were so many names mentioned= , all of whom were seeking power from the voters so that they could beat their chests.  I do not recall seein= g any of these people at a single meeting of mine in the last 9 years, except for= Mr. Traver who was on the Board when I joined and he was a heck of a nice guy.<= span style=3D'mso-spacerun:yes'>  Every few years we hear garbage li= ke this all the time and it’s kind of a shame because it brings us down = as a working team.  You guys work v= ery well together, I think you do, but there is always somebody who is going to= go and stick something in you and kind of ruin your day.  Well it ruins mine anyway.  It’s just like this this yea= r and here we are again it’s a voting year, so that’s the real reason, it’s just that they’re trying to do all of you in, even the ones that are staying in or the ones that are going out, and this year their ven= om seems to be aimed at the land use boards and that’s kind of a shame c= ause we work so hard in what we do and it’s not like other towns where peo= ple get paid and these boards don’t care.  We do care.

 

        &= nbsp;   Many years ago I volunteered to put a slide show together for the E.D.C.  I finished it, it had music with i= t, it took me maybe 3 months to put it together cause that’s my trade, that’s what I do, so for where I live, my town, I put a little extra = into that cause I just wanted it to be very, very special.  No name, no who edited it, no who = made it or whatever, and I handed it to the E.D.C. and I never saw it again.  If that’s what they think of= my work, then I’m sorry I’m not going to be interested in doing anything like that again, not that I can anymore, I just can’t.  The reason they said that they weren’t using it at that particular moment in time was there was no m= oney in the budget – when is there?

 

        &= nbsp;   I’m interested in knowing how the Town is going to make the town more desirable= to the business section?  Will you offer T.I.F.?  Will you pay th= eir light bill?  What plan do you = have to make these people say ooh, look. Lets go to Watertown.  I don’t understand it.  If I had a business in this Town, = and the guy next door came in and opened up and paved it and did everything tha= t he wanted, put a new roof on whatever, and I found out he got the Town to pay = for it, I think I’d be a little mad.&nbs= p; To buy the businesses to come that’s certainly going to stabil= ize the tax base, and of course it isn’t.  The style of buildings in Town is depicted by the Planning and Zoning, and the Planning and Zoning does have, believe it or not, a sort of plan, we may not all be aware of it, I know I’m not, I don’t know how many are, but I know I’m not, b= ut I look around this town and I drive around side streets and the main streets,= I love this Town, I think it’s absolutely wonderful.  I work in Waterbury, cause that= 217;s where I make my money, but I wouldn’t want to live there.  I’d go out of my mind.  I’d be sitting at the front = door with a shotgun.

        &= nbsp;   Many months ago we had an applicant come before the Zoning Board of Appeals, Mr. Bonsignore represented this applicant.&nbs= p; Neither he nor Mr. Lucia, for those of you who don’t know I’m talking about the Dunkin Donuts building on Main Street, were poo= rly treated.  They were not.  We bugled them into the room and o= ffered them coffee and everything else. It was just wonderful and we had great (inaudible) with these people.  The application needed a variance of parking, which it usually does, and it also needed a booth which kind of intrigued me cause I didn’t know what th= at was until I got there that night.  It was a booth where they would have a certain amount of donuts and coffee already ready to go and you just drive around, it’s not a driv= e up window, it was a drive up booth, like a telephone box.  We considered all that, and what w= as presented included the neighbor, the thoughts of what the neighbor was going through = up on Belden Street.  You have to remember that when we make a decision, our decision is not based upon the applicant, it’s based upon the applicant, the land, and a whole mix or other things, plus the future and the neighbors.  I don’t care if a neighbor c= omes to me and says oh I don’t mind if he sticks up an 80 foot tower.  I’m saying I do.  It’s not in our Regulations, it’s not allowed, so why would we do it, so we would knock that kind = of thing down.  All three standar= ds were affected by this particular applicant.  We could have given him one, we co= uld have even given him the garbage can visible to the road, I don’t know, put a fence around it, but we came back with another plan, the following mo= nth and we said look, how would you consider Plan B.  He looked at us and said what do y= ou mean Plan B?  So we took his l= and and I sort of took the building with the other members of the Board and we rotated it 90 degrees, so it was now facing north instead of east and he sa= id why didn’t he think of that.  And then he looked at his high-priced attorneys and his architects a= nd everything else and he didn’t say anything to them, but bet your boot= s he did out in the hallway.  Follo= wing month he withdrew.  I knew he = would, and he came back with his Plan B.  I didn’t care if it was his Plan B or anybody else’s Plan B, it didn’t matter, but he did one thing, it showed that businesses are willing to bend and listen to what people have to say, especially people who know somewhat what they’re talking about.

 

        &= nbsp;   Planning and Zoning (inaudible) Zoning Board of Appeals is designated by you after t= he Town Committee Chairman of each Board presents the name.  You the Town Council to (inaudible= ) for their jobs or get them to do their jobs.&n= bsp; I remember mine was 10 years ago, I never thought I would be in this= job 10 years, not a hope.  State L= aw dictates the rules and regulations we must go by, not you, we.  As the Town Council you’re t= old by the party reps that this person is going to be on whatever board on all boa= rds and commissions.  You cannot t= hen mandate to any member of any land use board your feelings or wishes.  In there it does.  I don’t know if that’s= a mistake, as we all know how accurate things are in the Waterbury Republican= but I hope it’s wrong, I really do.  Mr. Kane, he has a plan to transform Main Street into Lakewood Road, actually said that in not so many words but basically he did.  I think he’s nuts.  You can tell the great job he did = as the President of Wolcott/Lakewood Road Business Association, as we all know what happened the last time anyone made a presentation of this type to this Town that they wanted to change a road to look like Lakewood Road.  Can any of you say Homart?  Do any of you remember Homart?  I do.  I remember it very, very well.

        &= nbsp;   I envy Mr. Fisher (inaudible) being able to compare 2003 land use boards with= the 15th Century English History and the Star Chamber.  The only reason I knew what a star= chamber was was I had to do a paper on it when I was about 13 so that’s how I know it.  I can’t imagine anybody in this entire country knowing what a star camber is unless you’re an English Literature major or something, but he should have considered his studies and research, then he would have seen that history w= as not like saying land use boards were like the star chamber, but in a sense = the court was a provisionary body, it’s members oversaw the operations of lower courts for the king and his council.=   It’s not me that’s in the chamber.  You guys are in the chamber, so you’re the ones that the star chamber was really looking at.  I don’t think that he meant = that for me being English.  So you = need to take that with a pinch of salt cause you can’t go back 550 years a= nd expect us with all our modern techniques to continue without any improvemen= ts.

 

        &= nbsp;   Mr. Walton’s comments were totally out of order.  He should do more research before = he sticks his foot in his mouth.  I defy Mr. Walton to go through the records to see how many business applicat= ions and how many industrial applications the Z.B.A. has turned down in the last= 9 plus years.  Not 1 year, IR= 17;ll take him back 9 years.  Mr. Wa= lton also said the land use boards are stubborn.  He’s never been to one of mi= ne that I can remember, so how does he know I’m stubborn.  Reflectionism isn’t put in t= he Minutes.  It’s not he sa= id this, they said that.  And thi= s was exhibited by members of both parties of both land use boards.  That’s written in there too.=   He said we have done a top notch j= ob of stopping business coming to town.  That’s nonsense, we have not, and I defy him again to point one out.  W.O.T.A. won’t spe= nd a dime on the roads, schools, teachers, and other professional help.  They are the hypocrites that only = when it suits them.  So Mr. Walton,= you know nothing about what’s going on on our boards.  I think you should stick to tellin= g the Town at budget time, zero tax increase so that the Town is slowly strangled= due to normal inflation.  Let̵= 7;s see if they agree to voting funds for sewer and water going down Echo Lake Road.  Yeah right.

 

        &= nbsp;   It seems to me that I can remember with many others that a proposal was made to run sewer and water down this road.  We also had some serious plans put together remember?  It not only included in the 54 lot= s that we had subdivided as a supposed idea, but also the sewer, water and everyth= ing else, but again no money.  But= those plans are around somewhere.  I don’t know if you knew that.  Oh you did, okay.  It w= ill never be considered, even though you know about it, because we’ll nev= er have that kind of money, I mean unless the Town buys a lottery ticket and w= ins the big lotto, I mean we’re just not going to have that kind of money= . If I won it, I’d give you half.  Sorry to have to burst your bubble, Mr. Murphy, but you were also wrong.  I know I picked on a l= ot of Republicans, and I’m trying to keep this equal.  The problems are not directed out = of the Republicans.  It’s not true.  You work very well toge= ther and you share your mistakes together and that’s the way I look at it.  All land use boards are m= ade up of Democrats, Republicans, and Independents.  I don’t know if you knew tha= t, there’s one on my board, an Independent.  It’s not fair to lay all this at the door of the Republicans.<= span style=3D'mso-spacerun:yes'>  In case you’re wondering, I’m a Democrat on the Z.B.A. and have been the Chairman 9 years out of 10.  The Democrats do not hold= a majority.  The Z.BA. also has a Republican majority and has been since I've joined, so what’s this pa= rty stuff?

        &= nbsp;   It’s (inaudible) that we work so well together.=   You new members of the Town Council must appreciate many (inaudible)= of volunteer work that we give the Town.  I know you are also open for business twice a week, but you did fight long and hard to be voted for this job, so therefore, if you were to work 2= , 10 days a week, it doesn’t matter to me.  I mean (inaudible) who work 7 or 8= days a week, but I cannot.  We all = know how much the Council (inaudible). It’s about twice as much as the Z.B= .A., and I’ve had applicants stand right before me, I’m going to see your boss and I’m going to tell him to reduce your pay.  It’s crazy.  People in this Town really donR= 17;t understand the Town’s function and how we all put so much effort and = time into our work.  I don’t = envy any of you, your positions.  I= spent one day at a Z.B.A. meeting to do, as do the Planning and Zoning, to ask us= to do 2 days and I only speak for me, I don’t speak for the rest of my Board, asked me to do 2 days, I’m sorry, I can’t do it.  I spend an entire day reading my p= acket, which is about ¾ of an inch normally.  After I’ve read it I then re= -read it 2 or 3 days prior so I’m up to speed on it, so yes, it’s not like you (inaudible) through your paper, what’s this, what’s th= is, you guys are also way up to speed on what you have been presented with for = your evening.  It’s not just one evening, it’s several evenings for= us, and I believe it’s several evenings for (inaudible).  At times there are several hundred= pages and I (inaudible) them all and I and members of the Z.B.A. also partake in = many site visits.  That’s not something I think you guys do very often.&= nbsp; And we do it in all kinds of weather, at our own expense.  I’ve lost many a shoe out in= the fields.

 

        &= nbsp;   Also all of our Minutes are double sided, so if it’s this thick, it’s really that thick.  The reason= they are double sided is because I made a decision a while ago that the Zoning B= oard of Appeals were getting too many one sided pieces of paper.  I thought that was kind of cruel t= o the taxpayer and bad for the trees so if we could save a few dollars on taxpayer’s money, we would also save a few trees.

 

        &= nbsp;   Lastly, why are we (inaudible) ourselves with Waterbury?  Aren’t we doing that for the moment?  This is (inaudible) t= he last two paragraphs.  (Inaudib= le) but you can read this a little later.  Why align with Waterbury?  We all know how successful they are, and they have an 80 to 90 mill rate.  I can’t imagine doing someth= ing like that when we have a 25 mill rate. So why would we want to align oursel= ves with Waterbury?  And I know Mr= . Kane is sitting there and I know he’s probably got things I’ve never heard of, things like that, but if you don’t let the public know this= , by God is where we’re going to be.  Thank you very much for your time.

        &= nbsp;   Mr. Hernandez:  10 years ago t= here was two departments that separated, the water works and public works for the water and sewage and the public works also were the departments that separa= ted due to spending and inadequate communications between both departments.  I guess Donna Masi said it best wh= en she said back to the way things would be better.  I guess before that it was separat= ed and then you guys joined them together and now they’re separated again.  To that extent I just have a coupl= e of things I just want to get off my chest and some questions if you guys don’t mind answering them.

        &= nbsp;   First off, what’s the reason the Town refused to pay the salary approved by= the Town Council and the voters of this Town when a certain individual who was hired as Assistant Superintendent for 19941995 saved you guys a great deal = of money?  94/95 total water oper= ations was $777,832.11.  The year bef= ore it was $1,765,059.68.  That person saved the budget close to $1,000,000 and yet he didn’t receive the re= st of the funding that you guys agreed upon to pay him.  The wage benefits were an adjustme= nt where you guys didn’t pay the lack of the remaining of from one budget $3,148 and another budget of the same thing cause it was split 50/50 and sa= ving you guys all that money and he didn’t receive it and he’s in the works of trying to get it now but this was thrown on my desk so I’m j= ust going with it, just bear with me for a minute.

 

        &= nbsp;   In 1994 the Water Department was not run by the Public Woks Director but by the Water Sewage Authority and his Assistant Superintendent.  In comparison in 1993 total water operations under the Public Woks Director was $1,765.  In 1994 the total operations under= the Assistant Superintendent was $771,832.&nbs= p; (Tape #1, Side A ended – may have missed some,) or is it becau= se the Public Works Director made him look bad?

 

        &= nbsp;   Mr. Archer:  If you’re looki= ng for an answer off the cuff, I don’t have one.  It’s something that was a de= cade ago and I don’t know.

 

        &= nbsp;   Mr. Rinaldi:  I can shine a li= ttle light on that.

 

        &= nbsp;   Ms. Robson:  This is a matter = for the courts to decide.

 

        &= nbsp;   Mr. Archer:  It sounds like a = legal issue to me and it’s kind of out of our domain anyway.

 

        &= nbsp;   Mr. Rinaldi:  So you don’= ;t think we should answer this gentleman’s question?

 

        &= nbsp;   Mr. Hernandez:  I think you sh= ould because after all the homework that I’ve been doing, I think I’m entitled to at least a partial answer or something.

 

        &= nbsp;   Ms. Robson:  It’s my recommendation to (inaudible) since it is in litigation that it not be discussed at this point.

 

        &= nbsp;   Mr. Hernandez:  Nothing?

 

        &= nbsp;   Mr. Archer:  If it’s an = issue for the courts it would be improper for us to comment on it anyway, even if= we did know anything about it.

        &= nbsp;   Mr. Hernandez:  I could totally understand that if we were going to trial, if we were going up against a lawsuit, but that’s not what we’re doing here.  I’m just asking a question.<= span style=3D'mso-spacerun:yes'>  I think I’m entitled to know= the answer to that.  How would a p= erson not get his based on salary considering he saved you guys almost $1,000,000?  That’s noth= ing a court should decide.

 

        &= nbsp;   Mr. Archer:  That would seem o= n its face to be unusual, but I have no knowledge of the circumstances behind it = so I couldn’t even give you an educated answer even if it wasn’t a l= egal issue.

 

        &= nbsp;   Mr. Hernandez:  Are you an att= orney?

 

        &= nbsp;   Ms. Robson:  No, I’m the= Town Manager.

 

        &= nbsp;   Mr. Hernandez:  How much does = the Town spend on attorneys on different cases?  I understand in 1999 it was about $40,000 and what was it for, and what now, what are you spending on attorne= ys now?

 

        &= nbsp;   Ms. Robson:  I couldn’t = give you an answer right here.  You= cold come into the office and we could go through the detail in the Finance Offi= ce.

 

        &= nbsp;   Mr. Hernandez;  Okay, do you h= ave a business card?

 

        &= nbsp;   Ms. Robson;  Yea, I can get yo= u one.

 

        &= nbsp;   Mr. Hernandez:  Is it Town pol= icy to hire out of towners to work for the Council, the Board?  How many town employees who are wo= rking here live in Watertown and how many live out of town who work here in this great community of ours?  Are = all of us from Watertown?

 

        &= nbsp;   Mr. Archer:  You mean everyone seated here?

 

        &= nbsp;   Mr. Hernandez:  Yes.

 

        &= nbsp;   Mr. Archer:  We have to be in = order to be elected.

 

        &= nbsp;   Mr. Hernandez:  Thank you, that’s at least one question anyway.=   The Town’s Public Works Director, Phil Deleppo has retired correct?

      = ;            &n= bsp;     Mr. Archer:  One of the things we’re talking about sending to referendum tonight is a collection of Public Works projects that have been on the boards for, some of them years,= and a lot of them have to do with flood control, and a lot of people have been waiting a long time for these improvements to happen, and they are things t= hat are usually in the budget when we start the budget process and by the time = we get done with the budget process they’ve been cut out, and one of the things that Mr. Reynolds mentioned when he was speaking is that slowly the = Town infrastructure deteriorates and that certainly doesn’t help us to att= ract businesses to the Town either, when they come to town and see roads and bri= dges deteriorating, so this is a little bit of a novel approach to getting some = of these Public Works projects funded and I think it’s a great way to, it’s a little bit of a change in thinking on how to get these done, a= nd I just want to voice my support for it and hope everyone comes out to vote on these referenda when they come up.

      = ;            &n= bsp;            = ;             &= nbsp;   Mr. Cavanaugh:  Right now the Engineering Department is working on AutoCAD 2000 for all its programs for design program, survey, CAD, and mapping programs.  We were notified this month by the= Auto Desk who writes the AutoCAD program that they are no longer supporting the program and we can no longer upgrade it after January 15th.  We have to buy a whole new license= for all of our stations, so as of January 15th if we have a problem = with it we’re dead in the water.  We are anticipating proposing this upgrade in next year’s budg= et, but they kind of shot us in the foot with this.  So we found out if we appropriate = the money and get the order in by the end of October we can save some serious m= oney and that’s what we’re looking to do, and of course after Januar= y 15th we’re kind of hanging without any support.

You can’t just buy one and transfer from computer to computer, you have to buy individual licenses for every user.

     &n= bsp;            = ;            &n= bsp;            = ;     Mr. Cavanaugh:  No, what happe= ns is they’re giving a discount if you order in October.  There’s a price if you order before October, a price between November, December, and January 15th, and as of the 15th it cuts off period and we can no longer upgra= de, we have to buy a whole new license and a whole new program.

 

      = ;            &n= bsp;            = ;            &n= bsp;    Mr. Wick:  Are we reasonably confident that these guys will be in business long enough to get our money’s worth from this expense?

 

      = ;            &n= bsp;            = ;            &n= bsp;    Mr. Cavanaugh:  AutoCAD is wri= tten by Auto Desk and they’re probably the preeminent and it’s the leading designer/manufacturer/ writer of this software design at this time, yes.  They’re pretty muc= h the industry standard.

 

      = ;            &n= bsp;            = ;            &n= bsp;    Ms. Robson:  This is not just a Connecticut software or Watertown based program.  It is the standard.

 

      = ;            &n= bsp;            = ;            &n= bsp;    Mr. Cavanaugh:  This is what t= he vast majority of the consultants use and it’s compatible with the D.O= .T., and that sort of thing.

 

      = ;            &n= bsp;            = ;            &n= bsp;    Mr. Wick:  I only ask that que= stion because I’ve seen discounts used to motivate people to act, but this = is a rather large discount.

 

      = ;            &n= bsp;            = ;            &n= bsp;    Mr. Cavanaugh:  Yes, it is.  All I can think of is, they’= re offering this discount, and I’m just speculating right now because th= ey gave us such a short window, really they didn’t give us much notice at all that they were terminating our support.  To the best of my knowledge AutoCA= D has been around since the late 80’s when they first stated Version 13, 14, 14A, 2000, 2004.  Based on the= ir track record I would anticipate they would be around for quite some time.

      = ;            &n= bsp;            = ;     Mr. Archer:  But specifically = this is for Davis and Cherry Avenue and those that were designated as streets th= at are in danger of having to be rebuilt if we don’t act on them.

 

      = ;            &n= bsp;             &= nbsp;   Ms Adams:  Yes.  Those are the ones that we already= put out to bid.  The bids came back.  One of them was pretty = much on the money, and the other one was off by quite a bit.

 

      = ;            &n= bsp;             &= nbsp;   Mr. Cavanaugh:  We transferred previously $135,000 of LOCIP money which was previously designated for the repavement or the overlay of Echo Lake Road.  Because we specifically designated= LOCIP funding as paved rehab arterials and the Capital Improvement Plan said Echo Lake Road, so we’re going to take that $135,000 and use it for Cherry= and Davis.  Cherry and Davis, the = two projects together came in a little bit over that, so we’d like to take the money from last year and just make it crystal clear from when we go for reimbursement form the State that we (inaudible) legislative approval to use LOCIP money in this fashion.  = We are looking for specific authorization to do it.

 

      = ;            &n= bsp;            = ;     Ms. Adams:  This is the one th= ing that actually, well we had budgeted for, actually LOCIP gave us a little bit more than we thought we were going to get.=   Everything else was less.

B.     &nbs= p;   Discussion Regarding Public Investment Community Grant Use of Funds

 

     &nb= sp;      Ms. Robson:  Originally this w= as in response to the Economic Development Commission’s request for $3,000 = to digitize their brochure.  This= was, there’s a 1993 grant that was wonderful, it used to come to Town̵= 7;s for economic development activities, and we had a little over $3,000 left in that grant account that we could have put towards this.  I would recommend that you hold of= f a little bit, cause I recently had a conservation with our web site host to s= ee if there isn’t something that we could do in a different level at much less expense, so we’re trying to work that through.  We had a meeting this morning and we’ll get in touch with the Economic Development Commission members to get a little more feedback to get exactly what they want and how they want = it down so this is a potential that we can use to do that, but we may be able = to do it without spending that kind of money on it, so we’re just trying= to work through that first.

RESOLVE= D, that the Town Council hold a Public Hearing on Monday, October 20, 2003, at 7:00 p.m. at Watertown High School Library, 324 French Street, in Watertown, on = the following proposed bond ordinance, which is hereby introduced:

 

“= AN ORDINANCE APPROPRIATING $5,420,000 FOR FIRE HOUSE STATION #1 RENOVATION AND EXPANSION, AND AUTHORIZING THE ISSUE OF BONDS OR NOTES AND TEMPORARY NOTES = TO FINANCE SAID APPROPRIATION.

   &n= bsp;        The appropriation may be spent for design and construction costs, equipment, materials, furnishings, inspection and testing costs, contract management f= ees, architects’ fees, engineering fees, testing, legal fees, net interest= on borrowings and other financing costs, and other expenses related to the project.  The Town Council, or= such official or entity designated by the Town Council, is authorized to determi= ne the scope and particulars of the project, and may reduce or modify the scop= e of the project, and the entire appropriation may be spent on the project as so reduced or modified.

      = ;      Discussion:       Mr. Valenti:  I know this has = come before the Council several times. I ran on that track as a younger man.  In concept I’m supportive of making renovations, I think it’s important.  I know when we did Deland Field se= veral years ago, I know Mr. Hebert and Mr. Wick were on the Council, what came be= fore the Council at that time were several different options.  We could do this and this, or we c= ould do this without repaving the parking lot, and I just wish we could have had that same kind of choice among different scopes of project.  I think it’s a worthwhile en= deavor at 6 lanes; I’m not so sure they, especially given all the other thin= gs we’d like to do with the money, but with that thought, thank you.

 

      = ;            &n= bsp;            = ;     Mr. Primini:  I believe the re= ason for that, we’d be saving more money if we do everything all up front = and the main reason is something I don’t think has ever been done before = is the test borings. There is poor drainage up there right now, so what you’re going to be doing is doing all the work right now and then if = you decide to do some of it, you’re going to end up doing it all anyway a= nd it will cost a lot more money later on.&nb= sp; And I believe during the Gearing was the difference between a 6 lane= and an 8 lane is $55,000 which isn’t that bad.  If it was a couple hundred I’= ;d probably have a problem with it, but by having the 8 lanes, (inaudible) we could have championship meets on there which could open up concessions and = make a little bit more money to help defer some of the costs on it possibly.

            =             <= b>Mr. Valenti:  Unfortunately I couldn’t make that, and maybe some of my fellow Council members can educate me because I didn’t have a chance to read either, your point = is well taken.  I wonder though, = I know there was talk about there is money in this bonding amount to do test borin= gs; is there also money or a provision of money that should they discover that blasting and removal needs to be done, that’s accounted for as well in that estimate, or is that something where we’re going to have people coming back to us and saying now we found ledge?  We paid for the testing of it but = we haven’t budgeted for blasting it out and taking it away.

 

                    &= nbsp;   Mr. Archer:  This is something= that came up during the Public Hearing.

 

            =             <= b>Ms. Robson:  There is some lev= el of contingency to take into account any particular issue which that would be included in, but if it’s substantial I don’t believe there are funds to cover that, so it (inaudible) on the level I think.

̶= 0;3.        That the Town issue and renew temporary notes from time to time in anticipation = of the receipt of the proceeds from the sale of the bonds or notes and the rec= eipt of grants for the project.  The amount of the notes outstanding at any time shall not exceed ONE MILLION SE= VEN HUNDRED THIRTY THOUSAND DOLLARS ($1,730,000).  The notes shall be issued pursuant= to Section 7-378 of the General Statutes of Connecticut, Revision of 1958, as amended.  The notes shall be g= eneral obligations of the Town and shall be secured by the irrevocable pledge of t= he full faith and credit of the Town.  The Town shall comply with the provisions of Section 7-378a of the General Statutes with respect to any notes that do not mature within the ti= me permitted by said Section 7-378.

“4.        That the Town Manager and the Finance Director of the Town shall sign any bonds = or notes by their manual or facsimile signatures.  The law firm of Day, Berry, & = Howard LLP is designated as Bond Counsel to approve the legality of the bonds or notes.  The Town Manager and t= he Finance Director are authorized to determine the amounts, dates, interest rates, maturities, redemption provisions, form and other details of the bon= ds or notes; to designate one or more banks or trust companies to be certifying bank, registrar, transfer agent and paying agent for the bonds or notes; to provide for the keeping of a record of the bonds or notes; to designate a financial advisor to the Town in connection with the sale of the bonds or notes; to sell the bonds or notes at public or private sale; to deliver the bonds or notes; and to perform all other acts which are necessary or appropriate to issue the bonds or notes.

̶= 0;5.        That the Town hereby declares its official intent under Federal Income Tax Regulation Section 1.150-2 that project costs may be paid from temporary advances of available funds and that (except to the extent reimbursed from grant moneys) the Town reasonably expects to reimburse any such advances fr= om the proceeds of borrowings in an aggregate principal amount not in excess of the amount of borrowing authorized above for the project.  The Town Manager and the Finance Director are authorized to amend such declaration of official intent as they deem necessary or advisable and to bind the Town pursuant to such representations and covenants as they deem necessary or advisable in order = to maintain the continued exemption from federal income taxation of interest on the bonds or notes authorized by this resolution, if issued on a tax-exempt basis, including covenants to pay rebates of investment earnings to the Uni= ted States in future years.

̶= 0;6.        That the Town Manager and the Finance Director are authorized to make representations and enter into written agreements for the benefit of holder= s of the bonds or notes to provide secondary market disclosure information, which agreements may include such terms as they deem advisable or appropriate in order to comply with applicable laws or rules pertaining to the sale or purchase of such bonds or notes.

“7.    &nb= sp;   That the Town Manager, the Finance Director and other proper officers of the Town are authorized to take all other action which is necessary or desirable to construct and complete the project and to issue bonds or notes to finance t= he aforesaid appropriation.

      = ;      Discussion:       Mr. Kane:  We were given this,= I think at the October 6th meeting, and we Tabled it because of the timing.  I think everyone has = had the opportunity to look this over during the past two weeks as well as discussions we had in the past, so I am definitely in favor of this.  I think people have come to us qui= te often regarding the empty school buildings and asking for action and I think it’s time that we do take action and we move in a positive way so I a= m in favor of this.

 

     &n= bsp;            = ;            &n= bsp;     Ms. Adams:  Can we have an ove= rview of this proposal?  I thought I= had it with me.  This in no way I’m just giving Drubner the right to market the building, it doesn’t give them to enter into any agreement with possible sellers, = that would be our right, we would reserve that right correct?
